06-0905_APA ENGINEERING, INC._Personal Services Agreement PERSONAL SERVICES AGREEMENT THIS AGREEMENT is made and entered into this6day of 2006, by and between the City of San Juan Capistrano (hereinaft r referred to as the "City") and APA Engineering Inc., (hereinafter referred to as "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to prepare Plans and Specifications for Junipero Serra Road and Rancho Viejo Road Intersection Improvements; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in Exhibit "A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and services required hereunder shall be completed by no later than December 31, 2007. Section 3. Compensation. 3.1 Amount. Total compensation for the scope of services for this Project shall not exceed One hundred and thirty two thousand, four hundred and eighty dollars $132,480), as set forth in Exhibit "B," attached and incorporated herein by reference. 5® 3.2 Rate Schedule. The services shall be billed to the City at the hourly rate set forth in Exhibit "C," attached and incorporated herein by reference. Included within the compensation are all the Consultant's ordinary office and overhead expenses incurred by it, its agents and employees, including meetings with the City representatives and incidental costs to perform the stipulated services. Submittals shall be in accordance with Consultant's proposal. 3.3 Method of Payment. Consultant shall submit monthly invoices based on total services which have been satisfactorily completed and specifying a percentage of projected completion for approval by the City. The City will pay monthly progress payments based on approved invoices in accordance with this Section. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. 3.4 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to City. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. 0 0 Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that; (1) it has investigated the work to be performed; (2) it has investigated the proposed construction site, including the location of all utilities, and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. 411 • Section 12, Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non-owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self-retention amount, and an additional insured endorsement to the Consultant's general liability and umbrella liability policies to the City Clerk's office for certification that the insurance requirements of this Agreement have been satisfied. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement, Consultant shall submit an insurance certificate to the Clerk of the Board's office for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cancel lation/Term1nation of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 0 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City and Consultant shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to the other party In addition, this Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. Section 17. Attorneys Fees. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). Section 19. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. Sh , City Attorney PROJECT UNDERSTANDING PROJECT BACKGROUND The City of San Juan Capistrano is seeking proposals from qualified engineering firms to provide consulting engineering services for preparation of the engineering plans and specifications (PS&E)for the Junipero Serra Road and Rancho Viejo Road Intersection Improvements in the City of San Juan Capistrano (CIP No. 404). The intersection of Rancho Viejo Road and Junipero Serra Road currently experiences substantial traffic back-ups and delays, particularly during peak periods. A Traffic Study and concept plans for mitigation ofthis situation have been prepared and approved for the Junipero Serra Road/Rancho Viejo Intersection Improvements. The approval process included Caltrans, the City's Transportation Commission, Planning Commission and City Council. The City wishes to proceed now with the preparation of plans and specifications for construction of these improvements. The intersection of Rancho Viejo Road and Junipero Serra Road is a four-way type with split phasing on Junipero Serra Road and protective left turn arrows on Rancho Viejo Road. The fourth leg of the intersection is a private office building driveway. The operation of the traffic flow is heavily influenced by the existence of the northbound 1-5 Freeway on/off ramp situated so close that only 125 feet of vehicle storage exists on the Junipero Serra leg between the Rancho Viejo Road and the freeway ramp signals. To reduce excessive traffic queues and improve the overall operation, several roadway improvements are needed as follows: 1. Widen Junipero Serra Road to provide six lanes to replace the existing four in the short segment between Rancho Viejo Road and northbound 1-5 Freeway ramps. This will enable two westbound lanes on Junipero Serra to enter the northbound 1-5 on-ramp simultaneously. This in effect, provides essentially a"free" right turn lane onto the freeway thereby eliminating the vehicle queues in the No. 2 curb lane. 2. Widen the west side of Rancho Viejo Road north of Junipero Serra Road to provide separate right turn lane as well as enabling right turn to occur from No. 2 through lane of southbound Rancho Viejo Road. 3. Widen the west side of Rancho Viejo Road south of Junipero Serra to provide dual northbound left turn lanes replacing the short single lane that currently exists. This will more