SUBJECT: Consideration of Amendment to Stone Field Lease Agreement
(Capistrano Unified School District)
By motion, approve the amendment to the City's Lease Agreement with Capistrano
Unified School District for Stone Field to include the existing garage and bleacher
facilities; and, authorize the City Manager to execute the agreement.
City Council, on May 19, 1997, approved a lease agreement with the Capistrano
Unified School District for the property known as Stone Field. The 25 -year lease
provides for the field proper, and permitted the City to manage, maintain and improve
the facility as necessary to serve the recreation needs of the community.
At their September 4, 2001, meeting City Council approved the plans and specifications
for the Stone Field Renovation Project, a joint venture between the City and Mission
Hospital to upgrade the field. One new aspect of the field renovation was the inclusion
of restroom facilities for users of the park, Capistrano Unified School District approved
the use of an existing garage structure on school property adjacent to the field for the
restrooms, provided that some space in the structure be set aside for school district
office use.
Because the location of the restroom facility falls outside the current boundaries of the
City's lease agreement with the school district an amendment to the agreement is
necessary. Attached is an amendment to the Stone Field lease which amends the legal
description of the parcel to include the area on which the restroom will stand and the
parking lot and bleacher area adjoining the restroom location. The revised lease also
includes a provision to allow the school district to use a 15' x 24' space within the
restroom structure for their offices. All other aspects of the prior lease agreement have
been retained. CUSD representatives have reviewed and approved of the form of the
amendment and will take it before their board on February 25, 2002. Attached is a letter
verifying their review. Staff therefore recommends City Council approval and that the
City Manager be authorized to execute the revised lease agreement,
