CHC Resolution-98-05-26-01CHC RESOLUTION NO. 98-5-26-l HISTORIC DEPICTION PROGRAM CONCEPT, BRIGHTON GARDENS/MARRIOTT SENIOR LIVING SERVICES A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING APPROVAL OF AN HISTORIC DEPICTION PROGRAM CONCEPT FOR PROPERTY LOCATED AT 31741 RANCH0 VIEJO ROAD AND MORE PRECISELY REFERRED TO AS ASSESSORS PARCEL NUMBER 666-231-03. (ARCHITECTURAL CONTROL 97-09, MARRIOTT) Whereas, Marriott Senior Living requests approval of a historic depiction program (HDP) concept for the Brighton Gardens Assisted Living Facility and has submitted a proposed concept consisting of an ornamental garden showcasing native California plants and a contemporary interpretation of a “Portola” structure consistent with the conditions of approval for Architectural Control 97-09, Marriott, and, Whereas, the proposed project has been processed pursuant to Section 9-2 301, Development Review of the Land Use Code, and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 1506 1 of the California Environmental Quality Act (CEQA) and determined that it does not constitute a “project” as defined by CEQA, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA), and, Whereas, the Cultural Heritage Commission has considered the Environmental Administrator’s determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA), and conducted a duly noticed public meeting on May 26, 1998 pursuant to Section 9- 2.3 13 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings 1. The proposed historic depiction program concept is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Historic & Archaeologic Element because the project promotes the City’s unique history; and, 2 The proposed historic depiction program concept complies with all applicable provisions of Title 9, Land Use Code, and, 3 The proposed historic depiction program concept complies with City Council Policy 606, Historic Depiction Programs CHC Resolution 98-5-26- 1 -2- May 26, 1998 NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby recommends approval of the historic depiction program concept subject to the following conditions of approval 1. The project will provide and maintain public accessibility to the proposed historic depiction program The project may provide security through fencing and locked gates between sunset and sunrise However, at all other times, the historic depiction program shall remain publicly accessible The City understands that Marriott ultimately retains the right to enforce reasonable use restrictions to protect the security of facility residents. 2 As part of the submission of preliminary plans for the proposed historic depiction program, the project shall submit draft language for the two proposed plaques (pedestal-mounted plaque and structure plaque) The discussion of the “Portola Expedition” shall be limited to the pedestal-mounted plaque and include the following elements 0 A brief description of the purpose, route, participants, and significance of the expedition. 0 A general description of the Native California plants encountered during the expedition and their possible uses by the expedition’s participants 0 A description of the various uses of Native California plants by the Native Americans inhabiting the area, as well as the subsequent Missions and early Spanish colonists. 0 A discussion of the effect of Spanish colonization and the introduction of European plants and grasses on Native California flora Because the Portola expedition, to the Commission’s knowledge, did not construct any structures, temporary or otherwise, the “structure plaque” will not include any reference to or discussion of the “Portola” expedition In conjunction with approval of the preliminary plans for the proposed historic depiction program, the Commission shall determine that specific plaque language is generally consistent with the guidelines established herein. 3. Proposed walkways shall be constructed with historically-compatible materials including, but not limited, to decomposed granite, exposed aggregate, paving stone, slate/flagstone, and similar materials The use of concrete and/or asphalt as walkway surface material shall be prohibited 4. Prior to constructing any improvements, the project shall secure City-issued building and/or grading permits for the two proposed “Celebration Garden Theme portals” and the proposed “Theme Structure” CHC Resolution 9%5-26- 1 -3- Mav 26, 1998 5 Building permit plans for the historic depiction program shall include a detailed landscape plan as well as irrigation system. The project will be designed using a drip irrigation system consistent with the proposed Native California plant palette subject to the approval of the Planning Director or his designee 6. Prior to issuance of an occupancy permit, the project will have completed the construction and installation of all approved historic depiction program elements to the satisfaction of the Planning Director, or will have posted the necessary surety and performance bonds as required by the Planning Director 7 The proposed “theme structure” structure will include a “rusticated” design approach relying in naturally occurring building materials, and will be open or partially open (e g. corner post roof support or three wall design) PASSED, APPROVED AND ADOPTED this 26th day of May, 1998, by the following vote, to wit AYES: Commissioners Allen, Belardes, Hardy, Tryon, and Chairman Siegel NOES: none ABSTAIN: none ABSENT: Commissioners Buser & Forster (c \WPWIN61\CP:AC9709hI CHR) (Qi!B%&ae Wlliam Ramsey, AICP, Seni