than triple the storage available as well as increase capacity by allowing the turning of two left turns at the same time. In addition, it is our understanding that Caltrans has requested that the southerly Park and Ride access from Junipero Serra Road should be retained but with a right turn entry only. Vehicles exiting the Park and Ride lot must use the Rancho Viejo Road driveway. The width of this driveway should be reduced if possible relative to the existing condition when modified for a right turn entry only driveway.This should reduce the area of concrete and create the potential for additional landscaping as requested by the Planning Commission. Elimination of this access was proposed by Planning Commission to achieve more landscaping. This should be discussed with Caltrans. In addition, any modifications to the Caltrans Park and Ride facility (North and South) will retain the same total number of parking spaces. Sidewalks to be reconstructed on Junipero Serra Road between the northbound ramps and Rancho Viejo Road should have a landscaped parkway between the sidewalk and curb, and landscaping between the sidewalk and parking. Existing sidewalks are at back of curb. The existing sidewalk on the west side of Rancho Viejo Road between the corner and driveway should not be reconstructed as there is no potential for its continuation to the north and facilities exist on the east side of Rancho Viejo Road. Professional Civil Engineering Services 1 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano PROJECT UNDERSTANDING The City recently reconstructed Junipero Serra Road from the northbound ramps to Rancho Viejo Road. The geotechnical and pavement structural section report from that project will be used in this project. PROJECT APPROACH 1. Review existing and available maps and field verify them to ensure that all features are shown and the topographic map reflects the current condition. Perform additional detailed field survey, if necessary, to add new information to the map. 2. Review the new base map with City staff to ensure completeness and inclusion of all necessary data. 3. Review conceptual design for improvements that were developed by Austin Foust Associates and see how additional concerns by Caltrans and the City during the concept phase can be incorporated into the proposed improvements. 4. Contact all utilities and obtain as-built utility maps and superimpose them on the base map. Schedule potholing (optional) as necessary to ensure adequate and precise utility data. 5. Review the previously prepared Geotechnical Report and see if additional information/invistigation is needed for this project. 6. Obtain Caltrans right-of-way map and assessor's map to identify existing right-of-way clearly. 7. Identify and locate jurisdictional boundaries for Caltrans/City and private properties within the project limits. 8. Meet with Caltrans and other stakeholders to review the current approved concept, and discuss our plan and any other issues that might need to be incorporated into the project as we go forward. 9. Develop preliminary design to address all conceptual issues, to see the extent of impacts on adjacent properties, and to determine the extent of environmental documentation that may be required for this project. 10. Focus on design of alternative improvements that are of a high priority and is considered as a 'Y' choice". 11. Proceed forward with preparation of detailed plans and specifications for submittal to the City/Caltrans for review. 12. Prepare right-of-way plats and description for the appraisal and negotiations with Caltrans. 13. Continue the plan preparation and submittals process as necessary to address all review comments and to obtain encroachment permit and the City's approval for Final Product. 14. Assist the City staff during bidding period as an optional service. 15. Provide support during construction and/or construction inspection as an optional service. Professional Civil Engineering Services 2 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano PROJECT UNDERSTANDING MANAGEMENT APPROACH Based on our experience on past similar projects, APA proposes to take a leadership role to manage this project as the prime consultant. APA will assign an overall Project Manager as a link with the City of San Juan Capistrano to direct and oversee successful completion of the activities required in accomplishing each phase of the contract Each of the functional work areas will be headed by a Task Leader, specializing in that aspect of the work. We plan to use: ❑ APA Engineering, Inc., Prime Consultant—Responsible for overall Project Management, Engineering and Plan Production, Product Delivery, Scheduling,Cost Control, Permits and Agency Coordination. ❑ Austin Foust Associates, Inc.—for Traffic Engineering and Signal Design Services ❑ Richard Fisher Associate—for Landscaping and Irrigation Services ❑ Geo-Environmental, Inc.