Nasser Abbaszadeh, Public Works Director SUBJECT: Consideration of Agreement for Sign Inventory and Database (3M, Inc.) RECOMMENDATION: By motion, 1. Approve the Sign Inventory and Database Agreement with 3M, Inc. for inventory and database creation of City signs, in the amount of $32,988; and, 2. Authorize the City Manager to execute the agreement. Summary and Recommendation: In November 2010, the City solicited Proposals for the purpose of creating a city-wide inventory and database for roadway signage. The inventory/database is required to meet Phase I of the new Federal Retroreflectivity Program mandate which requires an inventory and subsequent replacement plan of any signs that do not meet the new retroreflectivity standards. An agenda report for award of this contract was originally brought to City Council on May 3, 2011. At that time, staff was directed to explore other "creative solutions" that would result in a City-wide sign inventoryldatabase that would meet the compliance mandate. After further research and analysis, as other options were explored, staff believes that the 3M solution is the most economical alternative for the City. The 3M proposal to provide data collection and use of the FastTool for continued compliance is the best method that will meet the compliance deadline. A cost/benefit analysis is attached that outlines the various options that were considered. Key points leading to this recommendation are: • Software development for the initial database (regardless of inventory method) would cost approximately $20,000 and would take at least another 8 weeks for development, not including required hardware/equipment to accomplish the inventory. ASAP Volunteers are not available to perform this work. Costs for other alternatives (volunteers, interns, in-house) will be higher than the 3M option and will not meet the time deadline for compliance of January 2012. Agenda Report Page 2 June 21, 2011 Staff recommends awarding the agreement for these services to 3M, Inc. for a total of $32,988. This program will be funded by Measure M local turnback funding and was approved in the 2010/2011 Capital Improvement Program Budget, Work is expected to begin in July 2011 and be completed by December 2011, in advance of the January 2012 deadline for Phase I compliance. Sign RetroreflectivitV Re uirement Background The Manual on Uniform Traffic Control Devices (MUTCD) is the national standard for all traffic control devices installed on all roads that are open to public travel. These rules apply to traffic control devices on "any street, highway, or bicycle trail open to public travel". Additionally, many states, including California, have their own MUTCD that meets or exceeds the federal manual standards (CA MUTCD). Retroreflectivity standards were originally established in 1993 by the Department of Transportation appropriations act and were again updated in 2003. In January 2008, the new Federal Highway Administration (FHWA) rule on sign retroreflectivity of the MUTCD went into effect. This FHWA rule requires public agencies to establish a sign assessment and management method to maintain a prescribed level of sign retroreflectivity by 2012. It also requires that by January 2015, all ground-mounted traffic control signs must meet these retroreflectivity requirements. The new retroreflectivity standards will insure improved visibility for motorists/pedestrians alike, especially after dark and make for a safer San Juan Capistrano. In addition to improving the safety of our community, compliance is required to obtain Federal funding for projects as well as the avoidance and defense of future litigation. COMPLIANCE DATE REQUIREMENT January 2012 Implementation and continued use of an assessment or management method designed to maintain retroreflectivity at or above established minimum retro levels._ January 2015 Replacement of regulatory, warning, and ground-mounted guide (except street name) signs identified as failing to meet the minimum retro levels. January 2018 Replacement of street name signs and overhead guide signs identified as failing to meet the established minimum levels. The Public Works Maintenance Division is responsible for the upkeep of approximately 5,000 signs, including regulatory, traffic control, and street name signs throughout the City of San Juan Capistrano. To meet the January 2012 compliance deadline, an inventory/database is required, Staff considered the possibility of meeting the Phase I requirement for inventory/database by performing an in-house inventory, and found that this was not a viable solution due to staffing levels expertise and equipment required to create and maintain an accurate inventory. Additionally, there is no work order system in place where the inventory would be managed, also a requirement of the Federal mandate. While a new work order system has recently been purchased (Maintstar), it will not be available for Public Works use until 2012/2013 or beyond. Agenda Report Page 3 June 21, 2011 As part of the 2010/2011 Capital Improvement Program, City Council approved CIP No.11101, Sign Retroreflectivity Update Program to meet the new mandate. The objectives of the CIP are to first identify the types of signs, GPS location, and properties of each sign located throughout the city and prepare an inventory/database to be used for both compliance as well as an on-going maintenance program. After initial compliance, the City is required to continually update/replace all