PC Resolution-19-06-25-01PC RESOLUTION NO. 19-06-25-01 SIGN PROGRAM (SP) 19-014 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING SIGN PROGRAM (SP) 19-014 FOR THE INN AT THE MISSION PURSUANT TO CONDITION OF APPROVAL NO. 95 OF ARCHITECTURAL CONTROL (AC) 10-002, AND FINDING THAT SUBSEQUENT ENVIRONMENTAL REVIEW IS NOT REQUIRED PURSUANT TO PUBLIC RESOURCES CODE, SECTION 21166, FOR THE INN AT THE MISSION LOCATED AT 26871 & 26891 ORTEGA HIGHWAY, GENERALLY LOCATED AT THE NORTHEAST CORNER OF ORTEGA HIGHWAY AND EL CAMINO REAL (ASSESSOR PARCEL NUMBER 124-170- 12,14,15,16)(APPLICANT: DAN FRIESS, MISSION COMMERCIAL PROPERTIES) Whereas, Dan Friess of Mission Commercial Properties, 31866 Camino Capistrano, San Juan Capistrano, CA 92675 (the "Applicant"), on behalf of South Coast Investors II, LLC (Property Owner), has requested approval of Sign Program (SP) 19-014 to establish uniform and consistent signage for the Inn at the Mission located at 26871 & 26891 Ortega Highway (APN: 124-170-12,14,15,16) which has General Plan Land Use Designation of General Commercial I Comprehensive Development Plan (CDP) 10-01 and a Zoning Designation of Town Center (TC) I Comprehensive Development Plan (CDP) 10-01; and, Whereas, South Coast Investors II, LLC are the owners of real property located at 26871 & 26891 Ortega Highway (APN: 124-170-12, 14, 15, 16); and, Whereas, the project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and has determined that - pursuant to Public Resources Code, section 21166 and State CEQA Guidelines, section 15162 -no further environmental review is required for the sign program because the sign program was part of the project evaluated in the certified Plaza Banderas Hotel Project EIR (SCH#2010051075); and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 1507 4 of the California Environmental Quality Act (CEQA); and, Whereas, the Planning Commission conducted a duly-noticed public meeting on June 11, 2019, pursuant to Title 9, Land Use Code, Section 9-2.302 and City Council Policy 5 to consider public testimony on the proposed project and considered all relevant public comments; and, Whereas, the Design Review Committee reviewed the details of the sign program on April 25, 2019 and recommended approval to the Planning Commission. PC Resolution 19-06-25-01 2 June25 2019 NOW, THEREFORE, BE IT RESOLVED, thatthe Planning Commission of the City of San Juan Capistrano does hereby find that -pursuant to Public Resources Code, section 21166 and State CEQA Guidelines, section 15162 -no further environmental review is required for the sign program because the sign program was part of the project evaluated in the certified Plaza Banderas Hotel Project EIR (SCH#2010051075). The sign program was expressly contemplated as a future action in the certified Plaza Banderas Hotel Project EIR. (See Draft EIR, p. 3-14.) The sign program would not: (1) constitute a substantial change to the project that will require major revisions of the certified Plaza Banderas Hotel Project EIR (SCH#2010051075) due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and, (2) constitute a substantial change with respect to the circumstances under which the project is administered that will require major revisions of the certified Plaza Banderas Hotel Project EIR (SCH#2010051075) due to the involvement of new significant environmental effects or a substantial increase in the severity of the previously identified significant effects; and, (3) involve new information of substantial importance that was not known and could not have been known with the exercise of reasonable diligence at the time the Plaza Banderas Hotel Project EIR (SCH#2010051075) was certified that shows any of the following: (a) the project will have one or more significant effects not discussed in the certified Plaza Banderas Hotel Project El R (SCH#2010051075); (b) significant effects previously examined will be substantially more severe than shown in the certified Plaza Banderas Hotel Project EIR (SCH#2010051075); (c) mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or (d) mitigation measures or alternatives which are considerably different from those analyzed in the certified Plaza Banderas Hotel Project EIR (SCH#2010051075) would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative. Thus, the proposed sign program would not require preparation of subsequent environmental documentation; and, NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings as established by Section 9-2.343 of Title 9, Land Use Code of the City of San Juan Capistrano in support of Sign Program (SP) 19-014: 1. The sign program is consistent with the General Plan and Design Guidelines, and is complementary to the architecture and design of the development project because the sign program is consistent with the following General Plan Community Design Element policy and Design Guidelines: • General Plan Community Design Element Policy 1. 2 Encourage high-quality and human scale design in development to maintain the character of the PC Resolution 19-06-25-01 3 June 25 2019 City. The signs are to be constructed from durable industry standard materials, and the design of the signs comply with Chapter 4, Architectural Design Guidelines of Comprehensive Development Plan (CDP) 10-01. Furthermore, the signs also comply with the following Architectural Design Guidelines: Design Guidelines, Chapter 8, Signs C. General Sign Design Guidelines 1. Colors a. Restrained use of color is recommended, use of multiple colors is discouraged. c. Use of contrasting colors to achieve visually pleasing signs should be considered as part of the sign design process. 2. Materials a. The following materials are recommended for signs in San Juan Capistrano: • Wood -carved or sandblasted • Metal -formed, etched, cast or engraved 3. Sign Copy/Lettering Style/Spacing a. A limited number of lettering styles should be employed in sign design to increase legibility. The number of different lettering types should not exceed two for small signs and three for larger signs. b. Avoid using overly intricate typefaces as well as crowding of the sign text. 5. Placement a. Siqns should be placed in proximity to the main business entrance. C. Wall and Building Signs a. Wall signs should not project away from the surface upon which they are attached by more than the minimum required distance for construction purposes and in no case by more than 12 inches. 