Brust, City MqKa y r FROM: Nasser Abbaszadeh, Public Works Director SUBJECT: Consideration of Approving Qualified Master Consultant Personal Services Agreements for Engineering, Building, Architectural, and Plan Check Services RECOMMENDATION: By motion, 1. Approve the Qualified Master Consultant List; and, 2. Approve 34 Personal Services Agreements to perform Engineering, Building, Architectural, and Pian Check Services for a three (3) year term with two (2) one-year optional extensions, not to exceed $50,000 per project proposal, per year. SITUATION- Summary and Recommendation: The concept of the Qualified Master Consultant List was originally introduced in 1992. It was created as a means to improve service delivery for resident and developer plan check services, as well as for City capital improvement projects, temporary staffing, and to support City operational functions. The concept has been proven successful as it provides for improved efficiency for staff operations. Our current agreements expire in December 2011. Staff has solicited proposals and is requesting that 34 firms be recommended for new three-year agreements with the option of two (2), one-year extensions at the City's discretion and demonstration of superior performance. Background: In 1992, the City Council approved the concept of creating a qualified list of consultants to support staff on an as-needed basis for specific services. The concept creates a long- term agreement with each consultant, allowing staff to expeditiously process various engineering and plan check services. In addition, for plan checking services, the agreements require that they perform their services at a specified percentage of the City's fees. All consultants agree to a fee not to exceed 60% or 75%, depending upon Agenda Report Page 2 November 1, 2011 the type of plan check. Having experienced a positive outcome with this concept, the Qualified Master Consultant list was reviewed, updated and again brought to City Council for approvals in 1997, 2002, and 2006. A Statement of Qualifications (SOQ) was sent out to 95 firms. Many of these firms were pre-approved based on prior experience with the City. Of the 95 firms, 34 responded with proposals. The proposals were sent out to various types of companies, including general engineering and building firms, as well as a number of specialty firms. The specialty firms include areas of expertise in geotechnical, traffic, building, structural, and survey services. The proposals were reviewed by staff and selected based upon the following criteria: • Consistency with scope of work • Ability to meet schedules • Past performance of similar work • Project manager experience • Ability to meet fee requirements • Qualifications of firm in handling required work As projects or concepts are defined, staff will solicit proposals for work from the firms on the Qualified Master Consultant List (Attachment 2). This process improves efficiency by having approved agreements with pre-qualified companies and required insurance in place. If the projects and the proposals fall within the Master Agreement scope of work, the work will be authorized by the City Manager. If,the fee exceeds the $50,000 limit established under the Master Agreement scope of work, or the work is not congruent with the Master Agreement, a separate agreement will be presented to the City Council for consideration. However, no new Personal Services Agreements will be required, nor will insurance certification requirements cause delays, as they will already be in place. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: None. FINANCIAL CONSIDERATIONS: The Qualified Master Consultant List is available for projects and programs with approved funding in the Fiscal Year 2011-2012 adopted budget. In the event that no pre-approved funding is available, the item will be brought to the City Council for consideration. NOTIFICATIONS: All the companies have been notified via e-mail. The services are generally described herein and intended to supplement staffs efforts where specific expertise is required or time constraints necessitate consultant assistance. From the Statement of Qualifications (SOQ), consultants will be selected who best represent expertise across the various specialty areas. The list will become part of a five-year program. Work will be parceled'out on an as-needed basis, and no specific guarantee can be given as to the annual fees andlor for consultant usage. The services will also include any other temporary in- house or field consulting work which may be required by the Department. The consultant list will only be modified in the event consultants are dropped from the list due to corporate changes or it is deemed by the City that additional consultants are warranted. The projects contemplated include, but will not be limited to, performance of engineering and design- (along with the preparation of evaluation reports), plans, sketches and specifications for small scale new facilities or the maintenance, repair, and replacement of existing facilities. Facilities contemplated include, but are not limited to, wells, pumping stations, hydro-pneumatic pump stations, pipelines, pressure reducing stations, reservoirs, sewer lines, structures, and appurtenances, sewer lines, structures, and lift stations