1973-0102_BENNITT, JO_Agreement for Interim City Clerki AGREEMENT FOR INTERIM SERVICES AS CITY CLERK OF CITY OF SAN JUAN CAPISTRANO This Agreement is made as of January 2, 1973, by and between the CITY OF SAN JUAN CAPISTRANO, hereinafter called "City," and JOANNE BENNITT, hereinafter called "Clerk." WITNESSETH: WHEREAS, the City requires the immediate services of a City Clerk for an interim period pending recruitment of a qualified person to fill the said office on a permanent basis; and WHEREAS, Clerk is an experienced and qualified person who is capable of undertaking and performing the duties and responsi- bilities of the office of City Clerk of the City of San Juan Capistrano. NOW, THEREFORE, for and in consideration of the premises and the terms and conditions hereinafter set forth, City and Clerk agree as follows: 1. ASSUMPTION OF DUTIES: Clerk hereby agrees to provide City, as an independent contractor, all of the services which are, during the term of this contract, imposed by the statutes of the state of California upon City Clerks of General Law Cities, and which shall, without limita- tion, include the following: a) To develop agendas and prepare packets of supporting data for all regular and special meetings of the City Council; to attend all regular and special meetings of the City Council; and to record and prepare official minutes of said Council proceedings; b) To authenticate, preserve and maintain all legal documents and other official records for the benefit of the City Council, the City staff and the public; c) To maintain a records and information system that will ensure the availability of necessary data with maximum efficiency and minimal delay; 0 0 d) To conduct the 1974 municipal election, being responsible for all aspects thereof; e) To administer the business license ordinance; f) To publish legal notices, take affidavits and depositions, administer oaths or affirmations, and to interface with the public within the prerogatives of the City Clerk's responsibili- ties; g) To work cooperatively with the City Manager and all City departments to facilitate a smooth, harmonious and efficient disposition of the City's business; h) To process annexation proceedings, if any; and i) To perform such other functions as the City Council or the City Manager may prescribe. 2. TERM: The term of this Agreement shall commence on January 2, 1974, and extend through March 31, 1974, during which time Clerk shall, except as otherwise provided, perform the services, functions and assume the responsibilities of City Clerk on a full time basis. 3. COMPENSATION: City shall pay Clerk as follows: a) The sum of $1,400.00 per month for the basic services hereinabove set forth; b) The equivalent of ten cents ($0.10) per mile transportation expenses, not to exceed the sum of $200.00 per month; and c) Reimbursement for meals and lodging not to exceed Fifty Dollars ($50.00) per month to be paid only on such occasions when Council meetings extend beyond 10:30 P. M. 4. MISCELLANEOUS PROVISIONS: a) Clerk agrees to initiate and complete the preliminary matters, including bonding, oath, etc., which are required of City Clerks upon their assumption of office, and shall cooperate and coordinate all activities with the City Manager. -2- 0 0 b) Clerk shall, upon prior coordination with the City Manager, be permitted to attend to and pursue such testing and interviews as may be generated by her applications for permanent employment elsewhere. The absences occasioned by the foregoing shall, however, not incon- venience nor adversely affect the normal functions and operations of the office of City Clerk, and there shall be a proportionate adjustment in the basic contract price of $8.50 for each hour of said absence.
