CHC Resolution-98-06-09-02CHC RESOLUTION NO. 98-6-9-2 SITE PLAN REVIEW 98-01, MCKINLEY HOUSE/APPLE ROSE COTTAGE A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING CONDITIONAL APPROVAL OF A SITE PLAN REVIEW APPLICATION FOR PROPERTY LOCATED AT 31600 LOS RIOS STREET AND MORE PRECISELY REFERRED TO AS ASSESSORS PARCEL NUMBER 121-142-13 (MCKINLEY). Whereas, Dona Helmick and Denise Miner have requested approval of a site plan review application to construct two additions to the existing front porch adding 156 square feet; install a decomposed granite driveway, two (2) guest parking spaces, and walkway along the front (east) and right side (north) of the dwelling; erect a gazebo and rose arbor within the frontyard of the property, install resident parking to the rear (west) of the dwelling, and install a “garden/lawn retail display” area along the right side (north) of the dwelling, and, Whereas, the proposed project has been processed pursuant to Section 9-2.30 1, Development Review of the Land Use Code, and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and has issued a categorical exemption and caused a Notice of Exemption to be posted pursuant to the City’s Environmental Review Guidelines, and any mitigation measures have been included herein as conditions of approval, and has otherwise complied with all applicable provisions of the California Environmental Quality Act WQN, and, Whereas, the Cultural Heritage Commission has considered the Environmental Administrator’s determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, Whereas, the Cultural Heritage Commission conducted a duly noticed public meeting on June 9, 1998 pursuant to Section 9-2 3 13 of the Municipal Code to consider public testimony on the proposed project, and recommended conditional approval of the project. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findmgs 1 The proposed site plan review application, including site plan and architectural design, is consistent with the policies and objectives of the San Juan Capistrano General Plan, and the purpose and intent of the Los Rios Precise Plan subject to the conditions of approval contained in this resolution, and, 2 The proposed site plan review application is consistent with the requirements of the “Historic Residential” (“HR”) District, the Site Design Standards, the Architectural Design Guidelines - CHC Resolution 98-6-9-2 2 June 9. 1998 of the of the Los Rios Precise Plan subject to the conditions of approval contained in this resolution, and, 3. The proposed site plan review application complies with all applicable provisions of the Land Use Code subject to the conditions of approval contained in this resolution NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby recommends approval of the site plan review application subject to the following conditions: 1 Retail commercial business activity shall be restricted to the front two rooms of the existing residence comprising 660 square feet and the “garden/lawn retail display” area comprising about 500 square feet, and shall be limited to the sale of garden accessories, plants, gifts and similar products permitted by the Historic Residential (HR) District regulations and consistent with the project’s “business plan” The project shall maintain two (2) off-street parking spaces for retail customer use located, and designed consistent with the approved site development concept 2 The project shall provide two (2) off-street resident parking spaces designed and installed in compliance with the provisions of the Los Rios Precise Plan and Land Use Code. The applicant shall secure the necessary encroachment permit from the Engineering and Building Department for the proposed driveway entrance 3 At such time that the central public parking has been constructed in the Precise Plan District to serve the District’s parking needs, the City may require the property owner to remove off- street parking which serves the accessory commercial use on the property In addition, at such time that the central public parking has been constructed in the Precise Plan District to serve the District’s parking needs, the project may remove off-street parking originally required to serve the accessory commercial use on the property 4. Prior to issuance of a building permit, the project shall provide building plans for the design and construction of the two proposed porch additions which include materials and building details which are compatible with the existing porch design subject to review and approval by the Planning Director or his designee The porch additions will be painted to match the existing front porch 5. The applicant’s building permit plans shall not include any proposed southerly porch addition 6. The design of the proposed driveway, parking spaces, and walkway along the front (east) and right side (north) of the dwelling shall consist of decomposed granite, pea gravel, exposed aggregate, or paving block or similar material subject to review and approval by the planning Director or his designee The use of asphalt or concrete shall be prohibited CHC Resolution 98-6-9-2 3 June 9. 1998 7. The proposed gazebo shall not be permitted on site due to the historical and architectural incompatibility with the vernacular board-and-batten construction of the McKinley House 8. The two proposed side yard arbors shall consist of the “Whitewood Arbor and Planters” model as submitted by the applicant or comparable design subject to review and approval of the Planning Director The two proposed side yard arbors shall be situated outside that part of the frontyard directly fronting the dwelling The project will consider the “Whitewood Arbor and Planters” model for use as the entry arbor in order to simplify the overall project design 9.
