EX ECUTIVE SUMMARY : On April 16, 2019, the City Council voted to defer action on the Northwest Open Space (NWOS) Community Park Project, also known as the "Putuidem Village ," as well as suspend preparation of an Exclusive Negotiation Agreement with Red Tail Acquisitions, LLC, until the public had an opportunity to provide input on preferred uses for the overall NWOS property. Pursuant to City Council direction, the purpose of this report is to provide information from the community workshops that occurred in June 2019, as well as results of an online survey conducted in August 2019. DISCUSSION/ANALYSIS : On June 5 and June 24, 2019, the City conducted public workshops at the San Juan Capistrano Community Center to receive input from the community on desired uses and amenities for the City-owned NWOS property. In preparation for the workshops, the City conducted a robust outreach effort to encourage public participation . A city-wide notification was mailed to all property owners and businesses (Attachment 1 ), and a dedicated NWOS webpage was created to provide information regarding the location and current uses of the property, purchase history, General Plan Land Use and Zoning designations , the Request for Proposal (RFP) process for limited use of the property, and the proposed NWOS Community Park Project. Weekly announcements regarding the workshops were also included in the City Manager's Weekly Update that is sent via e- mail to approximately 1,200 subscribers. City Council Agenda Report September 17, 2019 Page 2 of 4 At both workshops, City staff provided a detailed presentation (Attachment 2) on the NWOS property, followed by a question and comment period facilitated by a subcommittee comprised of Mayor Maryott and Mayor Pro Tern Bourne . Approximately 100 participants were in attendance at each workshop, and in addition to public comments a total of 22 written comment cards were returned (Attachment 3). The workshops were video recorded and can be viewed in their entirety on the City's website. Residents who could not attend either workshop were also encouraged to submit written correspondence to the Office of the City Clerk. All written correspondence received is included as Attachment 4 to this report. To supplement verbal and written feedback received at the workshops, and in an effort to reach additional residents that were unable to attend, the City released an online survey that was available from August 1 -31, 2019 . Flyers advertising the survey were available at City Hall, the Community Center, and the Library . Links to the survey were available in multiple locations on the City's website, and weekly e-mails were sent to those who subscribe to City notices . The San Juan Capistrano Chamber of Commerce also sent out the survey to their subscriber list to solicit input from the business community. The survey included questions regarding how often respondents visit the NWOS and the primary purpose of the visit, what features and amenities respondents would like to see at the NWOS, and prioritization of potential NWOS amenities in the context of other City projects and services. The survey also allowed respondents to provide comments. A total of 496 survey responses were received and are included as Attachment 5 to this report. Of the 496 respondents, 382 indicated they were San Juan Capistrano residents. FISCAL IMPACT : There is no immediate fiscal impact associated with the recommended action . ENVIRONMENTAL IMPACT : In accordance with the California Environmental Quality Act (CEQA), the recommended action is exempt from CEQA per section 15061 (b)(3), the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where is can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Approval of the recommended action would not be an activity with potential to cause a significant effect on the environment and therefore is exempt from CEQA. PRIOR CITY COUNCIL REVIEW : On April 16, 2019, the City Council suspended consideration of the revised plan for the Northwest Open Space Community Park Project, also known as the "Putuidem Village," and an Exclusive Negotiation Agreement with Red Tail Acquisitions, LLC, for limited use City Council Agenda Report September 17, 2019 Page 3 of 4 of the City-owned Northwest Open Space (NWOS) property, and directed staff to conduct public workshops to receive input from the community on potential uses of the property. Dare I say, your leadership is lacking? Once again I will ask you to listen to the more-than-modest proposal from our Native American community. These are their ancestral lands. Their voices are important, but arc very definitely being ignored. As a native Californian, l was taught from an early age all about the missions of California and the missionaries "struggle to lame the land and people of this area." \Vhat I was not taught is what the Native American community endured and how they were involved. I didn't learn this until much later in life, and that's just not right, and certainly not a well-rounded and proper education. As we look around this county and country today, we see what a lack of a well-rounded education can do to our social fiber. We desperately need to understand ALL points of view, and this is so lacking when it comes to the Native American story. Putuidem Park needs to be brought to life and have a meaningful