RECOMMENDATIONS: 1. Adopt a Resolution declaring the work completed as to plans and specifications for the Camino Capistrano and Del Obispo Street Stormwater Treatment Project (GIP 12502 and 16502) (Lucas Builders Inc.); and, 2. Direct the City Clerk to process recording of a Notice of Completion for the Project; and, 3. Authorize staff to release the Project retention 30 days after recordation of the Notice of Completion. EXECUTIVE SUMMARY : Construction work was recently completed for the Camino Capistrano and Del Obispo Street Stormwater Treatment Projects (GIP 12502 and 16502). The Projects consisted of the installation of bio-filtration units, storm drain pipeline, and replacement of concrete sidewalks on Camino Capistrano and Del Obispo Street as shown on the attached location map (Attachment 1). The work has been completed to the satisfaction of the Public Works and Utilities Director and is ready for acceptance and recordation of a Notice of Completion. Staff is recommending that the City Council adopt a resolution (Attachment 2) declaring the work completed in accordance with the approved plans and specifications, and directing the City Clerk to process recording of a Notice of Completion (Attachment 3). City Council Agenda Report January 15 , 2019 Page 2 of 3 DISCUSSION/ ANALYSIS : On March 6, 2018, the City Council awarded a construction contract for the Projects to Lucas Builders Inc. in the amount of $399,204. Two contract change orders were issued, totaling $32,533, to cover the cost of field changes and additional quantities of concrete. The final construction contract cost was $431 ,737. Payment of retention to the contractor in the amount of $21 ,586 will be made 30 days following recordation of the Notice of Completion, after which time claims against the City for payment to any unpaid labor or material suppliers will be barred. Additionally, a one-year warranty provided for in the construction contract will cover any construction deficiencies that become evident within the next year. Staff will continue to monitor the improvements throughout the one-year warranty period. FISCAL IMPACT: The construction accounting summary below shows the Projects' construction budget and expenditures, with an ending balance of $9, 187 that will be returned to the System Development Fund. ENVIRONMENTAL IMPACT: These Projects have been reviewed in accordance with the California Environmental Quality Act ("CEQA"). The City's Environmental Administrator determined that CIP 12502 and 16502 were categorically exempt from further environmental review under the Class 3 exemption for New Construction of Small Structures or Facilities (CEQA Guidelines 15303). A Notice of Exemption (NOE) was filed on March 30, 2018, with the County Clerk- Recorder's Office . No further environmental review is needed to declare the work completed. City Council Agenda Report January 15, 2019 Page 3 of 3 PRIOR CITY COUNCIL REVIEW: • On March 6, 2018, the City Council appropriated $126,204 for the Projects and awarded a construction contract to Lucas Builders Inc. (GIP 12502 and 16502) (Lucas Builders Inc.). • On September 5, 2017, the City Council took the following actions to augment funding for the Projects: o Unfunded the following Capital Improvement Projects, returning the funds to Systems Development Fund: Camino Capistrano Storm Drain between San Juan Creek Road and Ortega Highway (GIP 15501 ); Calle Arroyo and Sundance Drive Drainage Improvements (GIP 15503); and La Navia and La Ronda Drainage Improvements (GIP 15505); and, o Appropriated $247,000 from the Systems Development Fund for the Projects. • On April 3, 2012, the City Council approved an agreement with Caltrans whereby Caltrans contributed $112,000 toward the cost of a stormwater treatment system that the City would be obligated to design and construct near the 1-5 Freeway and Ortega Highway ramps. • On August 2, 2010, the City Council approved an agreement with Caltrans whereby Caltrans contributed $100,000 toward the cost of a stormwater treatment system that the City would be obligated to design and construct near the 1-5 Freeway and Camino Capistrano ramps. (GIP 12502 and 16502) WHEREAS, on the 6th day of March 2018, the City of San Juan Capistrano entered into a contract with Lucas Builders, Inc. (510 E. Jaime Ave. La Habra, CA 90637) for Camino Capistrano and Del Obispo Street Stormwater Treatment Projects (GIP 12502 and 16502). WHEREAS, the Public Works and Utilities Director has evaluated the final quantities and cost figures and recommends approval.
