Huber, Director of Engineering & Building SUBJECT: Approval of Plans and Specifications and Authorize the City Manager to Award the Construction Contract for Freeway Soundwalls. RECOMMENDATION It is recommended that the City Council, by motion: 1. Approve the plans and specifications for the soundwalls on the I-5 freeway adjacent to San Juan Elementary School and Casitas Capistrano and authorize advertisement for bid; and, 2. Authorize the City Manager to act as approving authority for the purpose of awarding the construction contract. SITUATION A. Summary and Recommendation The City has entered into Agreement with the California Corridor Contractors (CCC) to utilize CCC funds to construct soundwalls on private property rather than on corridor right- of-way. The Agreement states that the City will award a contract by September 15, 1996. B. Background The southbound portion of the San Joaquin Hills Transportation Corridor is expected to be complete in Summer, 1996. As a condition of construction, San Joaquin Hills Transportation Corridor Mitigation Measure 5-1 requires that noise impacts be reduced to an acceptable level,wherever possible for residences located along the proposed Corridor. In response to the required noise mitigation, CCC ordered the preparation of a Noise Impact Assessment Report,which was completed in February, 1994. The report recommended construction of soundwalls along the Corridor through San Juan Capistrano. In the case of two soundwalls (one near the Buchheim property at the Junipero Serra interchange and the other at San Juan Elementary School near the Ortega Highway interchange), a plan for the City to build the walls on private property has been approved. Originally, the two walls were proposed to be located at the edge of the freeway. Through negotiations with the CCC, the walls will be relocated onto private property. The City approved an Agreement for Escrow and Construction of Soundwall on Private Property on April 2, 1996, and approved an Amendment to the Agreement on July 16, 1996. The Agreement requires the City to award a construction contract by September 15, 1996. FOR CITY COUNCIL AGEf' . 35 r , ` AGENDA ITEM August 6, 1996 Page 2 The plans and specifications for the walls are complete and ready to advertise for bids; a copy of which have been forwarded to the Council Office for information. The public is also able to review the plans and specifications in the set on file in the City Clerk's office. However, due to the Agreement to award a construction contract for the soundwalls by September 15, 1996, there may not be adequate time after the bid opening to bring the construction agreement to the City Council for award. Therefore, Staff is proposing that the City Council authorize the City Manager to award the contract and bring the matter to City Council for ratification as soon as possible thereafter. COMMISSIONBOARD REVIEW, RECOMMENDATIONS Not applicable. FINANCIAL CONSIDERATIONS The 1996-1997 approved Capital Improvement Program identified $220,000 for this project: $155,000 from TCA and $65,000 from Systems Development. The City's share is to be reimbursed by TCA from future toll revenue. Do not approve the recommendation and follow the normal award process. 3. Do not approve plans and specifications and terminate the project. 3. Refer to Staff for additional information. . APPROVAL OF PLANS. SPECIFICATIONS. AND AUTHORIZATION TO AWARD CONTRACT - CONSTRUCTION OF FREEWAY SOUNDWALLS (600.30) As set forth in the Report dated August 6, 1996, from the Director of Engineering and Building, the plans and specifications were approved for the construction of soundwalls along Interstate 5 freeway on private property at San Juan Elementary School and Casitas Capistrano. Staff was authorized to call for bids. The City had entered into a contract with the California Corridor Constructors for funding of the soundwall construction on private property, with a condition that the construction contract be awarded by September 15, 1996. Due to that time constraint, the City Manager was authorized to award the contract, subject to ratification by the City Council as soon as possible thereafter. 6. RESOLUTION SETTING THE OPEN SPACE GENERAL OBLIGATION BOND PROPERTY TAX RATE FOR FISCAL YEAR 1996-97 (390.80) As set forth in the Report dated August 6, 1996, from the Director of Administrative Services, the following Resolution was adopted setting the tax rate of$0.0771 per$100 of assessed valuation for Open Space General Obligation Bond Property: City Council Minutes -2- 8/6/96