place in the community. San Juan Capistrano should be taking the lead on this for the County of Orange. Although I am not a resident of San Juan Capistrano, I have lived in Orange County for many years, and truly feel the ongoing disconnect. How many more years will the City Council continue to draw this process out and dangle the carrot before the Native American community? The N011hwest Open Space is all that's left. The City has allowed destruction of the core area of the Putuidem archaeological site with the construction of JSerra High School gym and athletic fields. NOW is the time to honor the very people that built the mission and the Los Rios Historic district. It's time to give back to this community. Further delays are simply not acceptable. I'm not paying taxes on vacant land so that a developer can make money off me. That was not the bonds original intent. Many people come to the Los Rios district now from all over. I myself talked to a couple from Pasadena last weekend . However, now you are changing the historical aspect of this area by putting in a retail etc center. What is historical about that? Greed is causing downtown Los Rios to become just another everyday area and so why would people keep coming here? While the Spanish fathers shared their Christian beliefs out of love for the natives, they nonetheless saw their cultural beliefs as inferior, not worth keeping . The Mexican government took their land and gave it to their friends as Land Grants. The Americans took many of the grants for themselves, and once gold was discovered and some natives made claims of their own, a bounty was put on their heads, murdering al least 16,000. For years, those not rounded up into reservations hid in fear. Through all this, Orange County's own tribe has still survived. San Juan is home to ab out 100 families, and more than 1000 still live In Orange County. Our local famllies, led by people like Teresa Romero and Happy Hun are kind and gracious, as were theirforebearers who first met Father Serra, according to the biographer who traveled with him, Father Francisco Pa11ou . To begin getting to know them, watch the video series "Indigenous Voices of San Juan Capistrano" online. Now, our city has a great opportunity to restore a bit of the cultural history and traditions of the Acjachemen people on one acre where their main village was located, securing for ourselves and our posterity one of the most fascinating aspects of our city's very long history. We have the chance to learn how the beliefs and traditions of the Acjachemen people helped them to thrive ln this place for 10,000 years without using up or debasing the land and resources as some tribes in other places did. The lessons we learn may even help us to sustain our beautiful valley in years to come. Do I believe we should build the Putuidem Village Cultural Center? Yes. Do I believe it should be a priority for our city? Definitely. We have the funds -both to build it and to maintain it. What is needed is a designated allowable use for this cultural center within the Community Park Framework As another resident, Dave Solt said recently, the Pre-Contact Narrative is missing in our story, and It will be a source of pride for all of us. What to do with the rest of the open area? Our Acjachemen Committee has asked that it be restored to its natural plantings so that visitors can enjoy it as it was. Certainly, filling It with 150-250 RV pads, a few cabins and Alrstream trailers, a clubhouse, a store, etc. as has been proposed, is not the answer. It would dig into archeologically significant land mercilessly and fill it with inappropriately intense for- profit development that most of our residents would never enjoy. Restore the original plantings, include trails to enjoy them, and call it done. I have taken swim classes al Saddleback College, bu1 once you have taken all the swim classes available, you may no longer retake them for fun. Then San Clemcnic opened a community pool, but if you are not a resident, you have to pay $8 each time you want to use their pool. Or you can join the new SJC 24 hr fitness and use their pool, but it will cost you $48 per month and they only have 3 Janes. As our population ages, as well as new families bearing new children, swimming is a great recreatit"m for all ages as well as providing an oppo1tunity for non-impact exercise and learning pool safety. Our beloved town feels different in all the best ways. It beats to it's own drum and isn't trying to be a cookie- cutter version of it's surroundings. San Juan is really a special gem. Where else can you get an old world feel, historic beauty, family friendly, and gorgeous development-free surrounding ridges and hills that's all of S minutes from the beach?! It's where home feels right and a place that I'm so happy to be raising my 3 children in. Along those lines, I'm saddened to hear that the city owned Northwest Open Space property is being considered for any sort of development. I'm all for maintaining our city and upgrading where necessary, keeping areas clean and safe for our residents; however this feels inherently different. It feels as if we are trying to "keep up" with the newness around us in the likes of Rancho Capistrano, Ladera Ranch, Baker Ranch, etc. That's not San Juan. We're already getting a huge hotel right in the center of town. And