08-0520_BOUDREAU PIPELINE CONSTRUCTION_D4_Agenda Report 5/20/2008 AGENDA REPORT D4 TO: Dave Adams, City Manager FROM: Nasser Abbaszadeh, Engineering & Building Director SUBJECT: Consideration of Waiving Formal Bidding Process, Award of Emergency Procurement and Contract for Replacement of Portions of the Trunk Sewer Pipe, (Boudreau Pipeline), (CIP No.728/ CIP No.716). RECOMMENDATION By motion, 1. Adopt a resolution authorizing the City Manager to Waive the formal bidding process related to replacement of the Trunk Sewer Pipeline portions; and, 2. Authorize the City Manager to enter into an agreement with Boudreau Pipeline for procurement and replacement of designated sections of the Trunk Sewer Pipeline, in the amount of$432,735; SITUATION A. Summary and Recommendation Municipal Underground Services, Inc. (MUS) has provided staff with T.V. inspection videos of the trunk sewer lines. Upon inspection of the videos and consultation with MUS, it was determined that the portion of the trunk sewer line along the easterly property line of City Hall adjacent to the existing railroad tracks are failing and need to be replaced as soon as possible. Informal proposals from four reputable contractors to perform the emergency work were received on May 2, 2008 and are summarized as follows: Contractors Bids Received Boudreau Pipeline $ 432,735.00 Bova Pipeline $ 588,450.00 Doty Brothers Equipment Co. $ 644,630.00 DLSB, Inc. $ 822,850.00 It is recommended that the City Council adopt the attached Resolution waiving the formal bidding process and authorize the City Manager to award a contract to Boudreau Pipeline for emergency procurement to replace failing portions of existing trunk sewer located along the easterly property line of City Hall adjacent to the railroad Agenda Report May 20, 2008 Page 2 tracks with limits from approximately south of Spaulding's property to south of the City's yard (Attachment 2). B. Background The City's sewer system within the portions identified for emergency replacement was originally constructed in 1964 and conveys a majority of the City's sewage to the South Orange County Wastewater Authority(SOCWA)facility in the City of Dana Point. The Sanitary Sewer System Master Plan and Rehabilitation Program dated January 2004 prepared by Tetra Tech, Inc. identifies the sewer as operating over capacity and recommends the said portion of trunk sewer be upsized from an 18 inch diameter to a 21 inch diameter sewer as part of the Hydraulic Capacity Project(HCP) No. 1,which is currently in design. Recent sewer inspection videos and data provided to staff by MUS have indicated that non-grouted flanges at pipe joint locations have caused the lining to be exposed to sewer gases which has resulted in shredding of the pipe's inner coating, and the deterioration of concrete at the exposed joints, evident from concrete bubbling and foam-like expansion. Gaskets are visibly broken and hanging from joint locations, and are causing significant blockages within the pipe itself. Cleaning operations to assess actual pipe condition and for possible pipe relining is not recommended based on the current condition of the pipe. In consideration of the current condition of sewer pipe within the portions identified, the amount of conveyed sewage flows, and possible liabilities associated with a sewage spill in close proximity to the San Juan Creek / Trabuco Creek, staff recommends that the said portion of sewer line be replaced immediately as opposed to constructing the replacement as part of HCP No. 1. COMMISSIONS/BOARD REVIEW, RECOMMENDATIONS Commission review is not required for emergency replacement projects. FINANCIAL CONSIDERATIONS Construction of the emergency sewer replacement project shall be funded from accounts CIP No. 716 and CIP No. 728, with equal apportionments as follows: 1. Funding in the amount of $216,368 is provided from Account No. 12-65300-4717-716 where a total of $3,497,487 is allocated for the design of HCP No. 1 and 6, and the construction of HCP No. 6. 2. Funding in the amount of $216,368 is provided from Account No. 12-65300-4717-728 where a total of$232,193 is allocated for major sewer repairs. Location Map RESOLUTION NO. 08-05-20-xx A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO WAIVE THE FORMAL BIDDING PROCESS AS AN EMERGENCY CONDITION, DECLARING THE NECESSITY THEREOF, AND AUTHORIZING STAFF TO PROCEED WITH EMERGENCY REPLACEMENT OF TRUNK SEWER PIPE LOCATED ALONG THE CITY'S EASTERLY PROPERY LINE. WHEREAS, Sections 20168 and 22050 of the Public Contracts Code provide that upon adoption by the City Council by a four-fifths vote of a resolution declaring that the public interest and necessity demand the immediate expenditure of public funds to safeguard life, health, or property in order to proceed with emergency work without notice for bids to let a contract for such emergency work; and, WHEREAS, the staff report accompanying this Resolution sets forth the facts supporting a finding that an emergency exists relating to the condition of the City's sewer system requiring the replacement of existing trunk sewer line located adjacent to the City's easterly property line and that the public interest and necessity demand the immediate expenditure of funds to construct the necessary sewer to prevent sewer overflows and safeguard life, health or property; and WHEREAS, Section 22050 also provides that the resolution may delegate to the City Manager, the authority to order any action required by the emergency and to procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let the contracts. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS: 1. That the public interest and necessity demand the immediate expenditure of public funds to safeguard life, health, or property in order to proceed with emergency work for the replacement of existing trunk sewer line located adjacent to the City's easterly property line. 2. That the emergency will not permit a delay that would result from a competitive solicitation for bids and that action is necessary to respond to the emergency related to the conditions of the sewer system requiring the replacement of the existing sewer pipe. 215479-1 ATTACHMENT 3. That the City Manager is hereby authorized to order any action required to remedy the emergency relating to the condition of the sewer system and replacement of the sewer pipe and to procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts.