signs on a regular basis, and maintain all sign information in its database to insure continued retroreflectivity compliance. Unique to the industry, the 3M proposal includes the Field Asset Status Tracker (FAST) tool system which will allow Public Works field staff to track sign assets and update the system from a standard notebook computer in the field using customized, proprietary software designed specifically for this task. Therefore, when staff replaces or repairs signs at a future date, the information will be able to be quickly and easily updated by using the FAST tool and the information uploaded directly into the web-based program. This will insure that the database and inventory will always be current and allow for strategic replacement planning of the City sign assets. The experience and efficiency offered by the 3M solution will insure that the City is provided with the most accurate information and allow.for greater efficiencies for future sign maintenance. Additionally, by having a photographic record and GPS coordinate, this database will allow staff to determine a particular sign's exact location in relation to other coordinate-mapped City assets, such as trees, water facilities and street lights. In addition, it will identify the exact sign assembly and location for replacement of missing signs, and possibly avoiding a field visit and therefore saving on staff expenses. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: NIA FINANCIAL CONSIDERATIONS: This new mandate was included in the Long Term Strategic Vision Plan under City Council Priority #3-2-1c. Funding of this program was included in the approved Fiscal Year 10111 Capital Improvement Budget, CIP No. 11101, provided by Measure M local turnback funding. An annual charge of $1,500 for software/maintenance will be provided for in the operating budget for software update/web-hosting beginning in Fiscal Year 2012/2013. Cost/Benefit Analysis i PERSONAL SERVICES AGREEMENT THIS AGREEMENT is made,entered into,and shall become effective this day of 2011, by and between the San Juan Capistrano (hereinafter referred to as the "City") and 3M, Inc. (hereinafter referred to as the "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's l proposal to create a sign inventory and database; and WHEREAS, Consultant is qualified by virtue of experience,training, education and E expertise to accomplish such services. I NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by the Consultant shall consist of those tasks as set forth in Exhibit'A," attached and incorporated herein by reference. To the extent that i there are any conflicts between the provisions described in Exhibit"A"and those provisions l contained within this Agreement, the provisions in this Agreement shall control. Section 2. Term. R This Agreement shall commence on the effective date of this Agreement and E services required hereunder shall continue until notified that said services are no longer required, subject to 15 days notice of termination. f I Section 3. Compensation. 3.1 Amount. j Total compensation for the services hereunder shall not exceed$32,998 for initial inventoryldatabase and$1,500 annually thereafterfor software maintenance, as set forth in Exhibit "B," attached and incorporated herein. l ' i 3.2 Method of Payment. Subject to Section 3.1, Consultant shall submit monthly invoices'Lased on total services which have been satisfactorily completed for such monthly period. The City will pay monthly progress payments based on.approved invoices in accordance with this Section. 1 l g A.TTACHMENT I ,: 6 3.3 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to the City. Invoices shall be addressed as provided for in Section 16 below. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of the City, and shall obtain no rights to any benefits which accrue to Agency's employees. Section 5, Limitations Upon Subcontracting and Assignment. B The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for the City to enter into this Agreement. Consultant shall not contract with any other.entity to perform the services required without written approval,-of the City. This Agreement may not be assigned, voluntarily or by operation of law,without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to the City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. i Section 6. Changes to Scope of Work. i For extra work not part of this Agreement, a written authorization from City is required.prior to Consultant undertaking any extra work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City,the Parties hereto shall execute an addendum to-this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. l Section 7. Familiarity with Work and/or Construction Site. By executingthis Agreement, Consultant warrants that: '1 it has investigated the g ( ) g work to be performed; (2) if applicable, it has investigated the work site(s), and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work to be performed under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform the City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. 2 f { E f Section S. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law; EVeri 9.1. Compliance with Law. Consultant shall comply with all applicable laws,ordinances, codes and regulations of federal, state and local government. 