as well as other engineering and building services as further defined in this document. Also included are other related engineering services such as preliminary design reports, traffic analysis, water treatment analysis, surveying, ATTACHMENT '1 Request for SOQ 2011 Page 2 of 7 geotechnical evaluation, ground water modeling, completion of CEQA checklist, materials testing, grant writing, grant compliance, and demolition and disposal plans. The purpose of this RFQ is to develop a qualified list of consultants capable of performing the work and having a ready contract and required insurances in place to streamline the• process of contracting for engineering and design work on small projects. The CONSULTANT(S) selected will be expected to execute the personal services agreement and comply with the terms of E-Verification and Insurance; but not to perform any work unless authorized. I EVALUATION OF SOQ'S The City of San Juan Capistrano is interested in selecting consultants who have the experience and expertise to render engineering and architectural design services (including plan checking) in a comprehensive and timely manner. Accordingly, the evaluation criteria will consist primarily of three parts: 1. Consultants' expertise 2. Consultants' experience ' 3. Consultants' ability to handle volume and meet time demands It is important to the City that you identify the persons you will assign to various functions, from which office they are assigned, and whether they are full-time E employees of your firm. You should also. address any conflict of interest that may exist and comment on solutions. The consultant shall bill on an hourly basis, not to exceed 75% of the total fee, and fees may be negotiated lower if; in the determination of the City, a lower.fee is warranted. b. Building Fees a. Plan Check Total plan check at 80% of base plan check fee paid by applicant not including any surcharges (base plan check fee). Maintenance of Records l The consultant will maintain all books, documents, papers, employee time sheets, accounting records/ledgers and other evidence pertaining to costs incurred and shall make such materials available at their respective offices at all reasonable times during the contract period and for three years from the date of final payment for inspection by } the City. The consultant shall furnish copies, if requested. CITY'S RESPONSIBILITY The City shall perform the tasks as forth herein: A. Establishment of Valuation (Plan.Check Services Only) i Assign a valuation to the proposed work in accordance with the appropriate Engineering or Building Division standards. The City shall collect all fees from the applicant in connection with the services. B. Prolect submittals l l City will supply all necessary documentation/specifications, reports, studies, calculations; etc., to Consultant as is readily available'at the City. i C. Coordination fi } City will serve as project coordinator. On plan checking, the City will be i responsible for notifying the applicant when plans with corrections are available to pick up. The City will route plans (preliminary/revised) to and from the Consultant. SELECTION PROCESS tThe CITY may select for contract negotiations the firm(s) that, in the CITY's judgment, will best meet the CITY's needs, irrespective of the comparison of fee schedules presented by the proposers. The CITY's CONSULTANT evaluation and selection process is based on the following criteria. a. Familiarity with the type and manner of work described. b. Qualifications and experience of the Project Manager, Project Engineer, other I key individuals, and sub consultants, The CITY reserves the right to request a change of Project Manager, or any member of the team, should it deem it necessary. The CONSULTANT shall honor this request. c. Results of reference checks. d. Clarity of the SOQ. e. Compliance with SOQ requirements. f jS f jjj jfEE 1 { s e Request for SOQ 2011 Page 7 of 7 When a specific project is defined and solicited, the CITY will negotiate a contract with the best-qualified firm for the desired consulting services at compensation which the staff determines is fair and reasonable to the CITY. Should CITY be unable to negotiate a satisfactory contract with the selected firm, negotiations with that firm will be formally suspended. To the"full lest��ctent permitted by law, Consultant agrees to protect, defend, and hold harmless theCity tl its elective and appointive boards, officers, agents, and employees from any and all claims, liabilities, expenses, or damages of any nature, including attorneys` fees, for injury or death of any person, or damages of any nature, including interference with use of property, arising out of, or in any way connected with the negligence, recklessness and/or intentional wrongful conduct of Consultant, Consultant's agents, 4 officers, employees, subcontractors, or independent contractors hired by Consultant in the performance of the Agreement. The only exception to Consultant's responsibility to protect, defend, and hold harmless the City, is due to the negligence, recklessness and/or wrongful conduct of the City, or any of its elective or appointive boards, officers, agents, or employees. This hold harmless agreement shall apply to all liability regardless of wether any insurance policies are applicable.
