It is mutually agreed between the Department of Transportation and the Contractor, City of San Juan Capistrano, that Standard Agreement No. 64520, dated January 21 1981 is hereby amended to read as follows: Le The first paragraph of Item Number 4 on page 2 of the Agreement is amended to read: "STATE shall contribute funds toward the acquisition through purchase, grant, dedication, or leasehold of the project site ($200,000), and final design, plans, and actual construction costs of the project ($156,000) in a total amount not to exceed the STATE's maximum obligation hereunder of $356,000. All costs relevant to the under - grounding of utilities and environmental clearances, shall be borne solely by SPONSOR without STATE contribution." A new paragraph Number 19 is added to read: "Should STATE desire to assume an ownership or operator status at any time in the future to include this PROJECT or facility, then the contribution made by STATE hereunder as well as other STATE funds allocated by the annual State Budget Act or the California Transportation Commission and federal funds designated for Public Transportation Capital' Improvements and incorporated into the PROJECT, shall be considered as a credit toward the acquisition or purchase costs to STATE based upon a percent of these contributions to the total purchase or development price from the date of Inception of the PROJECT. Thus, if the total transportation contributioniof federal and STATE funds amounts to one- fifth of the value of this facility, then at the time of purchase or acquisition by the STATE, STATE shall only be obligated to sponsor for four-fifths of the then value of that facility, etc. 3. All other terms of the Agreement shall remain as originally written.