(DBE)- for Pavement Evaluation and Pavement Design Services ❑ Ultrasystems Environmental, Inc. (WBE)—for Environmental Document Services (optional) ❑ Overland Pacific& Cutler, Inc—for Right-of-Way Appraisal Services (optional) APA has worked with or currently is working with the subconsultants proposed for this project. Over the years we have established a very good working relationship with each other. Through teamwork and by focusing on the client's needs, we have developed an understanding of quality performance beyond client's expectation. Beginning with day one, we will organize and set up as is delineated in our Organizational Chart. We will focus our effort on project development and design with the understanding that other technical services may be necessary to accomplish the assignment. To maintain availability and continuity of staff, we will utilize a few of the same personnel in both design and construction phases. APA, upon being given Notice to Proceed, will attend a kickoff meeting to introduce the key staff to the City and involved agencies and set the project in motion. Before conducting any tasks, APA will prepare a detailed work plan for conducting the review and assessment of the Project Development process. During the project development and value engineering process, we will make ourselves available for any other assignments which may be deemed necessary as part of the Project Management services. Similarly, during the construction period, year two through project completion, we will utilize our construction support staff to respond to any potential Change Order or Change Notice to ensure their participation early on to defuse any potential claim. During the duration of the project, APA, as part of the Project Management Services, will submit a consolidated Quarterly Project Evaluation and Status Report to the City. In addition, APA will submit a monthly"Spot Report"delineating progress outstanding issues, action items and impact of inaction PROJECT CONTROL Project Management and Coordination are not defined with any one particular task, but as an ongoing process throughout the entire project. APA will be responsible for the coordination of this project. This will include internal coordination with our staff and possible subconsultants, as well as with the staff at the County, City, and other agencies that are affected by the project. This portion of the work will also include quality control/quality assurance, and project administration, including monthly progress reporting and scheduling. Professional Civil Engineering Services 3 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano PROJECT UNDERSTANDING In order to deliver projects successfully, all possible issues and challenges will be identified and anticipated early on. These issues and challenges will be prioritized in the order of operation, social, economical and political impact. For each one of these challenges, several alternative solutions will be developed as plan A, and B for consideration to deal with the challenges of the project as they present themselves during the life of the project. In addition, from day one, a partnering philosophy will be implemented and conducted as often as necessary to align all the players and concentrate the team's focus on the project and its common goals and benefits. Asystem of checkina the `planned vs. actual" progress will be developed and evaluated periodically for several key elements of the project which will flag inconsistencies in project schedule, budget, staffing and delivery. This information will be used to ensure that the project is always on track. By being proactive and involved, errors and misdirection can be eliminated early on, therefore minimizing the need for rework which often burns the budget, delays the project, and generates claims. Otherwise, "do it right the first time" is the best and most effective policy that will be followed to save time and to produce quality products cost effectively. The project control system which APA uses consists of both an internal system and an external system. The internal system is part of the company's accounting system, where in expenditures and man-hours are tracked against those projected for the project. The input to this system is a detailed listing of task sorted by phases, man-hours budgeted, and project costs. The output is a detailed cost and man-hour status of the project. APA will provide an external control system for the project utilizing our Primavera Sure Track Project Management software. This system, which is very sophisticated, enables us to track every task in terms of completion schedule, cost expended, man-hours projected and expended, interaction with other tasks, and project completion, etc. It provides good graphical displays of the information, and is an excellent tool for the control of the project. QUALITY ASSURANCE/QUALITY CONTROL To provide the County with the best possible product, on schedule and within or under budget, APA will implement a Quality Assurance/Quality Control (QA/QC) Program that is organized in a manner that can be modified to accommodate the specific needs and requirements of this project. QA/QC program is generally divided into two phases: Peer Review - This review is done within the project design team, completed by the design supervisors as the work progresses. Independent Review-This review is conducted at various times by design personnel who are outside of the regular project design team. Phase I- Peer Review This review process is done for all projects undertaken by the team. Prior to the start of any design work, an analysis is made to determine the technical requirements, the needs and requirements of the client, jurisdictional requirements, and any fiscal constraints or schedule requirements of the project. At this time, specific quality control requirements and internal review procedures are established for the project. Professional Civil Engineering Services 4 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano PROJECT UNDERSTANDING The quality control requirements usually include the