5. Freestanding Signs b. Freestanding signs should include a 2 ft. high (min) base. The base color(s) and material(s) should be compatible with the architectural theme. 2. The sign program conforms to all applicable requirements of this Code and any applicable specific plan or comprehensive development plan because the proposed sign program is required by Comprehensive Development Plan (CDP) 10-01 and because the new signage design is architecturally compatible with the buildings. The sign program is consistent with Comprehensive Development Plan (CDP) 10-01, Chapter 4.1.1 Overall Goals: "The Plaza Banderas Hotel and Mixed-Use Development project shall comply with design principals from the City's General Plan Community Design Element; 1) Reinforce and enhance the City's downtown as one of the primary focal points of the community; 2) Contribute to the existing pedestrian-oriented "village-like" environment;" Through the sign program, the applicant has created a visually pleasing method of providing compatible and complementary signs to minimize visual clutter. The sign program is generally compatible with the design character of adjacent properties and/or rights-of-way because the signs will not impact the right-of-way and will not create light or glare impacts to the adjacent properties. Furthermore, the City's Design Review Committee has reviewed the proposed building mounted signs and monument signs, and has recommended approval. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the project subject to those conditions of approval established by Exhibit A, attached hereto and incorporated herein. CUSTODIAN OF RECORDS: The documents and materials associated with this Resolution that constitute the record of proceedings on which these findings are based are located at San Juan Capistrano City Hall, 32400 Paseo Adelanto, San Juan Capistrano, California 92675. The Development Services Director is the custodian of the record of proceedings. NOTICE OF DETERMINATION: The Planning Commission hereby directs staff to prepare, execute and file with the Orange County Clerk a Notice of Determination within five (5) working days of the approval of this Resolution. SEVERABILITY: If any provision of this Resolution is held invalid, the remainder of this Resolution shall not be affected by such invalidity, and the provisions of this Resolution are severable. PROTEST OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS: Pursuant to Government Code Section 66020, the applicant may protest the imposition of fees, dedications, reservations or other exactions imposed on this development project by taking the necessary steps and following the procedures established by Sections 66020 through 66022 of the California Government Code. Sergio Klotz, Assistant Development Services Director/Secretary Project#: Project Name: APPROVAL DATE: EXHIBIT A RESOLUTION #: 19-06-25-01 CONDITIONS OF APPROVAL Sign Program (SP) 19-014 Inn at the Mission Sign Program June 25, 2019 These conditions of approval apply to Sign Program (SP) 19-014, a request to establish uniform and consistent signage for the Inn at the Mission located at 26871 & 26891 Ortega Highway (APN: 124-170-12,14,15,16). Any proposed changes to this approval shall be submitted to the City Development Services Department, along with the required application and deposit or fee, for review. For the purpose of these conditions, the term "applicant" shall also mean the owner or any successor(s) in interest to the terms of this approval. Planning 1. Sign Program (SP) 19-014 is granted to allow for the establishment of a uniform sign program for the Inn at the Mission located at 26871 & 26891 Ortega Highway (APN: 124-170-12,14,15,16). Approval is granted based on the Planning Commission decision dated June 11, 2019. The project is conditioned herein, and shall not be further altered unless reviewed and approved by the affected city departments. Minor modifications to this approval which are determined by the Development Services Director to be in substantial conformance with the approved plans, and which do not intensify or change the use or require any deviations from adopted standards, may be approved by the Development Services Director upon submittal of an application and the required deposit or fee. If not appealed, this approval shall become effective on the first business day following the fifteenth (15th) day after the date of the Planning Commission's approval. 2. Approval of this application does not relieve the applicant from complying with other applicable Federal, State, County or City regulations or requirements. 3. The applicant shall defend, indemnify, and hold harmless the City of San Juan Capistrano and its officers, employees, and agents from and against any claim, action, or proceeding against the City of San Juan Capistrano, its officers, employees, or agents to attack, set aside, void, or annul any approval or condition of approval of the City of San Juan Capistrano concerning this project, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Planner. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to Planning Commission Resolution 19-06-25-01 SP 19-014 Inn at the Mission Sign Program Final Conditions of Approval June 25, 2019 Page 2 of 2 choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 4. The applicant shall be responsible for informing all subcontractors, consultants, engineers, or other business entities providing services related to the project of their responsibilities to comply with these conditions of approval and all pertinent requirements in the San Juan Capistrano Municipal Code, including the requirement that a business license be obtained by all entities doing business in the City. 5. In the event that exhibits and written conditions are inconsistent, the written conditions shall prevail. If there are any disparities between these conditions and the plans or final revised plans that are approved for any subsequent phase, the conditions and/or plans as stipulated in the later approval shall prevail. 6. The applicant shall pay all fees at the time fees are determined payable and comply with all requirements of the applicable federal, state, and local agencies. The duty of inquiry as to such requirements shall be upon the applicant. 7. Inspection. Prior to Building Permit final, the applicant shall schedule a final inspection with the Development Services Department, Planning Division to inspect the items outlined in this approval.
