SUBJECT: Proposed Agreement for the Transfer of Development
Rights - CDP Area 16 (The Ranch)
SITUATION:
On August 15, 1979, the City Council, in approving the developer's
application for a zone change for a portion of the Honeyman Ranch,
required the developer to enter into an agreement for the dedica-
tion of development rights for CDP Area 16 to the City of San Juan
Capistrano. We have drafted a proposed agreement which requires
that such dedication be made, without additional consideration,
prior to the issuance of the first residential building permit.
FINANCIAL CONSIDERATIONS:
None, except the minimal time required to review the document of
dedication.
ALTERNATE ACTIONS:
1. Approve the agreement and authorize the Mayor to execute.
2. Request modifications to the agreement.
RECOMMENDATION:
By motion, approve the agreement as presented and authorize the
Mayor to execute.

SUBJECT: Contract Wording
Attached is a copy of .the contract between the City and The
Ranch requiring the dedication of certain lands in the CDP..
It has been recommended that certain wording in the contract
`be changed to remove any misleading references to the--term-
"transfer of development rights."
Upon the City Attorney's approval, the following wording could
be substituted:
"Whereas, approval of said Development Plan was
conditioned upon Owner entering into an Agreement
Whereby Owner would dedicate to the City an open
space easement for, on and to CDP Area 16 (General
Agriculture District)....." etc.
This change would have to be made in the two places marked in
the contract, and also the word "transfer" should be deleted
in Section #1.

Re: Dedication of Development Rights - Agreement
Gentlemen:
Enclosed is a fully -executed copy of the Agreement for
transfer and dedication of development rights to the City, approved
by the City on November. 7, 1979. The proposed charges have been
approved, initialed and dated by Mayor Friess. The Agreement has
been forwarded to the Orange County Recorder's Office for recordation.

RE: Agreement with The Ranch - Dedication of
Development Rights
Attached are the original and one copy of the above agreement
which you signed on November 7th. The agreement has subsequently
been signed by a representative of the Ranch; however, certain
changes have been made to the agreement since your signature,
and those changes will need you initials and the date. I have
placed an "x" at the 4 places. Two of the changes are in connection
with a change in the company name from The Ranch to Crow San Juan
Ranch; two of the changes are corrections in parcel numbers from
"l through 15" to "l through 13, A and B." I am advised that the
City Attorney has approved the changes.

Gentlemen:
At their meeting of November 7, 1979, the City Council
approved the agreement providing for the dedication of develop-
ment rights to the City for CDP Area 16, pursuant to the
August 15, 1979, approval of a zone change application for The
Ranch. The agreement was amended to add the waiver of agricultural
fees.
Enclosed are two copies of the agreement. Please sign
both copies and return the "City Copy" to this office; the remaining
copy is for your files. Please note that all signatures must be
notarized.

Dear Mr. Mayor:
We have several items regarding the Ranch that we would like
the Council to review and give us some direction.
A. Four housing units at hilltop east of Foresman house.
B. Rezoning of Malaspina triangle from R. A. to a use that
would fit a family type restaurant designed as a large resi-
dence.
C. Completion of the supplemental EIR is contingent upon hav-
ing final grading information and providing two renderings
of the road.
D. The Hunt Club has already dedicated a 20' equestriantrail
adjacent to our property line. Can the trail on our property
be deleted.
Your assistance in the above matters is appreciated.
