SUBJECT: City Attorney and Agency Legal Counsel Employment
Agreement - Richard K. Denhalter
RECOMMENDATION:
By motion, approve the attached employment agreement establishing
the compensation for City Attorney/Agency Legal Counsel . The
agreement also establishes the automobile allowance and cancels
employee's eligibility for the City's Management Incentive Pay
Program.
SITUATION:
In addition to his position as City Attorney, the City Council/
Agency Board of Directors has offered the position of Agency Legal
Counsel to Richard K. Denhalter. The Agency Board of Directors is
taking a separate action tonight, by resolution, to appoint
Richard K. Denhalter as Agency Legal Counsel . The City Council
must now take an action to approve an employment agreement with
Richard K. Denhalter to include his expanded duties and establish
the compensation, the automobile allowance and to cancel the
employee's eligibility for the City's Management Incentive Pay
Program.
COMMISSION/BOARD REVIEW, RECOMMENDATION:
Not Applicable.
FINANCIAL CONSIDERATIONS:
The level of compensation and benefits established in the
employment agreement covering Mr. Denhalter's expanded duties does
not exceed the amount of compensation and benefits budgeted for the
City Attorney position (including the budgeted Management Incentive
Program) . A portion of the City Attorney salary, benefits and
overhead will paid for by the Redevelopment Agency, based on time
spent on Agency tasks.
No budget adjustment is required.

ALTERNATE ACTIONS:
1. Approve the employment agreement with Richard K. Denhalter to
provide services as City Attorney and Agency Legal Counsel .
2 . Request additional information from staff.