9.2. E-Verify. If Consultant is not already enrolled in the U.S. Department of Homeland Security's E-Verify program, Consultant shall enroll in the E-Verify program within fifteen days of the effective date of this Agreement to verify the employment authorization of.new employees assigned to perform work hereunder. Consultant shall verify employment authorization within three days of Firing a new employee to perform work under this Agreement. Information pertaining to the E-Verify program can be found at http://www.uscis.gov, or access the registration page at https://e-verify.uscis.gov/enroll/. Consultant shall certify its registration with E Verify and provide its registration number within sixteen days of the effective date of this Agreement. Failure to provide certification will result in withholding i payment until full compliance is demonstrated. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any, interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No-person having such 1 interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the work, Consultant shall have delivered to City at least one (1) copy of any final reports and/or notes or drawings containing Consultant's findings, conclusions, and recommendations with any supporting documentation. All reports submitted to the City shall be in reproducible format, or in the format otherwise approved by the City in writing. l i 3 3 I 9 ........... ...... .... Section 12. Ownershipof Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the 9 City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. To the fullest extent permitted by law, Consultant agrees to protect, defend, and hold harmless the City and its elective and appointive boards, officers, agents, and employees from any and all claims, liabilities, expenses, or damages of any nature, including attorneys' fees, for injury or death of any person, or damages of any nature, including interference with use of property, arising out of, or in any way connected with the negligence, recklessness and/or intentional wrongful conduct of Consultant, Consultant's agents, officers, employees, subcontractors, or independent contractors hired by Consultant in the performance of the Agreement. The only exception to Consultant's responsibility to protect, defend, and hold harmless the City, is due to the negligence, recklessness and/or wrongful conduct of the City, or any of its elective or appointive boards, officers, agents, or employees. This hold harmless agreement shall apply to all liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Consultant. Section 14. Insurance, Can or before beginning any of the services or work called for.by any term of this Agreement, Consultant, at its own cost and expense,shall carry, maintain for the duration of the agreement, and provide proof thereof that is acceptable to the City, the insurance specified below with insurers and under forms of insurance satisfactory in all respects to the City. Consultant shall not allow any subcontractor to commence work on any subcontract until all insurance required of the Consultant has also been obtained for the subcontractor. Insurance required herein shall be provided by Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or I better. 14.1 Comprehensive General Liability, 3 Throughout the term of this Agreement,Consultant shall maintain in full force and effect Comprehensive General Liability coverage in an amount not less than one million dollars per occurrence ($1,000,000,00), combined single limit coverage for risks l I 4 3 3 ._. _....__.. If a Commercial General Liability Insurance form or other form with a general aggregate limit is 'used, either the general aggregate limit shall apply separately to the work to be performed under this agreement or the general aggregate limit shall be at least twice the required occurrence_ limit. l 14.2 Comprehensive Automobile Liability. l Throughout the term of this Agreement, Consultant shall maintain in full force i and effect Comprehensive Automobile Liability coverage, including owned, hired and non- owned vehicles in an amount not less than one million dollars per occurrence ($1,000,000.00). 14.3 Worker's Compensation, If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employers Liability Insurance in the statutory amount as required by state law. 14,4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self-retention amount, and an additional insured endorsement naming City, its officers, employees, agents, and volunteers as additional insureds as respects each of the following: Liability arising out of activities performed by or on behalf of Consultant, including the insured's general 3 supervision of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant;or automobiles owned, leased, hired,or borrowed by Consultant. The coverage shall contain no special limitations on the scope of protection afforded City, its officers, employees, agents, or volunteers. 14.5 Errors and Omissions'Coverage NIA 14,6 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty(30)days'written notice is given to City,exceptthat ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium.. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions 5 w have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written"Notice to Proceed"verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to Consultant. In addition, this Agreement may be terminated by any party for cause by providing ten (10) days' notice to the other party of a material breach of contract_ If the other party . does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day.cure period. