SUBJECT: Resolution, Notice of Completion and Release of
Surety, Tracts 8087 and 8319 (Meredith Canyon)
SITUATION
The City Council has received a request from the Craig Development
Corporation, developers of Tract 8087 and 8319 (Meredith Canyon),
for the release of the bonds and landscape deposit held by the
City for on-site and off-site improvements within the subject
Tracts. Attached is a breakdown of current sureties and deposits.
The City Council considered similar requests from the developer
in October, 1979 and May, 1980. On both occasions, the City
Council chose not to release the public improvement bonds, the
grading bonds, or the cash deposits, due to slope failures on the
residential property and on the properties held by the Homeowners
Association.
Based on an Engineering Staff review of previous recommendations
to the City Council, Staff finds that the then City Construction
Inspector found the public improvements, which includes street
section, curb and gutter, sidewalks, sewer and storm drain
facilities acceptable. Staff presented a resolution and Notice
of Completion to the City Council for consideration with a Staff
recommendation of acceptance in October, 1979. Based on the
previous recommendations of the Engineering Division Staff,
reconsideration of the release of bonds and the filing of a Notice
of Completion is presented to the City Council.
FINANCIAL CONSIDERATIONS
There is no cost or compensation to the City associated with
this action. However, the thrust of the letter from Craig
Development Corporation for the release of the bonds, infers
that further action maybe undertaken if the City fails to
release the bonds. Any cost associated with these "further
actions" cannot be determined at this time.

ALTERNATE ACTIONS
1. By resolution, determine that the work resulting from
Tracts 8087 and 8319 has been completed and declare the
work to be accepted; and direct that within ten (10) days
from the date of acceptance, a Notice of Completion be filed
with the Orange County Recorder. By motion, direct Staff to
exonerate the Faithful Performance, Labor and Material
monumentation, and grading bonds upon the expiration of
thirty-five (35) days from the filing of the Notice of
Completion; direct Staff to release the $10,000 cash security
immediately.
2. Do not release the bonds and cash security.
3. Request further information from Staff.

WHEREAS, the City of San Juan Capistrano has entered
into an agreement with Craig Development Corporation for the
construction of public improvements in Tract 8319; and,
WHEREAS, the Director of Public Works has evaluated the
final quantities and cost figures and recommends approval.
NOW, THEREFORE, the City Council of the City of San
Juan Capistrano does resolve as follows:
SECTION 1. That the work required to be performed by
said subdiv-0-er Na—s been completed.
SECTION 2. That the work is hereby accepted and
approved.
SECTION 3. It is further ordered that a "Notice of
CompletionwFe recorded, on behalf of the City, in the office of
the County Recorder of the County of Orange within ten (10) days
of the date of this Resolution.

1. MEREDITH CANYON STATUS REPORT - SLOPE REPAIR
(85) Written Communications:
Jg,Report dated Judy 1'�f980, from the Director of Public Works
advising the Meredith Canyon Homeowners Association is
currently discussing alternate methods for repair of the
slope failures; including an assessment district or a
geological hazard abatement district. The report was
ordered received and filed.
Council Liaison:
There was a concurrence of Council that Councilman Friess
act as the Council liaison with the Meredith Canyon Homeowners
Association.
