RECOMMENDED ACTION(S)
1. Approve and authorize execution of the Fifth Amendment to the Five -Year Agreement with the City of
San Juan Capistrano for law enforcement services for the period July 1, 2004 through June 30, 2005.
2. Approve the FY 2004-05 charges for law enforcement services to the City in an amount not to exceed
$5,331,979 for the period July 1, 2004 through June 30, 2005.
3. Delegate to the Sheriff -Coroner authority to execute, on behalf of the County of Orange, an
amendment of this Agreement to substitute the City's amended or new Traffic Violator Apprehension
Program (TVAP) resolution, as long as the amendment does not materially change any other provision of
this Agreement.
SUMMARY:
The Sheriff -Coroner requests approval of the Fifth Amendment to the Five -Year Agreement with the City
of San Juan Capistrano for law enforcement services for the period July 1, 2004 through June 30, 2005, in
an amount not to exceed $5,331,979.

The City of San Juan Capistrano has been contracting with the County for the Sheriff -Coroner to provide
law enforcement services since 1961. The current five-year agreement, covering the period of July 1,
2000 through June 30, 2005, was approved by the Board of Supervisors on August 1, 2000. The proposed
Fifth Amendment defines the service level and costs for FY 2004-05. Services for FY 2004-05 include
one lieutenant, four sergeants, 15 patrol units at 40 hours per week per unit, three motorcycle deputies,
three deputies for a community support unit, two investigators, two community services officers for
parking control, and regional support services. The total cost to the City is $5,331,979.
Contract costs include salaries, wages, benefits, services, supplies and transportation expenses, as well as
division, department and County General (CWCAP) overhead. FY 2004-05 costs are 0.53% higher
($28,273) than the current fiscal year cost of $5,303,706.
The Association of Orange County Deputy Sheriffs contract expires in October 2004, and there are
currently salary and benefit issues that remain to be resolved. Therefore, the proposed amendment
includes provisions that require the City to pay for the cost of any increase in compensation or benefits, or
to adjust the service level to stay within the maximum obligation of the agreement.
The FY 2004-05 budget for the Sheriff -Coroner Department, as presented to the Board of Supervisors,
includes appropriations and revenue for this contract.
The Sheriff -Coroner may request a revision to the Traffic Violator Apprehension Program (TVAP) to
include additional vehicle code section violations that would be subject to the TVAP administrative fee.
The amendment includes a provision authorizing the Sheriff -Coroner to amend the agreement to reflect
revisions to the TVAP.