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. The data housed in the web-base database can then be used by the City for maintenance. activities. General Overview Based on the information in the Request for Proposal provided by the City, 3M understands that the City of.San Juan Capistrano is looking for a full service "turnkey"solution for inspecting, recording and Inventorying all City-owned traffic signs. This includes regulatory, warning and guide signs with their associated appurtenances and hardware in the City of San Juan Capistrano. Also included are street names signs and signs within City owned parking lots, parks, trails an exterior facilities. 3M will conduct the inventory, inspection and condition assessment of all signs and ancillary related items, listed above, located within the City of San Juan o i Capistrano's right-of-way for conformance to the Manual of Uniform Traffic Control Devices (MUC"CD) and FHWA minimum reflectivity requirements. All signs located within the City's 13.6 square miles, or approximately 112 centerline miles of roadway right of-way, will be inventoried. For purposes of responding to this RFP, the City estimates there are 4,000 traffic signs and 1,000 street name blades within the City's limits. This permits users to establish the initial inventory and enter changes as maintenance activities are completed. Sign Inventory luta Collection and Processing i 3M has developed a very efficient asset data capture method that will be employed for the City of San Juan Capistrano. Based on estimated 112 centerline miles for the City,we estimate it will take approximately three (3)work days to complete this task. The 3MTM Sign Management System uses a mobile camera system that captures pictures and GPS locations at 5 frames per second. This rate of data capture was selected to insure accuracy and image quality while driving at normal posted speed limits. The sign pictures, and corresponding GPS locations, are used by 3M .technicians to record sign location, attributes and physical condition (Figure 1). Table 1 below lists the attributes and conditions that will be captured for the City of San Juan Capistrano. At this point, the attributes unique to. that feature will be locked into the map identifier, so the feature and its geospatial location can be accessed in the future. This phase of the project will take approximately two (2)weeks to complete. 3. 3M"Fleld Asset Status Tool. (FAST) -- 3M'sexperience-working-with-agencies for'over 50'-years;-has-shown_us that inventory systems fail because,the inventories are not easily maintained and data cannot be updated as work is being performed in the field. This is no longer the case l with the 31VI'"" Sign Management Systems' Feld .Asset Status Tool (FAST tool). The l 3 1 FAST toolallows the agency to maintain their Inventory daily and record updates.while working in the field. The 3M FAST tool consists of a GPS enabled "netbook" computer with a touch screen and preloaded software package (Figure 2). This is a stand-alone desktop GTS application (not connected to the internet for any functionality or data). The FAST tool allows 3M and the City of San duan Capistrano to perform sign and post assessment or maintenance tasks via touch screen interface on the "netbook" computer. j The FAST tool allows users to quickly identify and record maintenance activities on site. It can also allow users to assess a sign's condition without leaving the vehicle. The data can be downloaded via wireless internet access or by docking at the user's office. Once complete, the comprehensive sign inventory system serves as the basis of all information that drives decisions for a number of sign management activities by the. City of San .Tuan Capistrano. The 3MTm FAST Tool (Field Asset Status Tool) will be used by the City to record maintenance activities for the signs in the web-based inventory database. As part of routine maintenance activity, daytime inspections are, conducted to identify signs that require replacement due to damage, vandalism or l obstruction. The FAST tool is used to collect and store this information. The screen shot below(Figure 3) shows another view of the user interface of the FAST tool and demonstrates the high degree of functionality it could provide City of San Juan.Capistrano personnel to efficiently update inventory records in the database. e I F Figure 3-FAST tool f i l " The FAST tool uses GIS data files in both ESRT Shapeflle format and SSRI Personal Ge.oDatabase format, The tool also utilizes GPS to continually update the user's current location relative to sign locations at a minimum.of 1 second intervals. The"feature'attribute table includes the ability to sort the data in ascending or descending order based on the column heading and able to select which attribute fields are to be L displayed for assessment. The FAST Tool connects, or docks, with the master web-based signs' database to extract a copy of the database -that could be used by.City of San Juan Capistrano personnel for maintenance activities in the field. Once the maintenance activities have been completed, the FAST tool will again be connected, or docked, with the web based database to upload the changed records. After the changed records are € uploaded,the web-based sign database will contain the most accurate inventory of all i traffic signs; and their attributes,-for the City of San Juan Capistrano. { 4. Assessment of Sigil Performance I ' 3M's system is designed to support a Visual Nighttime Inspecttion of signs to identify any deficiencies which impact visibility or legibility. 