Julian, City Manager FROM: Pamela Hallan Gibson, Senior Administrative Assistant SUBJECT: Agreement for Lease of Land for Landscaping Purposes (AT&SF Railway) CT TI IATT nN At the last meeting, Council reviewed the proposed agreement for lease of land for landscaping purposes supplied by Atchison, Topeka and Santa Fe Railway. This is a standard agreement form and cannot be altered; thus, the sections which do not apply in our situation must remain in the agreement. The leased area will extend from Mission Street on the north to the end of Mission Village Center on the south and will omit those portions already leased to others. Later, we will extend the area to Oso Road on the north and the railroad bridge on the south. A map is attached. FINANCIAL CONSIDERATIONS: There is no cost associated with the lease. ALTERNATE ACTIONS: I. Approve the lease of land for landscaping purposes and authorize the Mayor and City Clerk to sign the lease on behalf of the City. 2. Request further information. RECOMMENDATION: By motion, approve the lease of land for landscaping purposes and authorize the Mayor and City Clerk to sign the lease on behalf of the City. CONCEPT APPROVAL OF LEASE AGREEMENT - RAILROAD RIGHT-OF-WAY LANDSCAPING (ATCHISON, TOPEKA AND SANTA FE RAILROAD) (38) Written Communications: (88) Report dated May 17, 1983, from the Senior Administrative Assistant, forwarding an AT&SF Standard Agreement for leasing land, which the City will use for right-of-way landscaping purposes from Mission Street to the southernmost edge of Mission Village Shopping Center. A preliminary landscape plan, schedule and budget are being prepared for presentation at the June 7th Council meeting. Conte t Approval: It was moved by Councilman Schwartze, seconded by Councilman Hausdorfer and unanimously carried to approve the lease agreement in concept and to authorize the City Manager to continue negotiations with the railroad, bringing back the final lease for signatures at the time the landscape plan is submitted. Councilman Schwartze commended staff for their work in resolving the matter; there was a consensus of Council that a letter be prepared expressing the City's appreciation for the cooperation received from the railroad. 4-71, z6.