another one proposed by the Egan House. Those projects are amongst an already developed area, which makes sense. However why can't we keep open spaces just that? ... undeveloped, untouched open spaces that are scenic and natural? Again, if it's "cleaning it up" a bit and making some usable trails or building a nice restroom, adding grass to the dog park, etc. than I'm all for that. But considering a full blown amphitheater? Or worse, a campground'?!!!! That is a horrific idea. The Red Tail Acquisitions Proposal is flat-out dangerous. Campgrounds often bring trash, noise, drugs/alcohol, vagrants, homelessness, etc. to it's area and the surrounding areas. I live a mere mile from the Northwest Open Space and would feel very unsafe having my family that close to an area where passerby's are coming and going with little respect to the beautiful city that we call home. In your discussions and conversations about this rare area, I beg you to please be extremely careful in how you treat such precious land. Please be cognitive of the residents of San Juan Capistrano. Please put the well being of the residents and what's right ahead of a bottom-line or profit. Please cherish this city as much as it should be cherished. And please do NOT build any sort of campground nor anything resembling a campground, glamping, or anything of the sort. I attended Monday's forum at the Community Center, but left early and did not speak. As a resident since 1980, and having served on the City Council from 1994 to 200 6/. here are my thoughts: 1. The use of the NorthWest Open Space should be as passive as possible, while incorporating the non-conforming uses that are present. 2. A fair number of acres should be set aside for our First Residents/Native Americans' Village, for their uses and ours. 3. A community garden (see One Positiva Way) would be appropriate. 4. Walking trails, picnic areas, and native plantings are appropriate. All of the residents I have talked with see the NorthWest Open Space as a passive use .. El Camino Real and Ortega entrances from 01.,1r city limits in town define our community. It calms the mind as we return home. I would ask that we take the time to insure that our zoning, etc. conforms to our General Plan (which needs updating per code). Passive Open Space is the primary reason why our residents voted to own and maintain over 40% open space In city limits. No glamping, camping, soccer fields or other revenue enhancing venues. The city has an appropriate number of sports parks and equestrian stables for our residents. (Other cities use our parks and stables because they did not provide enough of them for their residents as it is.) With two new hotels and the River Street project, the city will have a new source of revenue to access for the benefit of our residents. Revenue enhancing uses bring with it a liability that the city does not need. If we are found just one percent liable in an incident that occurs on city property, litigators will try to access our deep pockets. I know that from serving on the Executive Board of the California Joint Powers Authority for ten years. An example Is the $8 million plus we incurred at the equestrian park we lease out on our Eastern entrance. This issue is a hot button issue with our residents. I have seen lesser issues result in costly referendums and recalls. 37 Having served 12 years as a Council Member, I can appreciate your efforts, time and service on behalf of our resident. We publically thank Mayor Maryott for his integrity and political courage in honoring the San Juan's citizens original understanding and intent that their vote and subsequent tax money would be used for open space and, certainly not another commercial revenue generator for the City. We respectfully disagree with Staff that since the bond that purchased the subject property has been paid off, "therefore, the property may be sold or leased without and bond restrictions." Sta(fgives 110 cite as to the legal authority for their claim. While that may be true for a general-obligated bond, the subject property was purchased for funds authorized and collected by a referendum specifically for "open space." The case-law governing exact wording in initiatives and referendums is well known. The wording in the subject referendum was specific and precise for "open space." There was no "notice" that once the bond was paid off, the purpose stated in the referenda could be ignored. If Staff has a stature or case-law cite that clearly refutes the above assertion, please provide the cite(s). A commercial campground with all its frequent turnover and noise does not belong in this open space. The dramatic reduction in protection for the subject open space property by changing from a CP zoning to a OSR zoning is shown in Staffs "Northwest Open Space Zoning Designation" Table, "campground (RV, Trailer & Tent)" is allowed in only the OSR and RP zones. Clearly, the subject property is not a "regional park." If the Planning Commission and Council considers this project, an EIR will be required. If it is not, that would trigger a legal action. Please leave the subject property zoned as CP, and find another use that is truly compatible with the San Juan voter who wanted open space and voted and passed the referendum. A suggestion: A community garden with individual "plots" where San Juan citizens