following: • Analyzing design requirements and assigning work tasks, including reviewing work, to specific design or drafting staff individuals. • Establishing design and drafting standards that are acceptable to the client, to be utilized on the project. • Establishingthe project schedule and identifying critical milestones to complete the project within the P 1 Y 9 P P 1 proposed schedule and budget. • Establishing internal review procedures. All designs are reviewed by members of the design team. Review of work, both completed tasks and those tasks in progress, are conducted by personnel of equal or higher classification than the staff accomplishing the work. • The County is encouraged to be involved in the QA/QC process. We will maintain regular contact with the County staff and will schedule project status meetings to insure that the project objectives are met to the County's satisfaction. Phase II - Independent Review For major or complex projects, a detailed review of the project is also done in addition to the peer review. This process involves the assignment of senior personnel, including principals of the company, to perform a detailed, independent review of the work done on the project and to evaluate the design of the project in meeting its objectives. The selection of senior personnel for this task is based on their professional expertise, specific knowledge of similar projects, and years of experience. At a minimum, the detailed reviewer's responsibility will include: a) Evaluation of the overall project concept. b) Verification of the adequacy of the design to achieve the project goals. C) Evaluation of possible design alternatives. Recommendations made by the independent reviewer are made directly to the Project Manager, who has the responsibility to evaluate the recommendations and implement changes as required. Professional Civil Engineering Services 5 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano SCOPE OF WORK SCOPE OF WORK The objective is to improve the intersection of Rancho Viejo Road and Junipero Serra Road to improve the traffic operation and traffic circulation in the vicinity of the 1-5 interchange. Plans, Specifications and related bid documents will be prepared for the widening of Junipero Serra Road on both sides (north and south) and widening of Rancho Viejo Road adjacent to the Caltrans Park and Ride facilities to allow additional right and left lanes through the intersection. The following issues will be considered as minimum during design development process: 1. Review existing plans and perform detailed topographic survey for use in the preparation of project plans at 1"=40' as necessary to prepare a current existing condition base map. 2. Prepare improvement plans and specifications based on the following issues raised during the concept review phase which will need to be addressed during the design phase. i. Caltrans review and permit. ii. Modification to Caltrans Park and Ride (North and South)to retain the same totally number of parking spaces. iii. Various suggestions were made during the concept review stage on how the intersection should operate. These should all be reviewed and a recommendation made from the following: a. Signal split phases for the north-south traffic directions on Rancho Viejo Road (Caltrans). b. Restriction of the right turn on red movement for the southbound Rancho Viejo Road (Caltrans). In 2003, as a recommended "Immediate Project" by the Traffic Congestion Relief Ad Hoc Committee the City implemented this restriction at the intersection. This was subsequently discontinued as no benefit and is the current situation. c. "Do Not Block Intersection Sign" (Resident) d. Free southbound right turn at Rancho Viejo Road and Junipero Serra (Commission) e. Right turn arrow for southbound Rancho Viejo Road (Commission). iv. Caltrans has requested that the southerly Park and Ride access from Junipero Serra Road should be retained but as right tum entry only. Preparation of Preliminary Plans including landscaping for Environmental Review. 4. Utility Relocations. 5. Drainage, including modification of existing. 6. Storm Water Pollution Prevention Plan (SWPPP). 7. This project exceeds 5,000 square feet of new pavement and must include treatment of runoff. 8. Landscaping & Irrigation. 9. New"Right-of-Way' boundaries.The City will process these as some form of agreement with Caltrans. 10. Consideration of landscaping some or all of the southbound left-turn protection and the chevron island as raised medians. 11. Possible minor retaining wall separating south parkway and south parking lot. 12. CEQA Initial Study as an optional fee item. 13. Coordinate by certified mail with utility companies regarding existing and future facilities. 14. Prepare bid package(s), inclusive of general and special provisions,for bidding and construction in accordance with City format. 