SUBJECT: Consideration of Amendment to the Law Enforcement Services Agreement
for Fiscal Year 2001/2002
RECOMMENDATION:
By motion, approve the Second Amendment to Agreement between the City of San Juan
Capistrano and the County of Orange for the provision of law enforcement services during
the 2001/2002 fiscal years, for the amount of $4,356,799.
SITUATION:
Since 1961 the City of San Juan Capistrano has been contracting with the County of
Orange for Sheriff -Coroner to provide law enforcement services. On July 5, 2000 council
approved a Five Year Service Agreement between the County and the City for the Sheriff
to provide contract law enforcement services.
The current contract includes, 1 Lieutenant, 5 Shift Sergeants and 1 Administrative
Sergeant (shared with the City of Dana Point), 2 Criminal Investigators, 20 Deputy Sheriffs
and 2 Parking Control Officers. The City also shares regional positions with other south
county cities for traffic accident investigation and supervision, investigation supervision and
general clerical support. Patrol scheduling consists of 1 Sergeant and 3 Deputy Sheriffs on
the midnight shift (2300 hrs. to 0700 hrs.), 1 Sergeant and 7 Deputy Sheriffs on day shift
(0630 hrs. to 1500 hrs.) and 1 Sergeant and 7 Deputy Sheriffs on swing shift (1500 hrs. to
2400 hrs.) and 3 Motorcycle Deputy Sheriffs. The two Parking Control Officers provide 7
days of uniform parking enforcement.
In this year's budget staff recommended the addition of (1) Sergeants position and (1)
Deputy's position. The Sergeants position is necessary after the City of Dana Point made
a decision to no longer share Sergeants with the City of San Juan Capistrano. To
adequately provide Supervisory coverage for three shifts and relief, a fourth Sergeant
position is necessary. The cost of the additional Sergeant position is $155,000. Also an
additional Deputy is requested to oversee the Red Light Camera Enforcement program.
This program requires a sworn officer to review citations daily and deal with violation
reviews. When the deputy is not addressing Red Light Camera issues, he/she will be
available for other law enforcement duties. The cost of this additional deputy position is
$139,000. This position is fully funded by revenue from the Red Signal Camera
Enforcement program.

Staff recommends the City Council approve the Second Amendment to the Five Year Law
Enforcement Service Agreement with the County of Orange, to add these positions to the
City's law enforcement compliment.

FINANCIAL CONSIDERATIONS:
The total cost of services is $4,356,799 and includes the addition of (1) Sergeant and (1)
Deputy position. This amount has been included in this years FY 2001/2002 budget. This
represents an increase of $449,722 over the previous agreement. This increase is due to
the addition of the two positions as noted above and to provide for negotiated cost
increases for salaries and benefits for law enforcement personal.
