CHC Resolution-98-06-09-01CHC RESOLUTION NO. 98-6-9-l ARCHITECTURAL CONTROL (AC) 7 l-101 5 MODIFICATION. SITE PLAN REVIEW (SPR) 90-01 MODIFICATION. SAN JUAN DEPOT A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING DENIAL OF MODIFICATIONS TO ARCHITECTURAL CONTROL AND SITE PLAN REVIEW APPLICATIONS FOR PROPERTY LOCATED AT 26701 VERDUGO STREET AND MORE PRECISELY REFERRED TO AS ASSESSORS PARCEL NUMBER 121-141-17 (SAN JUAN DEPOT). Whereas, Guy Edwards, on behalf of Manna Station, requests approval of modifications to the site and architectural plans to allow construction of a 288 square foot patio cover with gas heaters over a portion of the existing outdoor patio located at 2670 1 Verdugo Street; and, Whereas, the proposed project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code, and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 1506 1 of the California Environmental Quality Act (CEQA) and issued a Class 1 categorical exemption and caused a Notice of Exemption to be posted pursuant to the City’s Environmental - Review Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA), and, Whereas, the Cultural Heritage Commission has considered the Environmental Administrator’s determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA), and, Whereas, the Cultural Heritage Commission conducted a duly noticed public meeting on Tuesday, June 9 pursuant to Section 9-2.3 13 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings 1. The proposed project is inconsistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Historic & Archaeologic Element because the project proposes a design approach, specifically the cantilevered porch cover design, which is inconsistent with historically appropriate building methods, and, 2. The proposed project is inconsistent with the “Secretary of the Interior’s Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings” including provisions for masonry building exteriors because the project proposes a design approach, specifically . r - . The proposed project is inconsistent with the findings established by Section 9-2 306 of the Title 9, Land Use Code for architectural control applications because the project proposes a design approach which is inconsistent with historically appropriate building methods. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage of the City of San Juan Capistrano hereby recommends denial of the proposed project.