15. Provide reproducible plans and Mylar 36"x24"and a CD of the plans in AutoCAD .DWG (or DXF) layered format using OCLB (Orange County Land Base) coordinates NAD83StatePlane VI. in accordance with the City's digital submittal standards (Attachment 3). Project Management and Coordination APA Engineering will meet periodically with the City of San Juan Capistrano staff during the progress of the design for general coordination, to discuss design issues, and obtain direction from the City on policy and design issues. APA's Project Manager will provide overall project control, City coordination, and project monitoring through completion of the contract documents and into the construction phase of the project. He will maintain adherence to APA's ongoing quality control program. This will include the review and tracking of the project progress, advising the City of schedule status, and coordination with the City and other affected agencies. APA project manager will coordinate all meetings with the City and provide written meeting minutes documenting the meeting and the important issues discussed at the meeting. Professional Civil Engineering Services 7 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano 0 .A SCOPE OF WORK Task 2. Research and Data Collection Prior to beginning the work tasks, APA Engineering will assemble the project team for a project kickoff meeting. The team will be comprised of the City of San Juan Capistrano staff and APA Engineering key project staff. The purpose of this meeting will be to review the scope of work, the project schedule and to finalize any administrative details such as point-of-contact for each team member. APA staff will review design criteria and collect available City data such as "as-built" records, plat maps, survey control, etc. APA will research all available topographical and utility information required for this project. Task 3. Design Survey for Intersection Improvements APA Engineering survey crew will provide the design survey that will consist of identifying the topographic features within the public right-of-way and in the two existing parking lots that will impact the design. The design survey will include cross-sectioning the streets. The cross sections will be taken at a maximum of 25-foot intervals as well as at centerline intersections, transitions, grade breaks and driveways. Cross sections will be extended 10 feet beyond the right-of-way and 50 feet on cross streets from beginning and end of curb returns. The design survey will provide flow line elevations along the gutter every 25 feet. Survey will also include all pertinent surface culture including but not limited to catch basins, valves, manhole covers and fire hydrants. In addition, APA survey crew will collect data for preparation of before and after corner records of the existing centerline Monumentation. All survey points will be data collected and electronically transferred to our computer for preparation of the improvement plans. APA Engineering will prepare a detailed topographical base map at 1"=40'scale for use in the final contract document drawings from the as-built improvement plan drawings and the desigrf survey. All drawings will be prepared in AutoCAD using Land Development(Softdesk)design enhancement packages. In addition, APA will perform field surveying to develop street cross sections for existing striped median and lanes immediately adjacent to median.This will allow APA to develop top of the median curb profile and see if cross slope reversal may be needed within the left turn pockets for positive drainage. Task 4. Utility Investigation and Coordination APA Engineering will contact water, sewer, electric, telephone, gas, cable and all other utilities providing service within the project area. We will notify each utility company of the City's proposed plans, proposed schedule and obtain as-built drawings of the existing utilities. Utility located from these record drawings will be shown on the base map for preparation of the construction plans. All key communication and coordination activities with utility companies will be via certified mail. A utility log will prepared to document and track all correspondences with utility companies. Potholing will be performed, if necessary to precisely identify horizontal and vertical position of utilities for relocation, avoidance, and/or protection in place (optional). Task 5. Geotechnical and Pavement Evaluation The City recently reconstructed Junipero Serra Road from the northbound ramps to Rancho Viejo Road. The geotechnical and pavement structural section report from that project will be used in this project. However, APA Engineering will utilize the services of our geotechnical subconsultant to examine the report to see if all the necessary soil and foundation data is provided. Should additional investigation be necessary, APA will discuss the needs with the City PM to obtain authorization for proceeding with the additional geotechnical work to complete the existing report. Task 6. Preliminary Intersection Improvements Plan(65%complete) APA staff will conduct extensive job walk to collect field data and observe and assess the existing condition of the facilities within the street right-of-way. Prior to commencement of this task,APA will meet with the City to discuss the findings, recommendations, and existing condition assessment report. Professional Civil Engineering Services 8 Preparation of Plans,Specifications, Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano SCOPE OF WORK APA will also discuss the base map and existing utilities for each street with the city staff. Upon addressing any comments and receipt of tentative approval from the City, APA will proceed with preparation of the preliminary plans for intersection improvements based on the approved conceptual plan. APA will further develop the conceptual plan considering all the above issues that Caltrans, City Planning Commission, City Transportation Commission, and residents would like to see incorporated. The preliminary design will be developed to avoid taking any unnecessary right-of-way from Caltrans or other