could raise their crops. The City of Orange has one, and it is always utilized. Absolutely a no to the RV Park. Move it out on the Ortega Hwy. where it belongs. Traffic will be unbearable. As a resident it is already impossible to get around town to do errands or to even get to the freeway. Those who say it is not a problem, obviously don't live where they have to deal with it on a daily basis. I am very disappointed in the city's decision to charge for parking in the Los Rios lot. You certainly are simply catering to tourists and tourist dollars. Makes it difficult for those of us who live in town to support the businesses . I like to spend my dollars eating and enjoying this special area, but you continue to make it difficult to do this by adding additional expenses. Has any consideration been given to provide stickers to residents for parking like is done in some other cities?? Lastly, what this city is doing to the Putuidem project is a travesty. This has been in process for years and just keeps being set aside. Additionally, the space has been cut by more than 50% which is ridiculous. There is no logical reason from what I heard this week to keep pushing this aside for your big revenue projects. I and many other citizens hope that you will stop stonewalling this project and move forward. This is a well deserved honor for the people who made this town the special place it is and to honor their ancestors. We moved here because we liked how it is less developed, undeveloped hillsides, unlike the South Bay .... too developed. It was either south of mission viejo or north to ventura or santa barbara. We always get compliments from family and friends . Then we heard of all the law suits. Wow, awesome! To me, it couldn't be more clear what the citizens of San Juan wanted with multiple approved measures over the years .... D and X. It is evident that the majority of the council does not know what their responsibilities are ..... REPRESENT THE CITIZENS OF SAN JUAN, not themselves. Its very suspicious. No commercial development for the Northwest open space!!! I understand that we are in the black, not red. Even if we were in the red though, the voters have already spoken in regards to this area. A campground is obviously not the intent for those measures. Common sense. What to do: Tie new trails to existing trails to the south, one for walking another for equestrian use. I wish you and the rest of the Council an abundance of patience and consciousness of deliberate stepping forward as you review and plan the next steps in this process. I moved to San Juan Capistrano with my parents in 1974. Other than living in Irvine for several years, my family and I bought a home here in 1992. I've seen many developments go up, road changes, and of course population changes. Often times the interest of the city is not the best for our city's cultural heritage, and open space. People are bought off, or taxable income is the priority. A park sounds like a great idea, excluding the campground, in light of our growing homeless population and the problems that come with it. Cities do not have control over homelessness, and I fear a campground or park may be a magnet for the homeless. A park less so than a campground. A horrible idea for a beautiful gateway to our city. Their history includes being uprooted from their village home of Putuidem and the surrounding area by Spanish missionaries and brought to the Mission site, treated as a lesser form of a human. They were forced to build the Mission, renamed the Juanefios Band of Mission Indians, and adopt a strange new faith. Following the American occupation of California in 1846, the "claims of Indians who had acquired land in the 1841 formation of the San Juan Pueblo, were ignored, despite evidence substantiating the Juanefios' claims." To further complicate their lives and dehumanization, the Governor of California called for the extermination of the indigenous population in 1851, and over the next 20 years, 80 percent of California's Native Americans were wiped out. Between 9,000 and 16,000 were murdered in cold blood ---the victims of a policy of genocide sponsored by the state of California and gleefully assisted by its newest citizens. In 2003, cultural genocide continued when the City Council approved the building of Junipero Serra High School on land sacred to the Acjachemen. Today their sacred burial ground is a soccer field. In 2016 the City Council approved the Putuidem Village Cultural Center, and after numerous reviews and concessions, the City Council approved plans and specifications for the Center on May 15, 2018. Then , less than a year later, on April 16, 2019, the new City Council voted to table the project until the community has had an opportunity to provide input on what it would like to see in the Northwest Open Space area. Enough! The sacred sites and lands of the Acjachemen descendants have been plundered, desecrated, and devoured by development over the past 243 years. We paid for that land and if you're going to do something to it other than what it was originally intended for. give us our money back and give us the full face value of what it is valued at now .I don't think it's fair that wasn't the intention of the founders to have that land developed with the exception of the Native Americans putting their there Camp there.
