CONTRACT REVISION - APPOINTMENT OF RICHARD DENHALTER AS AGENCY COUNSEL (600.30) /N Written Communication: Report dated March 16, 1993, from the City Manager, advising that pursuant to the CRA Board of Directors' appointment of Richard Denhalter as the Agency's Legal Counsel, the Council must approve the employment agreement with Mr. Denhalter to include his expanded duties, to establish his compensation and automobile allowance, and to cancel his eligibility for the City's Management Pay Incentive Pay Program. Approval of Employment Agreement with Richard K. Denhalter: It was moved by Council Member Hausdorfer, seconded by Council Member Nash, and unanimously carried that the Employment Agreement with Richard K. Denhalter be approved establishing compensation for the joint position of City Attorney/Agency Legal Counsel, establishing an automobile allowance, and canceling eligibility for the City's Management Pay Incentive Pay Program. DIRECTOR OF PLANNING SERVICES 1. STATUS REPORT ON NEW DEVELOPMENT APPLICATIONS (440.10) Written Communication: Report dated March 16, 1993, from the Planning Director, advising that four new development applications were received by the City since the last report of February 16, 1993. It was moved by Council Member Nash, seconded by Council Member Hausdorfer, and unanimously carried that the Report be received and filed. 2. APPEAL OF DESIGN REVIEW COMMISSION ACTION OF FEBRUARY 3, 1993 - MONUMENT SIGN, ARCHITECTURAL CONTROL 88-10 (FAMILY FITNESS CENTERS) (410.602 Written Communication: Report dated March 16, 1993, from the Planning Director, recommending that the Design Review Commission's denial of a proposed 60-square-foot, externally-illuminated, freeway monument sign be upheld. The denial is based on opinions by the Planning Commission and the Design Review Commission that these types of signs are visually obtrusive, are not consistent with the goals and objectives of the General Plan in preserving the rural character of the City, and that adequate signage exists for the health club at this location. The applicant's appeal is based on the need for better identification of the health club facility because of its location in an industrial center. Mr. Tomlinson made an oral presentation. William Barker of Image Media Group, the sign contractor, stated that the Design Review Commission held little or no discussion regarding the possible denial of this sign at their February 3, 1993, meeting, and he did not have time to speak on the matter. He further stated that he had never been advised by City staff that he had little chance of receiving approval for the sign, which had the consent of the landlord; that the $5,000 deposit required on this single sign application was excessively high; and, that he had not received notice of this meeting. Robert Dennis of Family Fitness Centers, 7521 Espera Street, Carlsbad, explained that the 16-foot, freeway-oriented sign that was previously approved had never been installed. Therefore, only one of the approved signs is in use at this time. He noted that another application for a freeway-oriented sign received preliminary approval by City staff. However, through an error the wording on the sign was changed to "Family Fitness Center" instead of"Capistrano Business Center,"with Family Fitness Center City Council Minutes -5- 3/16/93