owners. Park and Ride facilities on north and south of J Serra will be protected as much as possible. The goal is to modify Caltrans Park and Ride if necessary, but retain the same total number of oarking spaces. Existing driveways will be examined to see it it can be modified to function better and provide more space for landscaping. Additional signs will be developed for traffic circulation within the Park and Ride to ensure proper and faster entry and exit. Traffic signals will be redesigned to make them more functional and more acceptable to Caltrans In addition, free right movements will be examined to see its applicability and operation benefit. Any retaining wall that might be required to minimize impact on adjacent Park and Ride facilities will be designed to be aesthetically pleasing while meeting the City's requirements. Landscaping will be introduced as much as possible to diminish and/or balance the impact of the proposed widening. Median landscaping will be developed as a conceptual plan for the City's approval prior to finalizing the full median landscaping and irrigation plans. we assume that the soil underneath the existing pavement may not be suitable for olantina and has to be tested. If the soil is tested to be not suitable, it may have to be removed and replaced with imported soil thus adding to the cost of this project. The Preliminary Design Phase will be limited to (1) Planting Concept to the new landscaped areas, and, following approval by the City of San Juan Capistrano, will be the basis for the preparation of the Construction Documents. This is based on all Landscape Plans being reviewed and approved by the City and not Caltrans design criteria or approval process. Drainage will be studied and reports will be prepared using County of Orange guidelines, if necessary to meet the City/Caltrans requirements. Since this project will have over 5000 square feet of new pavement a runoff treatment plan will be provided in addition to Storm Water Pollution Prevention Plan (SW PPP). All right-of-ways will be identified and labeled on the base map. All right-of-way takes will be identified and described in a plat format for the City to pursue with Caltrans. Should the City require assistance, APA has included a specialized right-of-way agent in our team to support the City and expedite the Acquisition/Appraisal/rransfer process. Furthermore, concurrent with preparation of the preliminary plans, a determination will be made with respect to the extent of the Environmental Document requirements and level of efforts needed to meet that requirement. APA has included an Environmental Consultant in our team to support the City in any documentation needed by Fed/Caltrans Deliverables: Two sets of preliminary plans and associated reports and exhibits will be submitted to the City for review and comments before proceeding with final design. Task 7. Community Meetings (Optional) APA recommends that community meetings be held after review of the preliminary plans by the City. This will enable the City to share preliminary design plans with the public after it has been reviewed by the staff. Prepare 100%Construction Plans APA Engineering will prepare the improvement plans for approval by the City of San Juan Capistrano. All improvement plans will be prepared in compliance with the City of San Juan Capistrano standards.The plan and profile drawings on 24"x36"sheets will show the street in plan, and profile if necessary, at an appropriate scale. The profile will show existing centerline as well as proposed centerline and proposed street edge of pavements profile. The plan view will show topographic features and elevations necessary for the construction of the proposed improvements and any areas needing repair. The centerline profile will verify drainage cross fall. These preliminary and final improvement plans will consist of the following: Title Sheet- Indicating name of project, a vicinity map showing the specific location involved in the improvement plans, general notes, utility agencies'contacts and phone numbers, a sheet index and a list of the construction notes. Typical Section—Will show several typical sections within the limits of improvements indicating all horizontal dimensions and the proposed and existing median section. Street Plan and Profile Plans—Will show street, median, parking lot, and sidewalk construction plans including limits of grinding, saw cutting, overlay, pavement and base removal and replacement, median curb, median drainage, utility adjustments, record utilities, design survey information, and construction notes. These improvement plans will show all repairs, reconstruction, and alterations to the existing improvements including but not limited to curb and gutter, sidewalks, cross-gutters, driveways, ADA ramps, retaining walls, and catch basins. Signing and Striping Plans—Will show all proposed striping and lane markings reflecting the proposed lane configurations as approved by the City Traffic Engineer Construction Staging Plans—Will provide a basic guide and criteria for contractor to prepare its own traffic control plan for city approval prior to construction. Detail Sheets-Will show sections, details at the intersections, specific drainage feature and improvements that require additional details. Cross-Sections—Will be prepared, if necessary,for the project for use in the design and construction by APA Engineering and the City. The cross sections will be prepared to the criteria stated above. Irrigation