A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
— CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN
AMENDMENT AND LAND USE CODE AMENDMENT STUDY TO
CORRECT INCONSISTENCIES BETWEEN THE CITY'S HISTORIC
TOWN CENTER MASTER PLAN, HISTORIC TOWN CENTER
FORM BASED CODE AND GENERAL PLAN AND MAKING
A DETERMINATION PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH
WHEREAS, Municipal Code Section 9-2.307 requires that the City Council
initiate consideration of all General Plan Amendments by the approval of a
resolution to initiate a General Plan Amendment Study; and
WHEREAS, Municipal Code Section 9-2.309 requires that the City Council
initiate consideration of all Land Use Code Amendment Studies; and
WHEREAS, on February 9, 2016, the Planning Commission recommended
that the City Council initiate a General Plan Amendment and a Land Use Code
Amendment to correct various inconsistencies between the Historic Town Center
Master Plan, Historic Town Center Form Based Code and General Plan identified
by a Planning Commission Ad-hoc committee, except for issues related to the
Esslinger Building and Judge Egan House; and
WHEREAS, on March 8, 2016, the Planning Commission Committee of the
Whole recommended to the City Council that further refinement of height and
setback standards for protection of the Esslinger Building and Judge Egan House,
as well as other historic structures in the Historic Town Center, be included in the
General Plan and Land Use Code Amendments recommended by the Planning
Commission on February 9, 2016; and
WHEREAS, on October 24, 2017, the City Council directed staff to provide
a report on the City's Historic Town Center Master Plan and identify options to
address inconsistencies between the Historic Town Center Master Plan and the
City's General Plan; and
WHEREAS, on November 7, 2017, the City Council directed staff to return
at a future meeting with a recommendation to initiate a combined General Plan
and Land Use Code Amendment to correct the inconsistencies and ambiguities
between the Historic Town Center Master Plan, Historic Town Center Form Based
Code and General Plan; and
WHEREAS, Staff recommends that the City Council initiate a General Plan
Amendment and Land Use Code Amendment study to correct specific
inconsistencies identified between the Historic Town Center Master Plan, Historic
Town Center Form Based Code and General Plan.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council finds and determines that the proposed
initiation of a General Plan Amendment and Land Used Code Amendment Study
to correct various inconsistencies between the Historic Town Center Master Plan,
Historic Town Center Form Based Code and General Plan is statutorily exempt
from the requirements of the California Environmental Quality Act (CEQA)
pursuant to CEQA Guidelines Section 15262 because this is a planning study and
not a commitment to adopt a General Plan Amendment, Land Use Code
Amendment or any specific project entitlements.
Section 2. The City Council hereby initiates a General Plan Amendment
and Land Use Code Amendment Study to correct various inconsistencies between
the Historic Town Center Master Plan, Historic Town Center Form Based Code
and General Plan, and refers the matter to staff for analysis and to the Planning
Commission for a recommendation.