3M will use the FHWA's Comparison Panel Method to conduct the nighttime assessment. This inspection procedure is one of the allowable assessment methods identified in the document "Maintaining Traffic Sign Retrorefiectivity" (20€15 Edition) available from the Federal Highway Works Administration. 3M will work with the City to prioritize routes for nighttime visual inspection, with the Intent to maximize the benefits to the motorist and maintenance personnel. High priority roads such as Interstate and limited access freeways are usually completed first followed by arterial and collector roads. As these are completed the data recorded using the FAST tool and then posted to the web-based database. City 3 maintenance personnel can begin using the analysis and planning functions before the ? entire road system is completed. In addition, annual maintenance of purchased hardware and software upgrades can be expensive. Since 3M.provides hardware maintenance and free upgrades to the web-based sign inventory database, this ultimately minimizes any additional City of San Juan Capistrano IT resources needed to sustain the system. There is no"per user"license fee for access to the database. A 3M 'hosted system provides password protected access to the web-based database, along with regular backups of the data. The 3M web-based database includes free software updates for the length of our contract with the City. In addition,the server is housed in an underground, temperature control environment to minimize . any disruptions to services for the City of San Juan Capistrano. 3M provides 24 hour/7 days a week access to the database. This allows the City of San .Tuan Capistrano to assign access to those City approved users-requiring admittance to . the database. 3M can also provide the City with the sign inventory in a compatible format for uploading into their Mainstar software in the future. 3M's system was designed from the maintenance engineers` perspective. The mobile image capture system is designed from the ground up specifically to be easily shipped to project locations and quickly assembled on a van or SUV. This mobile system results in a cost-effective solution that eliminates the need to lease or move expensive hard-wired vehicles to dlstant locations. The mobile image capture system is built around 3M-developed software that captures multiple images,with GPS location, at 5 frames per second and allows real-time viewing of the logging process. The system uses dual 1280460 Firewire B cameras, sub-m�tdr GPS, and a custom-built mobile computer designed for the logging process, with uninterruptable power supply and backup data storage to insure data integrity. The inventory process begins by driving the roads for the entire project area in both directions using a vehicle specially equipped to log GPS locations and taking high- quality pictures with each of its two cameras. The mobile camera system captures pictures and GPS locations at 5 frames per second. This rate of data capture was selected to insure accuracy and image quality while driving at normal posted speed limits. The result is a large detailed GPS photo log that will be post-processed to extract sign and post Information. The sign pictures and corresponding GPS locations are used by 3M technicians to record sign location and attributes (Figure 7). NV_ i i - i III a F S. Phase I: Building the Inventory V After the data capture phase of the work is completed, 3M will then develop a comprehensive.inventory of all traffic signs within the City of San Juan Capistrano. " 3M has completed numerous post-processing exercises similar to this for other customers and will utilize the same care and quality assurance to accurately map and develop a comprehensive inventory for the city of San Juan Capistrano. For the data processing phase, each sign location's GPS coordinates will be used to field locate that:particular asset on a GAS base map. At this point, the attributes unique to that feature will be locked Into the map identifier, so the.feature.and its geospadal location cab be accessed in the future(Figure 8) The initial sign. and post inventory is built by further processing the GPS photo log using a software.extension written by 3M for the ArcGTS system, The.GPS.phpto fog is "played back" in real-time (or variable time as needed) to locate each sign and post, and record relevant attributes. Once all the sign and'post inventory attributes have been recorded, the database is sent to Quality Control for verification. In Quality Control, a technician takes a random sample of ten (10)"percent; of the sign/post records in the inventory database to verify that the attributes recorded for those assets are correct. This Is done by again viewing the photo log for that particularasset and comparing those attributes recorded in the database With what the technician views on screen. Final Inventory Database After Quality Control, the records for each sign, its post and attributes are recorded and stored in a central, spatially-aware repository database (Figure 9). At this time, any changes the City of San Juan Capistrano has made to their existing signs will be updated in the database. Implementation Plan In recent years, 3M has created tools and procedures for efficient traffic sign management. We propose managing signs using both daytime Inspection and FHWA visual nighttime