Plan—Will show all necessary irrigation lines, heads, control valves, meters, lines and connections to the source as detailed as possible to comply with SB325 irrigation Ordinance. Landscape Plan—Will show all necessary plans and details for planting and landscaping the median, parkways and other areas that may be necessary to soften the impact. Traffic Signal Relocation Plan —Will show all existing traffic signal plans on one sheet and proposed signal relocation on another plan. Plans will show signal pole and mast arm locations, type of foundations, heads and type of heads, signage, conduits, wiring, phasing diagram, and all other schedules needed to install a complete and functional traffic signal system including all ADA requirements. Drainage Plan—Will show all existing and proposed drainage facilities including any demolitions, relocations of catch basins, installation of new pipes, drop inlets, water quality, etc. it will show lines in both plan and profile with stations, invert elevations and pipe slope as necessary for construction. Professional Civil Engineering Services 10 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano SCOPE OF WORK Storm drain/hydrology/hydraulics/water quality-The proposed widening will be reviewed to verify if drainage system upgrades are required. Storm drain upgrades may consist of an additional catch basin, a storm drain lateral pipe, and a storm drain manhole or junction structure to connect to the existing storm drain system. APA will work with the City to design a storm drain system that will convey the drainage into the existing storm drain system without affecting any utilities or any of the private landowners. After all existing data is collected and reviewed; we will prepare updated hydrology calculations to verify the amount of stormwater created by the proposed widening project. Hydraulic calculations will be prepared for the existing storm drain system and for the proposed drainage inlet/storm drain system to verify that the stormwater can be collected and conveyed to alleviate any flooding. A preliminary/schematic plan will then be prepared and submitted along with the hydrology/hydraulic calculations to the City of San Juan Capistrano for concurrence before incorporation into the final plans and specifications. In addition, if this project will have over one (1) acre of disturbance, a Notice of Intent(NO]) will filed and a Stormwater Pollution Prevention Plan (SWPPP) will be prepared for use during construction. The NOI and SW PPP are required for projects that disturb more than one acre. The proposed project will have over 5000 square feet of pavement.Therefore, based on the latest Regional Water Quality Board rules a Drainage Area Master Plan (DAMP) or a Standard Urban Stormwater Mitigation Plan (SUSMP) will be prepared to determine water quality requirements and size of any water quality treatment facilities needed for this project. Task 9. Prepare 100% Specifications APA team will prepare construction specifications consistent with the City of San Juan Capistrano format. The special provisions will be prepared using the City of San Juan Capistrano standards and the latest edition of Standard Specifications for Public Works Construction (Green Book). The specifications will include the required provisions for replacement of pavement markings and striping removed during construction with thermal equivalents as well as traffic control and stage construction during construction. Task 10. Prepare 100% Opinion of Probable Construction Cost APA will prepare an itemized quantity estimate and cost estimate based on general engineering standards for each street. APA will also prepare a bidder's proposal sheet for use in project bidding as required by the City. APA will use typical industry standards units and will provide an engineer's cost estimate for construction bid purposes. Task 11. Prepare Final PS&E APA will review and address 100% review comments from the City. These comments will be addressed and incorporated into the PS&E as appropriate. The revised 100% PS&E will be submitted for final review by the City. Task 12. Caltrans Encroachment Permit APA will prepare required applications, exhibits, and fact sheets if necessary to obtain encroachment permit from Caltrans District 12. APA is very familiar with the process and just recently obtained encroachment permit for reconstruction of Beach Boulevard (State Highway 39) in the City of La Mirada. During the review process we will work with Caltrans design review team and address their concerns by discussing and resolving them prior to issuance of written comments. Professional Civil Engineering Services 12 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano SCOPE OF WORK CEQA Initial Study for Improvements to the Intersection of Junipero Serra Road and Rancho Viejo Road for the City of San Juan Capistrano PROJECT UNDERSTANDING Proposed Project. The City of San Juan Capistrano has prepared and approved a traffic study and concept plans for the Junipero Serra Road and Rancho Viejo Road Intersection Improvements. The improvement plans have several issues that will need to be addressed in the preparation of plans and specification (Design) and in the preparation of the California Environmental Quality Act (CEQA) Initial Study(IS): 1. Modification to Caltrans Park and Ride (North and South) — Design will retain the same total number of parking spaces in the Caltrans Park and Ride lots; the IS will discuss the retention of the same total number of parking spaces. 