A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF
SAN JUAN CAPISTRANO APPROVING AN EXTENSION OF TIME TO
ARCHITECTURAL CONTROL (AC) 17-018 FOR A NEW PRIVATE
19,000 SQUARE FOOT EQUESTRIAN FACILITY LOCATED ON AN
UNDEVELOPED 7.4-ACRE PARCEL LOCATED AT 28801 SAN JUAN
CREEK ROAD, SAN JUAN CAPISTRANO, CA 92675 (APN: 664-111-04)

Whereas, Rob Williams, Studio 6 Architects, 2753 Camino Capistrano,
Suite A-100, San Clemente, CA 92672 (the "Applicant"), has requested approval of an
extension of time to Architectural Control (AC) 17-018 to construct a new private 19,000
square foot equestrian facility located on an undeveloped 7.4 -acre parcel; and,
Whereas, the Property is General Plan-designated Planned Community
(PC), classified as Planned Community (PC) on the Official Zoning Map and regulated
by the Rancho San Juan Comprehensive Development Plan (CDP) 86-02; and,
Whereas, the proposed project has been processed pursuant to Section
9-2.301, General Review Procedures of the Land Use Code; and,
Whereas, the Zoning Administrator has considered the Environmental
Administrator's determination pursuant to Section 1507 4 of the California Environmental
Quality Act (CEQA) and finds the project categorically exempt from further review
pursuant to 15332 (In-Fill Development Projects); and,
Whereas, the Zoning Administrator conducted a duly noticed public
hearing on January 29, 2020 pursuant to Section 9-2.351 of the Municipal Code to
consider public testimony on the proposed project and has considered all relevant
public comments.
NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator
of the City of San Juan Capistrano does hereby make the following finding:
Section 1. CEQA. The project is Categorically Exempt from further review
pursuant to State CEQA Guidelines sections 15332 ("In-Fill Development
Projects"). The project is consistent with Section 15332 because the (a) The
project is consistent with the applicable general plan designation and all
applicable general plan policies as well as with applicable zoning designation
and regulations, (b) The proposed development occurs within city limits on a
project site of no more than five acres substantially surrounded by urban uses,
(c) The project site has no value as habitat for endangered, rare or threatened
species, (d) Approval of the project would not result in any significant effects
relating to traffic, noise, air quality, or water quality, and (e) The site can be

adequately served by all required utilities and public services.
Section 2. Time Extension Approval.
1. The project applicant has not proposed any changes to the project as
approved by the Planning Commission on November 28, 2017; and,
2. The applicant has demonstrated that issues or circumstances warrant
approval of a time extension. As shown by the applicant, to allow the applicant
enough time to process the required permits through the numerous agencies
as well as securing the funding necessary to build the project; and,
3. The request for time extension was submitted prior to the expiration of AC 17-
018 on November 18, 2019; and,
4. The project is consistent with Title 9 of the Municipal Code, specifically,
Section 9-2.313 and Comprehensive Development Plan (CDP) 86-2, Sports
and Recreation District. Further, neither the policies of the City's General Plan
Land Use Element nor the provisions of Title 9, Land Use Code have changed
so as to create inconsistencies or non-conformities.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning
Administrator hereby approves an extension of time to Architectural Control (AC) 17-
018, subject to those conditions contained in Exhibit "A", attached hereto and
incorporated here.in by reference.
CUSTODIAN OF RECORDS: The documents and materials associated
with this Resolution that constitute the record of proceedings on which these findings
are based are located at San Juan Capistrano City Hall, 32400 Paseo Adelanto, San
Juan Capistrano, California 92675. The Development Services Director is the custodian
of the record of proceedings.
EFFECTIVE DATE & FINAL APPROVAL: Pursuant to Section 9-2.311 of
Title 9, Land Use Code, this project approval shall become effective following expiration
of the fifteen (15) day appeal period without filing of a valid appeal application. The
appeal period ends Thursday, February 13, 2020 at 5:30 p.m. This project approval
shall be valid for a period of one year from the effective date of approval of this
resolution and shall expire on January 29, 2021, unless a time extension request has
been submitted to the City or building permits have been issued and construction is
underway.
