Elwell, Interim Public Works Director 8/15/2006 D3 SUBJECT: Consideration of Notice of Completion for the Krum Reservoir Pipeline Stabilization (Calex Engineering Company)(Krum Reservoir Site)(FEMA- 1585-DR) RECOMMENDATION: By motion, 1. Adopt a Resolution declaring the work complete for the Krum Reservoir Pipeline Stabilization; and, 2. Direct the City Clerk to record the Notice of Completion; and, 3. Authorize staff to release the retention 35 days after recordation. SITUATION: In early June 2005, an ancient landslide, known as the Avenida Placida Landslide was re -activated. The landslide is located west of the San Juan Hills Estates residential development, just above Avenida Placida. According to the City's Geotechnical Engineer, Lawson and Associates Geotechnical Consulting (LGC), the re -activation of the landslide was due to the heavy rains experienced by Southern California during the declared Federal Emergency Management Agency (FEMA) DR -1585 event. This event occurred during the period of February 16 to 23, 2005. Movement from the landslide impacted the stability of existing domestic water facilities at the Krum Reservoir site. Staff proceeded under an emergency basis to prepare engineering plans, solicit bids, and award a construction contract for the stabilization of the domestic water facilities. On October 14, 2005, the City Manager, under delegated authority from the City Council, executed a construction contract with Calex Engineering Company (Calex) for a total of $1,884,000. RBF Consulting, Inc., the project engineer, has declared the contract work to be complete (Attachment 1). Staff has prepared the requisite Notice of Completion (Attachment 2) and Resolution (Attachment 3) and recommends final acceptance of the contract. The Avenida Placida Landslide also impacted an existing detention basin within the San Juan Hills development. Debris from the landslide filled the detention basin and Agenda Report • Paae 2 • August 15, 2006 nearly spilled onto the public right-of-way. Removal of the debris and re -grading of the impacted area was completed in January 2006. The work associated with the Avenida Placida Landslide has been previously reviewed in accordance with the California Environmental Quality Act (CEQA) of 1970. Staff previously determined that the project constituted an "emergency project" under the provisions of Section 15269 of the CEQA Guidelines, and issued a Notice of Exemption. Required permits from the U.S. Fish and Wildlife, California Department of Fish and Game, Army Corps of Engineers, and Regional Water Quality Control Board were obtained prior to the start of any construction work. As part of the permit provisions, the City is required to restore up to 7 acres of native habitat. Staff is working with the resource agencies mentioned above to finalize the restoration plans. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: Not applicable. FINANCIAL CONSIDERATIONS: The original construction contract cost with Calex was $1,884,000. One change order for $5,733.12 was issued by the City. This change order included the relocation of an existing overflow drain, repair of the inlettoutlet line to the Krum Reservoir, and the removal of excavated concrete debris. Including this change order, Calex's final construction contract cost is $1,889,733.12. The total final cost for the stabilization of the domestic water facilities, including construction, construction management, engineering design, and inspection is approximately $2.7 million. In March 2006, the City Council appropriated a total of $5.4 million from the General Fund Reserve for expenditures associated with the Avenida Placida Landslide. Of this amount, a total of $4.7 million was budgeted for the stabilization work and the removal of the landslide debris. The remaining balance was budgeted for environmental mitigation. The total cost of the stabilization work and landslide debris removal is approximately $4.4 million. This is within the aforementioned budgeted amount. An updated cost for the environmental mitigation is pending finalization of the restoration plans. Staff is seeking FEMA reimbursement for expenditures associated with the Avenida Placida Landslide on the basis that the landslide is considered an emergency and a threat to public property and infrastructure. To date, FEMA has committed to reimburse a total $4.3 million. Staff is working closely with FEMA as well as the State Office of Emergency Services (OES) to secure additional funding for the remaining balance. Staff is currently processing the required FEMA documentation to obtain the committed funds.
