05-0719_ADVANCED GROUP 99SJ_E1_CorrespondenceLO Page 1 of 2 I ask that the city before entering into any agreement with the Advance Group 99 -SJ, that there be clearly defined protection written into the agreement for the residents of Capistrano Terrace. If the development of revised tract map (TTM) 14343 San Juan Meadows causes the damage I foresee when grading begins, that the applicant be responsible for the concerns I have drafted for myself and my neighbors, especially the seniors, the disabled, the low income families that reside in Capistrano Terrace. I asked that the city give the HOA of Capistrano Terrace 30 days to finalize this draft and petition it to the residents so that the group who will be the most impacted by this development be given fair and adequate representation and protection in the agreement. I believe that by doing so will allow the Advance Group to proceed in completing its long overdue project without possible litigation from the residents of Capistrano Terrace. Before entering into any agreement with the Advanced Group 99 -SJ, I would like the city to consider these additions to the agreement for the revised tract map (TTM) 14343 San Juan Meadows. This draft will be finalized and petitioned to the residents Capistrano Terrace. 1. A 90 day period to allow the independent appraisal of the current resale value for each mobile home by any resident who wishes to do so. The cost of each appraisal being applied to space rent being paid by that resident. 2. Create a detailed plan for the relocation or purchase of any mobile home at the appraised value by the Advance Group 99 -SJ that will be affected by any grading done in preparation and or during the development of revised tract map (TTM) 14343 San Juan Meadows. 3. In the case for those residents who are one or more of the following and who have resided in the park for a minimum of 12 months; over 52 years old, permanently disabled or qualify for low income housing, that they be given first right to any affordable housing built proposed in revised tract map (TTM) 14343 San Juan Meadows. 4. For the rest of the residents who do not fall under concern 93, that they be given first right to purchase a single family residence in San Juan Meadows at a reduced price that they can qualify for given the resident's current income and the current standard of loaning institutions ratio for income vs mortgage payment amount. Any park resident who purchases a home in San Juan Meadows will not be allowed to resell or rent the home within the first 20 years without giving the Advance Group 99 -SJ 75% of any proceeds generated by the sale or renting after subtracting any costs associated with improvements done by the owner and any costs levied by the future home owners association outside of normal monthly dues. This number of homes to be limited to no more then 50 of the proposed 275 home projected. In the case of more then 50 residents fall under concern #4 a lottery will chose 50 residents with the remaining group being given $5,000.00 in addition to what they will receive under concern #2. In the case that Capistrano Terrace survives the grading and development of revised tract map (TTM) 14343 San Juan Meadows, to not allow the remedial grading being done at Capistrano Terrace in association with the revised tract map (TTM) 14343 San Juan Meadows agreement to be considered as a capital improvement or maintenance on a capital improvement and the costs being assessed to the residents of Capistrano Terrace. Considering the amount of development this area is facing and has already undergone, at the very least a new Environmental Impact Report should be done, since the one on file is obsolete. If you are not already, the residents have received notice that our slopes are unstable which may require the removal of some or all of our homes. We have no idea, other than being told it will be weeks, before knowing if homes have to be moved and if so exactly how many, where they will go, if they will be brought back and who is going to cover the costs of it. We have been told that the City has ordered additional soils testing so a determination can be made. I ask that you keep in mind, that in the meantime, the value of our Homes is being affected by this along with the ability to sell them. I know this first hand because mine was listed for sale. How can this project, with the major grading that needs to be done, not impact us? It already has, the run off from this property during the course of the last 25 years, has contributed if not caused a major part of the slope erosion and resulting damage caused by drainage problems that now put us in a position for the possibility of losing our homes as a result. The fact that six landslides came over the top of the back wall, from their property during the last intense rains, should be considered along with the fact that they didn't place plastic on this slope prior to this, only afterward. The fact that Advanced Real Estate Services has done nothing to address these issues, even though they now own Capistrano Terrace, should be a very good indication of their level of concern for the residents of our community. When unusually heavy rainfall occurred during the winter and additional slope erosion was observed along with a toppled (retaining) wall, a more comprehensive soils analysis of the entire park was ordered. That study entailed deep borings in several locations within the park to develop an understanding of the underlying soils structure as well as the condition of slope surfaces. This was a very expensive and unexpected cost incurred, but undertaken to insure the safety of our residents. This work was accomplished by the geologic firm of Lawson & Associates Geotechnical Consulting, Inc. The draft report was sent to us and we immediately forwarded a copy to the City of San Juan Capistrano for their review. The park owners met with city officials, and the city has requested that additional studies be completed on the park. The same geologic firm will do this continuing study within the next few weeks. A copy of the report summary pages will be available for your review in the Capistrano Terrace MHP office upon receipt. It is on the advice of city officials that we provide you with this notice of the potential requirement for extensive remedial grading, pending the outcome of the additional soils analysis to be done. This is of great concern to us because this could require the removal of some or all of mobile homes from the park. We will keep you advised when additional information becomes available. (Tentative Tract Map (TTM) 14343, San Juan Meadows). It has been brought to my attention this week by doing some other local research in City Hall, that a Comprehensive Development Plan 81-01, Forster Canyon Planned Community, plans to work 300 feet east of Valle Road located along the south side of La Novia. Although we own a site located at 32802 Valle Road Space No 127, San Juan Capistrano CA 92675 and within 500 feet of this project location, we did not receive notification by mail for this agenda item. I have checked with over 70 residents within the Capistrano Terrace mobile home park to find out that they had not received notification from the city or from the parks owner Rick Julian, of Advanced Group. Upon receiving a copy of this notice yesterday and by verifying it with the cities website it appears that the plans are located within/or very near the perimeter of the Capistrano Terrace mobile home park. The park residents are unaware of this. I think the city needs to clarify, before development approval that this location of 300 feet east of Valle will have no negative impact of the quiet and peaceful enjoyment of the residents living within the Capistrano Terrace Mobilehome Park. Since former Geotechnical reports recommend that no building be done on that slope, I think the city should re -consider any remedial grading on that slope. Several seniors in San Juan Capistrano have also noted that that agreement fails to mention affordable or low income housing for them. This is of concern considering the expensive rates of some other senior retirement homes within our area. As a member of several state, local and national organizations it is requested that the outdated Environmental Impact Report be revised to reflect the current conditions of today in the San Juan Capistrano area. Groundwater is a huge issue, along with traffic conditions, nature and the wildlife of our beautiful southern California community. The comprehensive development agreement needs revision as well. What actions may the city enforce to guarantee that this "new" park owner and management maintain the park properly? Again, I ask that the City postpone signing a development agreement with San Juan Meadows (TTM 14343), revise the EIR, consider the neighboring residents, and do further investigation until these and other necessary concerns are met.