inspection, using the Comparison panel Method,to determine sign replacements. t 3M understands sign management must be a.systematic process. It must combine a comprehensive inventory with analysis tools so that effective investment strategies can be developed. A mature sign management system allows an organization to be proactive in how' assets are maintained. Developing a consistent approach to delivery is another important goal for any asset management system. Effective traffic sign management requires a good understanding of sign. performance over time, and 3M is unequaled in this respect. To ensure City of San Juan Capistrano budgeting, scheduling and performance management activities are as efficient as possible, 3M would use this knowledge to be proactive in our sign replacement activities. B. Assessment The assessment process involves both day and night time inspections to visually identify areas of non-performing signs. The inspectors will calibrate their rating using the FHWA guideline or by manually measuring signs at the start of the visual inspection. This calibration will insure consistency in the identification of non- performing signs. The shape files of the suspect signs will be mapped onto to the inventory and reported on the web-based database with the suggested replacement areas in clearly marked colors. The assessment data will drive the decision to either replace sign singularly or in the entire corridor. C. Work Plan Generation f ' 3M will provide a construction management website for our entire supply chain (City of San Juan Capistrano, Fabricator, and Installer) to manage the traffic and stmt name sign replacement pipeline. A website portal will be created to"allow the City to 1 submit work orders, approve sign lists and drawings, monitor the signs being fabrication and installation and download the certification documents. D. Submittal and Approval 3M will submit requests for sign replacement or maintenance via an electronic workflow system to the City for approval. The submittal package will be in the form of a tabular report of sign types,quantity, and drawings. The 3M construction manager will work with City personnel to approve and prioritize signs to be replaced, in consideration of any Capital Improvement Program, budget, other maintenance issues and the traveling public. The 3M construction manager will assist and provide the necessary information to designated City personnel to resolve any discrepancies in the work plan quantities before each annual preconstruction meeting. After the work plan quantities are approved, the next step is.to provide accurate information to the fabricator. E E. Fabrication Once the work list is approved by the City of San Juan Capistrano, 3M will generate fabrication orders including preparing sign drawings for non-standard signs for the City to approve. For signs requiring the City's approval, drawing files will be sent electronically for reference. The fabrication request will be.reviewed .for accuracy and compliance to the City's standards and specifications before commencing production. Once fabrication is completed, the fabricator will' upload the certification package onto the website portal. The C€ty of San Juan Capistrano can then view and download the certification documents for records of compliance. i F. Installation Installers can view the sign fabrication progress via the website portal. They will be alerted by an email from our fabricator as to the status of delivery. 3M provides GIS maps and the FAST tool to the installer, so the exact location of the each sign can easily.be found:The installer will use-the FAST.-tool-to..plantheir-day-more-efficiently.._._.._-....._-- ...-.___._..............._. by sequentially ordering the signs by route. This process also improves accuracy by providing an automated.method to insure correct.placement of the signs. I 1 Keeping the web-based inventory database current will be the responsibility of the 3M team in conjunction with the City of San Juan Capistrano. 3M will use daily log of sign installations as Inputs for updating the inventory database. In addition,traffic engineering will perform an assessment to determine potential signing improvements that would increase visibility and safety for motorists. Traffic Engineering will implement a Sign Management.System data reporting tool, including a central database housed at Its servers.for storing asset data. Traffic Engineering will work with the City to establish appropriate sign data to be captured. This database will be in industry-standard ESDI geo-database format e and sent periodically to the City as part of the work plan submittal. H. 3M's Blanket Replacement Plan Per the RFP, 3M is using estimates of 4,000 traffic signs and 1,000 street name signs for the purpose of this replacement plan. Based on these numbers, 3M has put together a two-year,two-phase, replacement strategy for all the Citys estimated 5,000 signs. These numbers will be adjusted using those from the final sign inventory database. To aid with budgeting, 3M is recommending a two�year 3 replacement plan for all the City of San Juan Capistra o's traffic and street name signs.. Even though 3M is recommending a two-year replacement plan, it would be possible for the City to pay for this project over a longer period of time. If 3M is awarded the sign replacement project and the City is interested In a pay-aver-time option,this can be discussed during negotiations. 