Huber, Director of Engineering & Building SUBJECT: Approval of Consulting Services Agreement for Right-of-Way Acquisition Services for CIP Project #126, San Juan Creek Railroad Bridge and Track Realignment (Boyle Engineering) RECOMMENDATION By motion, approve the Consulting Services Agreement for right-of-way acquisition services for CIP project #126, San Juan Creek Railroad Bridge and Track Realignment with Boyle Engineering. Authorize the Mayor to execute the Agreement on behalf of the City. SITUATION A. Summary and Recommendation It will shortly be appropriate for the City to begin right-of-way negotiations for the San Juan Creek Railroad Bridge and Track Realignment Project. Project design is now at a stage where right-of-way needs can be established and environmental review is well underway. This project, because of the range of interested parties involved, has been in progress now for many years. In order that right-of-way negotiations can be started upon completion of environmental review, staff is recommending approval of the Consulting Services Agreement with Boyle Engineering not to exceed $27,000 for right-of-way acquisition services Items 1-14 in the Scope plus an estimated cost of $15,500 consisting of $14,000 for title insurance policies plus 5% ($700) for handling costs plus $800 for policy review, for a total of $42,500. B. Background Since 1985, the Community Redevelopment Agency and the City have been working with the National Railroad Passenger Corporation (Amtrak), the State of California (Caltrans), the Orange County Flood Control District (OCFCD), the Atchison, Topeka & Santa Fe Railway Co. (Santa Fe) and, more recently, the Southern California Regional Rail Authority (SCRRA) who are purchasing the Santa Fe right- of-way. The project of combined interest is to construct a new railroad bridge over San Juan Creek and realign a portion of track in the vicinity of San Juan Creek and Camino Capistrano. This project is of benefit to the community as it will allow for the future widening of Camino Capistrano to ultimate width, improve the development potential of land which is presently under-utilized and relatively inaccessible and will decrease the running time of passenger trains along the Los Angeles-San Diego Coridor thus assisting in the addition of passenger trains to service this area. FOR CITY COUNCIL AGEND Z11 AGENDA ITEM • • December 15, 1992 Page 2 Boyle Engineering are the design engineers for this project and have an existing contract not to exceed $1,137,983 with the City's Community Redevelopment Agency which is funded by Caltrans. This contract is being considered for amendment by separate Community Redevelopment Agency action. This existing contract provides for the preparation of right-of-way documents but not for any negotiations. Boyle Engineering also produced the preliminary project report which dealt with right-of-way as well as project feasibility. Staff believes that Boyle Engineering has done excellent work on the preliminary report and the project design and are in a unique position to economically provide right-of-way acquisition services. FINANCIAL CONSIDERATIONS Funding for this work is budgeted in Account No. 12-63500-4703-126 in the amount of $704,000. Funding for this right-of-way negotiations contract is being reimbursed 50% by Caltrans up to $40,000 with 50% matching funds being reimbursed by OCTA. Staff time is also reimbursable under both contracts. NOTIFICATION Boyle Engineering Caltrans, Division of Rail OCTA ALTERNATE ACTIONS 1. Approve the Consulting Services Agreement for right-of-way acquisition services with Boyle Engineering. 2. Do not approve the Consulting Services Agreement. 3. Request additional information from staff. RECOMMENDATION By motion, approve the Consulting Services Agreement for right-of-way acquisition services for CIP project I1126, San Juan Creek Railroad Bridge and Track Realignment with Boyle Engineering.