2. Intersection Operation — Design will evaluate the intersection operation suggestions made during the concept review stage. The IS will analyze the intersection operations selected by Design. 3. Southerly Park and Ride Access— Design will evaluate the southerly park and ride access suggestions made during the concept review stage. The IS will analyze the park and ride access selected by Design. 4. Drainage Facilities Modifications, Storm Water Pollution Prevention Plans, and Treatment of Runoff — Design will identify the utility relocations that will occur, including modifications to drainage facilities; the IS will analyze these utility relocations. Storm water pollution prevention plans measures to minimize soil and debris from entering storm water facilities will be discussed in the IS. Proposed treatment of runoff from the more than 5,000 square feet of new pavement will be discussed in the IS. 5. Landscaping and Irrigation— Design will identify the landscaping and irrigation components of the proposed project; the IS will discuss landscaping and irrigation. 6. Right-of-Way Boundaries—Design will identify any change in right-of-way boundaries. It is currently anticipated that the City will process these as some form of agreement with Caltrans. The IS will discuss any change in the right-of-way boundaries. 7. Retaining Wall — Design will determine whether a minor retaining wall separating the south parkway and south parking lot will be required; the IS will discuss the retaining wall if it is included in the project design. CEOA Guidance. The California Environmental Quality Act(CEQA) Guidelines Section 15300 describes Categorical Exemptions, which are classes of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. Section 15301 describes Class 1 Categorical Exemptions, which consist of: "...the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The types of "existing facilities" itemized below are not intended to be all-inclusive of the types of project which might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of an existing use. Examples include but are not limited to... (c) Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and Similar facilities (this includes road grading for the purposes of public safety)" (e) Additions to existing structures provided that the addition will not result in an increase of more than: 10,000 square feet if: Professional Civil Engineering Services 13 Preparation of Plans,Specifications,Intersection Improvements Rancho Viejo Road and Junipero Serra Road Intersection San Juan Capistrano SCOPE OF WORK (A) The project is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan and (B) The area in which the project is located is not environmentally sensitive. CEQA Guidelines Section 15061 addresses the steps that a lead agency needs to take in its review for Exemption: A project is exempt from CEQA if: (2) The project is exempt pursuant to a categorical exemption and the application of that categorical exemption is not barred by one of the exceptions set forth in Section 15300.2. (3) The activity is covered by the general rule that CEQA applies only to projects, which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA..." Hence, while it appears that the improvement of the Junipero Serra Road and Rancho Viejo Road intersection may be exempt from CEQA as a Class 1 Categorical Exemption, it is also necessary for the lead agency to determine that there is no possibility that this Project would have a significant effect on the environment. The exceptions to Categorical Exemptions described in CEQA Guidelines Section 15300.2 include cumulative impacts, significant effect, scenic highways, hazardous waste sites, and historical resources. UltraSystems Work Plan. This proposal specifies the work plan by describing in detail the scope of work that will be completed by the UltraSystems project team and delineating the UltraSystems approach to complete the work. The major work task proposed at this time is the preparation of the Initial Study and determination of the applicability of the CE to this project: TASK 1 -PREPARE INITIAL STUDY AND DETERMINE APPLICABILITY OF CE It is expected at this time that the CE would be the appropriate environmental document to satisfy CEQA environmental documentation requirements. UltraSystems will prepare an IS, and based on the findings of the IS, UltraSystems will determine whether the CE would be applicable for this project. The IS will include all requisite information as required by State CEQA Guidelines Section 15063(d). UltraSystems will submit the draft Initial Study to City staff via email for review and comment. No stand-alone technical studies will be produced; all necessary environmental analyzes will be documented in the Initial Study. Noise and air quality analyses will be qualitative in nature; extensive modeling will not be conducted. All improvements will be within existing roadway intersection right-of-way; no acquisition of additional property that may contain hazardous materials will be required. All improvements will occur on previously paved or highly disturbed areas; no undisturbed areas that may contain biological or cultural resources will be potentially impacted. If it's found that potentially significant and adverse impacts may result from the proposed improvement of the Junipero Serra Road and Rancho Viejo intersection, the CE would not be the appropriate environmental document to satisfy the requirements of CEQA.