3 Based on a review of the final sign inventory, which was developed as stated earlier In this proposal response, 3M anticipates that approximately 3.5% of the signs will be rated"critical"and should be replaced during the first year. Since this is a two- year plan, we are also recommending that another 46.5% of the total signs within the City be replaced during the first year. These would be prioritized based on zone and/or those signs rated as"poor", as discussed with the City. The remaining 50% of traffic and street name signs would be replaced in the second year. This plan would bring the City of San Juan Capistrano into compliance with the requirements of the FHWA minimum reflectivity ruling and MUTCD standards by the end of the second year. 1 Additional, a certain percentage of signs to be replaced will need new pasts. Minimum Retroreflectivity Comparison Standard Panels All standard are made using beaded or prismatic sheetings that have less sensitivity to the changes in the observation angle. The panels are calibrated to the minimum retroreflectivity levels in the MUTCD Table 2A-3. • Each Comparison Panel Method standard master panel shall be generated using a photometric range. A portable reflectometer approved by the sheeting manufacturer can then be used for generating panels for field use. Comparison Panel Method standards are hung in front of the sign using a mechanical clip or hook with 3M Command's' Adhesive to avoid damaging the sign face. • Standards must be re-calibrated annually by sending to the manufacturer. Calibration standard values may not be exactly the same as specified in the MUTCD Table 2A-3. The tolerance, however, must not be larger enough to be visually detectable by a human eye. S. Visual Calibration - Calibrating the Inspector Calibration standards have known retroreflectivity levels at or above minimum levels. The inspector uses the visual standard to calibrate his/her eyes to establish a threshold for the sign brightness levels. Licensee, on behalf of itself, its owners, shareholders, directors, officers, employees,agents and assigns,acknowledges that the Software and all copyrights thereto are the sole and exclusive property of 3M,and that none of the aforementioned parties has any .night,title or interest in the Soflware.except as expressly provided in this Agreement. 12.Publicity. Licensee shall not make any public statements regarding the Software or this Agreement,or make any use of 3M's logos, trademarks, trade names, trade dress or other identifying marks without obtaining 3M's prior written consent in each instance. 13.Governing Law and Attom 'Fees.This Agreement is governed by the laws of the State of Minnesota, excluding its conflict of laws rules.The parties consent to exclusive jurisdiction and venue in the state and ..federal courts Iocated in Ramsey County,Minnesota. In any action or suit to enforce any right or remedy raider this Agreement or to interpret any provision of this Agreement,the prevailing party will be entitled to recover its costs, including reasonable attorneys' fees. We appreciate the forward-thinking response of the City of San.Tuan Capistrano to the FFIWA Minimum Requirements for Maintaining Traffic Sign Retroreflectivity, including requirements for implementing a traffic sign management plan by January, 2012. The Request for Proposal as outlined by your city will enable the City of San Juan Capistrano to meet these federal requirements and minimize your liability. We also appreciated the interaction and discussion with you and your staff when we visited your agency earlier this year. The original proposal included some"open-ended"costs associated with collection of traffic sign data,based on 5000 traffic signs within your city. We understand the need for San Juan Capistrano to contain your costs prior to implementing a contract such as the one under consideration. We have reviewed our calculations and predictions related to the estimate of 5000 signs within your. j city and we are prepared to enter into an agreement that would cap the costs as outlined regardless of how many signs are actually inventoried, If we significantly exceed the 5000 traffic sign figure,3M will absorb this cost. Page 10 of the request for proposal outlines requirements for collecting data on various sign types, including signage for"city owned or leased parking lots, city owned parks,way finding,and trail signs." ,Schedule E,item 3 of our price proposal confirms that completing these signs was included in our overall base price for completing the Inspection and inventory phase of work. In order to reduce costs,we can eliminate the data collection, inventory and assessment costs for these sign types,resulting in savings of$1500 for the project. Data for these signs could be captured at a later date by city forces and could be considered a lower priority compared with standard warning,regulatory,and street name signs located directly along roadway corridors. 3. The night assessment task(optional)was originally listed at a cost of$7250, using our rate of$1.45 per sign for the estimated 5000 signs. We understand that the City of San Juan Capistrano will implement a Blanket Replacement process of. sign management,in line with SHWA requirements. To this end,we will also work with city staff to train your individuals to conduct a night assessment task in the future,using our sign management field tracking tools. We will absorb the cost of training at no additional cost to the City of San Juan Capistrano.
