Review of Landscaping and Bonds
Dear Mr. Meredith:
At their meeting of May 21, 1980, the City Council
discussed staff reports regarding your request to modify
conditions of approval for Tract 8087 to delete the landscape
requirements for Areas E and G, and to release public improve-
ment bonds for Tracts 8087 and 3319.
Enclosed for your information are copies of pages 4
and 5 of the unofficial Council Minutes of the May 21st meeting
setting forth the Council's actions with regard to your requests.

(85) Tom Rogers, 29192 Country Hills Road, cited problems with sewer
(80) location, landscaping, slope erosion, weeds and trash at the
development, an# requested City review of the situation.
With the concurrence of Council, Mayor Hausdorfer referred
the matter to the Director of Public Works.
6. FIESTA ASSOCIATION SWALLOWS DAY PARADE
(61) C. C. McCary, 31501 La Matanza, spoke in opposition to
(65) continuing the annual Swallows Day Parade and suggested
that a fiesta -type celebration be held instead. Councilman
Friess advised that the Fiesta Association, Chamber of Commerce
and City representatives have scheduled a meeting to evaluate
the activities.
7. IAS CORRALES ESTATES,TRACT 7654 - EQUESTRIAN TRAIL AND
ZKMON PROBLE:9S HAEHN)
(85) Dennis Haehn, 28261 Via Rueda, cited equestrian trail and
(80) slope erosion problems causing mud accumulation.
Tim Rruer, representing Patrick Development, stated that
the slope has been landscaped and maintained by the developer.
(23) Referral to Council Committee and E astrA Commission:
RM-Councilconcurrence, Mayor Haus or er irecte that the
matter be referred to the Equestrian Commission and to the
Council Committee established on April 2nd.
Helen Smith, 28281 via Reeds, also cited slope erosion problems
at her residence.
Referral to Director of Public Works:
With Council concurrence, Mayor Hausdorfer referred the matter
to the Director of Public Works for a meeting with the homeowner
and developer.

NEREDI" CANYON LANDSCAPE REVIEW VEST FOR RELEASE OF BONDS
(TRACTS 8087 AND 8319)
(8S) Written Communications:
Report to May 21, 1980, from the Acting Director
of Community Planning and Development, advising that
the developer, Richard Meredith, has requested modification
of the conditions of approval for Tract 8087 for the
purpose of deleting the landscape requirements for
areas F and G. Discussions between the developer
and the Meredith Canyon Homeowners Association have
not resolved the matter of responsibility for landscape
and maintenance of the two areas. Staff recommends
deletion of landscape requirements for the two areas
and payment by the developer for equivalent landscaping
requirements, subject to certain conditions.
(2); Report dated May 21, 1980, from the Director of Public
Works, regarding the developer's request for release of
Public Improvement Bonds.
John Conley, representing the Meredith Canyon Community
Association, 33421 Via de Aqua, stated that the Association
approves the landscape proposal in concept, but requested
clarification that there are two locations to be relandscaped
by Meredith Company, and noted concern with City acceptance
of landscaping at the seeding stage. Mr. Conley also cited

opposition to release of the bonds and requested that they
be held or re -negotiated, noting mud discharge onto streets
and placement cf-hillside draihage facilities. Copies of a
May 1, 1980, report by D. A. Evans, Inc., submitting
geo4echnical evaluation of slope damage, were presented.
Councilman Thorpe noted that unstable slopes could undermine
streets or cause damage to residences.

suchheim and unanimously carried to approve deletion of
Areas F and G from the Tract Landscape Plans, subject to
the following conditions:
(1) In consideration of the deletion of landscape areas
F and G, the developer shall deposit with the City
$19,563. Said funds shall be deposited in a separate
account for the purpose of providing supplemental
landscaping within Tract 8087. Funds will be dispersed
upon presentation of expenditure receipts from the
Meredith Canyon Homeowners' Association for such
planting.
(2) In consideration of the deletion of landscape areas
F and G,. the Meredith Canyon Homeowners' Association,
upon acceptance by the City of the re -landscaping on
both sides of Via de Aqua of the slope repair area and
the area adjacent to the Murray residence on Via de
huge* shall accept maintenance of said areas including
the 90 -day germination period.
(3) The City shall retain the $10,000 cash bond for the
tract landscaping until the re -landscaping for the
slope repair area and the area adjacent to the Murray
residence on Via de Aqua has been completed. Upon
satisfactory completion of said landscaping and deposit
of the $19,563 with the City, the $10,OOO cash bond shall
be released to tie developer.
Judy Jamroz, President of the Meredith Canyon Association,
stated opposition to release of the improvement bonds.
A motion by Councilman Friona to call the bonds in order
to repair the slopes, faied for lack of a second.

Schwartze and unanimously carried to direct staff to meet
with the Homeowners Association representatives during the
next 45 days to formulate a suit against the Meredith Company
for the repair of the slopes; during that period of time the
bonds shall not be released, however, should there be rapid
and impressive repair action on the part of the developer
during that 45 -day period, the Council will reconsider
the matter.

a policy statement to be included in future hillside develop-
ment approvals regarding the type of bonding to be required
for slopes and slope landscaping.
