13-0104_RBF CONSULTING_C2_Agenda Report 1/4/2013 0 C2 City of San Juan Capistrano Agen ort TO: Karen P. Brust, City >i/ari FROM: Keith Van Der Maaten, U ilities Directo Prepared by: Eric Bauman, Utilities Engine r- Af DATE: January 4, 2013 SUBJECT: Consideration of Approving a Personal Services Agreement for Construction Management Services for the 1-5 and Ortega Highway Interchange Pipeline Relocation Project. (Capital Improvement Project 11805) (RBF Consulting) RECOMMENDATION: By motion, approve a Personal Services Agreement with RBF Consulting in the amount of $157,291 for construction management services for the 1-5 and Ortega Highway interchange pipeline relocation project. EXECUTIVE SUMMARY: The 1-5 and Ortega Highway Interchange Pipeline Relocation Project will require the services of a construction manager to perform construction management services including specialty inspection services for welding and steel pipe installation, stand-by inspection services (if City staff is unavailable), documentation services for Caltrans reimbursement, alignment survey staking services, and archeological monitoring services. Staff recommends approving a Personal Services Agreement with RBF Consulting for construction management services in the amount of $157,291 (Attachment 1). DISCUSSION/ANALYSIS: Staff solicited proposals from RBF Consulting, Butier, Dudek, AECOM, Dexter-Wilson Engineers, MCK Associates LLC, Tetra Tech, Inc., Arcadis, Psomas, URS Corp., Anderson-Penna, and Hunsaker (Attachment 2). On November 13, 2012, proposals were received from Dudek, RBF Consulting, and Tetra Tech, Inc. Additionally, three firms sent written notice to the effect that they could not meet the staffing requirements of this project at this time (Anderson-Penna, Hunsaker, and Dexter-Wilson Engineers). The remaining firms solicited did not respond to the City's request. City Council Agenda Report January 4, 2013 Page 2 of 3 Staff reviewed and rated the proposals according to City Council Policy 112. The primary consideration was the firm's familiarity with managing construction projects for local utility companies affected by an active Caltrans roadway construction project. The second most important consideration was a familiarity with the Caltrans record keeping and documentation methods required for reimbursement by Caltrans. The following is a summary of the proposed fee from the three proposals that were received: Firm: Proposed Fee: RBF Consulting $187,291 Dudek $240,935 Tetra Tech, Inc. $252,319 The proposal from RBF Consulting includes $30,000 to manage the construction of an additional waterline in the Ortega Bridge that would be paid for by the Plaza Banderas Hotel (Hotel) to satisfy the fire flow requirements of the Hotel as required in the Development Agreement for the Hotel. The City is working with the Hotel on an agreement to pay for the cost to construct the Hotel pipeline plus the fair share costs of construction management, survey and design work, and staff time. As the City and Hotel currently do not have an agreement, the Personal Services Agreement has been reduced from $187,291 to $157,291 to reflect the removal of the project management costs of the Hotel pipeline work. Staff has discussed with RBF Consulting the removal of the project management work directly related to the aforementioned waterline and they are amenable to the removal of the work and the addition of the work at a later date should an agreement be reached with the Hotel. FISCAL IMPACT: The cost of the work by RBF Consulting is $157,291. This cost is included in the Fiscal Year 2012-2013 Capital Improvement Budget under CIP 11805 (1-5 and Ortega Highway interchange pipeline relocation project). ENVIRONMENTAL IMPACT: Not applicable. PRIOR CITY COUNCIL REVIEW: • On August 7, 2012, the City Council approved the plans and specifications prepared for the 1-5 and Ortega Highway Interchange Pipeline Relocation Project for bid; and, authorized staff to proceed with negotiations with the owners of the Plaza Banderas Hotel. City Council Agenda Report January 4, 2013 Page 3 of 3 COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: • On July 17, 2012, the Utilities Commission recommended the City Council authorize the project for bid, authorize staff to proceed with negotiations with the owners of the Plaza Banderas Hotel, and recommended option three (heightened awareness) with regard to the closure of the waterline due to the north bound off- ramp construction. • The Utilities Commission will be updated at its January 15, 2013, regular meeting on the selection of construction management services.
