SUBJECT: Consideration of Personal Services Agreement— Butier Engineering,
Inc., SC-04 Pipeline Extension (CIP# 794) (Consultant)
RECOMMENDATION
By motion: 1) Approve entering into a Personal Services Agreement with Butier
Engineering, Inc. for Construction Management Services for the SC-04 South
Connectors Pipeline I & II Project Construction Management Services, in the
amount of $490,745.96. Authorize the Mayor to execute the Agreement after all
insurance, and documentation has been submitted.
SITUATION
On February 15, 2000, the Board approved entering into a Personal Services
agreement with Malcolm Pirnie, for civil engineering design services for the SC-04
Terminal Pipeline Project. The Environmental Administrator reviewed the project
pursuant to Section 15061 of the California Environmental Quality Act (CEQA)
and issued a Mitigated Negative Declaration, on July 26, 2000. No objections
were noted to the selected route. On September 5, 2000, the Board selected the
La Pata alignment for this project; and, directed staff to develop the final
construction plans for this project. Malcolm Pirnie has completed the design work,
and has obtained all necessary permits, and environmental clearances. The
estimated total costs, detailed in Malcolm Pirnie's Alignment Study, dated July 12,
2000, is $5,178,000. The water system improvements known as the SC-04 South
Connectors I and II (the SC-04 Terminal Pipeline Project) are identified in the
Capistrano Valley Water District Domestic Water Master Plan dated May 1999,
and the revised Domestic Water Master Plan, dated April, 2001. This project will
enhance overall water service reliability and increase capacity on the southeast
side of the District. The project includes approximately 22,000 lineal feet of 24-
inch diameter pipeline, 5,400 lineal feet of 12 inch diameter pipeline, 3 pressure
regulating stations, and modifications to existing system interconnections. At its
meeting of October 2, 2001, the Board approved authorization to advertise for the
construction the SC-04 Terminal Pipeline Project.
Professional Construction Management (CM) Services are needed for the Project.

The Construction Manager will act in a supporting role to the City and integrate
CM procedures in a timely manner to meet the project completion date and
budgets. Specific services to be rendered are included in tasks as set forth in
Exhibit "A - Request for Proposal (RFP) and as specified in the AGREEMENT and
incorporated herein by reference.
PROJECT DESCRIPTION
The SC-04 Terminal Pipeline Project starts at the intersection of Ortega Hwy and
Antonio Parkway, and crosses Ortega Hwy, continues south, adjacent to and in
the right-of-way (RNV) of La Pata up to the Prima Desecha Landfill boundary.
This alignment then heads west along the northerly boundary of the landfill. The
alignment then continues south along the westerly edge of the Landfill and
meanders southwesterly to the proposed location of the SC-04 Terminal
Reservoir.
PROPOSALS RECIEVED
Staff solicited four (4) engineering consultants to submit proposals to provide
construction management services. Four (4) proposals were received. The
proposals were reviewed and ranked as follows:

Tetra Tech, Inc. $ 697,943.00
Staff reviewed the proposals for completeness and affirmative inclusion of all work
items. Staff is confident that the Butier Engineering, Inc. Proposal addresses the
required scope of work and that the firm can complete the project within the
proposed budget. The Agreement for Personal Services with Butler Engineering,
Inc. is attached for your consideration.
COMMISSION RECOMMENDATIONS
The Water Advisory Commission received and reviewed this item at their meeting
on March 6, 2002.

FINANCIAL CONSIDERATIONS
There is $5,400,000 in the 2001-2002 Budget, CIP #794 for the SC-04 Terminal
Pipeline Project to cover the costs of construction, construction management,
permits, engineering, and contingencies.
ALTERNATE ACTION
1. Approve entering into a Personal Services Agreement with Butier Engineering,
Inc. for Construction Management Services for the SC-04 South Connectors
Pipeline I & II Project Construction Management Services, in the amount of
$490,745.96. Authorize the Mayor to execute the Agreement after all
insurance, and documentation has been submitted.
2. Request additional information from staff.
