SUBJECT: Agreements for Engineering Services: San Juan Creek Railroad
Bridge Project (Boyle Engineering and AT&SF Railway)
SITUATION:
A. Summary and Recommendation
The Community Redevelopment Agency has been negotiating with the
Atchison, Topeka & Santa Fe Railway Co. and Boyle Engineering Corporation
in anticipation of a project to construct a new railroad bridge over San Juan
Creek and realign a portion of railroad track in the vicinity of Camino
Capistrano and San Juan Creek Road. Negotiations have been completed and
agreements reached with both of these entities, and it is recommended that
the Board of Directors approve them at this time.
B. Background
For the past several years, the Community Redevelopment Agency and the
City have been working with the National Railroad Passenger Corporation
(Amtrak), the State of California (CalTrans), and the Atchison, Topeka &
Santa Fe Railway Co. (Santa Fe) on a project to construct a new railroad
bridge over San Juan Creek and realign a portion of track in the vicinity of San
Juan Creek and Camino Capistrano. This project is beneficial to the
community as it will decrease the running time of passenger trains along the
Los Angeles -San Diego corridor, allow for future widening of Camino
Capistrano to ultimate width, and improve the development potential of land
which is presently underutilized and relatively inaccessible.
In April, 1987, the City, Amtrak and CalTrans entered into a tri -party
agreement which spelled out the responsibilities of each relative to this
project. Amtrak and Caltrans agreed to contribute $1,200,000 to fund this
project; the City agreed to pursue a grant from the Urban Mass Transportation
Administration (UMTA) in the amount of $1,800,000 to fund the balance of the
project. Additionally, the Community Redevelopment Agency agreed to be
responsible for acquiring the necessary right-of-way and for negotiating a
right-of-way exchange directly with Santa Fe. In sum, approximately
$3,000,000 has been set aside for the completion of this project.

Also in 1987, Santa Fe selected Boyle Engineering Corporation as the result of
a competitive bid process to provide railroad bridge engineering design
assistance on the project. This selection was made with the approval of the
City, the Agency, CalTrans and Amtrak. However, during the ensuing months
Santa Fe was unable to commit adequate staff time to provide necessary
project supervision in a time frame acceptable to the other parties involved.
Rather than allow the project to falter, the Community Redevelopment
Agency offered to assume project management responsibility and work directly
with Boyle Engineering Corporation to move the project towards completion.
To accomplish this task, two agreements have been negotiated and are before
the Board of Directors for approval at this time. The first is an agreement
with Santa Fe to allow the Community Redevelopment Agency to serve as
project manager on this project which will impact railroad owned property and
equipment. The agreement allows Santa Fe the right to review and approve
plans which will impact the railroad. This agreement is included as Exhibit A.
The second agreement is with Boyle Engineering Corporation for a
"Pre-Design/Right-of-Way Conceptual Study". This agreement authorizes
Boyle Engineering to acquire necessary data, develop site constraint maps,
investigate utility locations, prepare hydraulic design parameters, evaluate
bridge location and track alignment, develop a conceptual grading plan,
evaluate alternative right-of-way/land exchange options, and develop a
schedule of project costs for the ultimate construction of the new bridge and
realigned track. The agreement for these services is attached as Exhibit B. It
allows approximately five months, or until March 1, 1989, for the completion
of this conceptual study.
While somewhat different than the agreement Santa Fe had originally been
negotiating with Boyle Engineering Corporation, the Community
Redevelopment Agency's agreement provides for a more comprehensive
analysis of all design constraints which may impact the later construction of
the railroad bridge and track project. Thus, it will be known on March 1 if the
project remains viable given flood control, drainage, right-of-way, and design
impacts.
During the last few months, Agency and City staff have spent a great deal of
time working with Boyle Engineering Corporation and Santa Fe to help them
better understand the importance of these improvements to the community.
With the Community Redevelopment Agency assuming responsibility for
management of this project, staff is confident that these improvements will be
made in a timely fashion.
COMMISSION/BOARD REVIEW & RECOMMENDATIONS:
Not applicable.
FINANCIAL CONSIDERATIONS:
The cost of the conceptual study to be completed by Boyle Engineering Corporation is
$65,806. Amtrak and CalTrans have agreed, through the tri -party agreement entered
into in April, 1987, to pay the cost of this study. Upon approval of these agreements

between the Community Redevelopment Agency, Boyle Engineering Corporation and
Santa Fe, funds will be made available to the Community Redevelopment Agency by
CalTrans to pay all costs associated with the proposed Boyle Engineering Corporation
agreement. It is requested that $66,000 be appropriated from the Community
Redevelopment Agency's administrative fund reserve to cover the cost of the conceptual
study. There is no cost to the Community Redevelopment Agency to enter into the
proposed agreement with Santa Fe.
NOTIFICATION•
Boyle Engineering, the Atchison, Topeka & Santa Fe Railway Co., the California
Department of Transportation and the National Railroad Passenger Corporation are
aware these agreements are being considered by the Board of Directors at this time.
ALTERNATE ACTIONS:
Move to approve the agreement and the additional appropriation for a
Pre-Design/Right-of-Way Conceptual Study with Boyle Engineering Corporation and
the agreement with the Atchison, Topeka do Santa Fe Railway Co. for railroad
realignment engineering work and authorize the Executive Director of the
Community Redevelopment Agency to sign these agreements.
2. Move to approve a modified agreement for Pre-Design/Right-of-Way Conceptual
Study with Boyle Engineering Corporation and a modified agreement with the
Atchison, Topeka & Santa Fe Railway Co. for railroad realignment engineering work
with modifications and authorize the Executive Director of the Community
Redevelopment Agency to sign these agreements.
3. Request more information from staff.
RECOMMENDATION:
Move to approve the agreement and transfer funds from the administrative fund reserve
to account No. 26-6900-4720-C21 for a Pre-Design/Right-of-Way Conceptual Study with
Boyle Engineering Corporation and the agreement with the Atchison, Topeka do Santa Fe
Railway Co. for railroad realignment engineering work and authorize the Executive
Director of the Community Redevelopment Agency to sign these agreements.
