ADOPTION OF ORDINANCE NO. 907
Notice is hereby given that on August 2, 2005 the City Council adopted Ordinance No.
907 entitled:
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, APPROVING AND ADOPTING A DEVELOPMENT
AGREEMENT FOR THE SAN JUAN MEADOWS (ADVANCED GROUP
SJ -99) (APN 666-311-02, 03 & 04) (TTM 14343)
Ordinance No. 907 adopts a Development Agreement for the San Juan Meadows
project, between the City of San Juan Capistrano and Advanced Group SJ -99, a
California limited partnership, the developer. The San Juan Meadows project is a
proposed development for 275 single-family detached lots and a parcel for future senior
housing, situated on a 135.63 acre parcel. The parcel is located along the south side of
La Novia Avenue, about 300 feet from Valle Road. The development agreement
provides for vested rights to develop the property, defines permitted uses, extends a
tentative tract map, provides for the developer's obligation to pay certain fees, and
establishes developer requirements, subject to Design Review approval, Parks,
Recreation and Equestrian Commission approval, Planning Commission approval,
among other requirements. The agreement establishes other terms related to review
periods, termination or default, third party litigation, mortgagee protection, insurance,
indemnity and miscellaneous provisions.
Ordinance No. 907 was adopted by the following vote:
AYES: Council Members: Allevato, Soto, Swerdlin & Mayor Hart
NOES: Council Members: None
ABSENT: Council Members: Bathgate
