SUBJECT: Consideration of License Agreement Between the City of San Juan Capistrano and
Capistrano Valley Bobby Sox for Use of the Concession Stand at the Cook Park
Cordova Athletic Fields
RECOMMENDATION:
By motion,approve the License Agreement between the City of San Juan Capistrano and Capistrano
Valley Bobby Sox for use of the concession stand at the Cook Park Cordova athletic fields for the
period of March 1, 1998, to February 28, 1999.
SITUATION:
On September 16, 1991, Capistrano Valley Bobby Sox submitted a request(Attachment A) to the
City of San Juan Capistrano to construct a snack bar at the Cook Park Cordova athletic fields. After
evaluating the construction process and cost of building a snack bar, City staff and the Bobby Sox
organization decided that converting one(1)of the existing storage closets attached to the permanent
restrooms was a better alternative for the concession stand.
The Capistrano Valley Bobby Sox had received donated materials and services to convert the storage
closet into a concession stand,which also met Health Department and the City's Building Division
requirements.
The organization has operated the stand effectively for the past six seasons. Proceeds are used to
defray program expenses and fund improvements to the fields.
With the license agreements that have been developed between the City of San Juan Capistrano, San
Juan Little League and AYSO Region 87,staff is recommending that the practice of concession stand
use be standardized; therefore, it is recommended that the attached license agreement between the
City and Capistrano Valley Bobby Sox for the use of the concession stand at Cook Park Cordova
athletic fields be considered by City Council.
Capistrano Valley Bobby Sox has been operating the concession stand during the fall months for their
Super Sox season and during the spring months for their primary season. AYSO, who also utilizes
the Cook Park Cordova fields,has no desire to operate the concession stand at this time; therefore,
the license agreement with Capistrano Valley Bobby Sox for the use of the concession stand is for
the period of March 1, 1998, through February 28, 1999. The agreement identifies regulations and
conditions of the concession stand use,which includes signs and advertisements,hours of operation,
food and beverage products,maintenance and cleanliness,equipment,vehicles,concessionaires,walk-
throughs, inspections and permits.

FINANCIAL CONSIDERATIONS:
In exchange for the use of the concession stand,the organization will assist with in-kind services for
general maintenance of athletic fields.Capistrano Valley Bobby Sox will retain all proceeds from the
operation of the concession stand.

ALTERNATE ACTIONS:
1. Approve the License Agreement between the City of San Juan Capistrano and Capistrano
Valley Bobby Sox for use of the concession stand at the Cook Park Cordova athletic fields.
2. Approve the License Agreement between the City of San Juan Capistrano and Capistrano
Valley Bobby Sox for use of the concession stand at the Cook Park Cordova athletic fields,
with modifications.
3. Do not approve the License Agreement between the City of San Juan Capistrano and
Capistrano Valley Bobby Sox for use of the concession stand at the Cook Park Cordova
athletic fields.
4. Continue this item, and request additional information from staff.

We would like to request a waiver of permit fees for the construction
of a new Snack Bar at Cook Park for fields 1 and 2. It is my under-
standing prior to submitting Plans & Blueprints we need to receive this
waiver through your offices.
We are the only program of Girls Fast-Pitch Softball in the City, reach-
ing over 300 families in our community. We have been using the Cook
Park fields since their construction. Also, we have aided and maintained
the fields and facilities. We are an all volunteer organization. Our
Bobby Sox league is open to all girls in the San Juan Capistrano & Dana
Point area (ages 6 to 18 yrs.)
The Snack Bar will be used for Bobby Sox Softball from March 1 to Septem-
ber 1 and shared with AYSO during their soccer season (September to March) .
We are also in agreement to let the City of San Juan Capsitrano use this
facility for such events as they choose.
Capistraho Valley Bobby Sox will assume liability and carry insurance for
the facility.
