JUAN CREEK RAILROAD BRIDGE AND TRACK REALIGNMENT (BOYLE
ENGINEERING)
Written Communication:
Report dated December 15, 1992, from the Director of Engineering and Building, recommending that
the Consulting Services Agreement with Boyle Engineering be approved, for an amount not to exceed
$27,000,for right-of-way acquisition services[Items 1-14 in Exhibit A,Scope of Services and Procedures]
for the San Juan Creek Railroad Bridge and Track Realignment Project, including the following
additional costs: $14,000 for title insurance, $700 (5%) for handling costs, and $800 for policy review.
Total consultant cost: $42,500.
Approval of Consulting Services Avreement:
It was moved by Council Member Hausdorfer, seconded by Council Member Nash, and unanimously
carried that the Consulting Services Agreement with Boyle Engineering be approved for right-of-way
acquisition services for Capital Improvement Project No. 126--San Juan Creek Railroad Bridge and
Track Realignment--for an amount not to exceed$27,000 for acquisition services, plus$15,500 for title
insurance work to be paid at actual costs, for a total fee of$42,500, for the period ending June 30, 1994.
The Mayor was authorized to execute the Agreement on behalf of the City.

1. CONSIDERATION OF NAME CHANCE FOR HERITAGE FESTIVAL (15060)
Written Communications:
(1) Report dated December 15, 1992, from the Director of Community Services, summarizing
discussions between community organizations,the City's Parks and Recreation Commission,and
City staff regarding suggestions to change the name of the Heritage Festival to another name,
such as Festival of the Swallows,Swallows' Festival, and Fiesta of the Swallows. The Council
was requested to decide whether to approve a name change or retain the name of the Heritage
Festival.
(2) Letter dated September 14, 1992, from Brian McInerney of the Mission San Juan Capistrano,
in support of the names"Festival of the Swallows,""Swallows Festival,"or a name with the word
"fiesta" in it.
Don Stott,33781 Shamrock Lane,felt that the name should include the word"fiesta"and preferred the
name 'Fiesta de las Golondrinas."
Mr. King made an oral presentation.
Council Member Vasquez cited his preference for the name"Fiesta de las Golondrinas"but stated that
the Fiesta Association might hold the trademark on that name. Council Member Hausdorfer explained
that the reason for the name change to "Heritage Festival"in 1986 was to name the City's month-long
celebration and not just the return of the swallows, but agreed that the name should retain its Spanish
heritage and be named"Fiesta de las Golondrinas'
Anita Adkisson,president of the Fiesta Association,stated the Association held a trademark on the logo
only and not the name"Festa de las Golondrinas." She concurred with the Council's recommendation
but expressed concern that the name would not be as recognizable as a name with the word"swallows"
in it. She also felt that tourists might confuse the name with other businesses and organizations in town,
