SUBJECT: Resolution for Notice of Completion and Acceptance of the Work for
Construction of the Riding Park Water and Sanitary Sewer Pipelines
Project (Rich Construction Inc.) (CIP 17201)
RECOMMENDATION :
1. Adopt a resolution declaring the work for construction of the Riding Park Water and
Sanitary Sewer Pipelines Project complete, accepted, and approved; and,
2. Direct the City Clerk to process recording of a Notice of Completion for the Project.
DISCUSSION/ANALYSIS:
On October 17, 2017, the City Council approved a Construction Agreement with Rich
Construction Inc. for construction of the Riding Park Water and Sanitary Sewer Pipelines
Project (CIP 17201 ). Staff performed construction inspection, including pressure testing
of the water pipelines and video inspection of the sanitary sewer pipeline, and concluded
that the project was constructed in accordance with the contract documents. The project
is operational to the satisfaction of the Public Works and Utilities Director and is ready for
acceptance. Accordingly, it is recommended that the City Council direct the City Clerk to
process and record a Notice of Completion (Attachment 1) and adopt a resolution
(Attachment 2) declaring the work for construction of the Riding Park Water and Sanitary
Sewer Pipelines Project complete, accepted, and approved.

FISCAL IMPACT:
The Project budget was $1,070,200, which included $977,900 from the Agricultural
Preservation Fund and $92,300 from the Eastern Open Space Fund. Construction was
completed at a total cost of approximately $686,000. Other project costs (including
environmental studies, design, surveying, archeological, paleontological, biological, and
Native American monitoring, stormwater planning and permitting, and staff time to
administer the contract and provide construction inspection services) total is
approximately $364,000, resulting in a total construction cost of approximately
$1,050,000. The approximately $20,000 of unspent funds will be restored to the Eastern
Open Space Fund.
ENVIRONMENTAL IMPACT :
The present action of declaring the work to be completed for the Project is not subject to
CEQA pursuant to Section 15060(c)(3) of CEQA Guidelines because the action is not a
project as defined in Section 15378 of the CEQA Guidelines, and the action has no
potential for resulting in physical change to the environment, directly or indirectly.
PRIOR CITY COUNCIL REVIEW:
• On October 17, 2017, the City Council approved and authorized the City Manager to
execute a Construction Agreement with Rich Construction Inc. for construction of the
Riding Park Water and Sanitary Sewer Pipelines Project.
• On February 6, 2018, the City Council authorized the City Manager to approve change
orders to the construction contract for the Project for a total contract increase amount
not to exceed $138,842, and, approved and authorized the City Manager to execute
Amendment 1 to the environmental monitoring Professional Services Agreement for
the Project, increasing the not-to-exceed compensation amount to $67,040.
COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS:
• On October 17, 2017, the Utilities Commission considered a staff recommendation
that the Commission recommend that the City Council approve and authorize the City
Manager to execute a Construction Agreement with Rich Construction Inc. for
construction of the Riding Park Water and Sanitary Sewer Pipelines Project. At that
time, the Commission tabled the item. Subsequently, on the same date, the City
Council considered and acted on the item as noted in the section above.
3. On April 17, 2018, the Utilities Commission recommended that the City Council adopt
a resolution declaring the work for construction of the Riding Park Water and Sanitary
Sewer Pipelines Project complete, accepted, and approved, and directed the City
Clerk to process recording of a Notice of Completion for the Project.

NOTICE OF COMPLETION
NOTICE IS HEREBY GIVEN that a contract was heretofore awarded by the City of San Juan
Capistrano to Rich Construction Inc. for construction of the Riding Park Water and Sanitary Sewer
Pipelines Project;
That said work was completed on April13, 2018 by said company according to the satisfaction of
the City Engineer of the City of San Juan Capistrano, and that said work was accepted by the City
Council of the City of San Juan Capistrano, as the owner, 32400 Paseo Adelanto, San Juan
Capistrano, California 92675, at a regular meeting thereof held on the 1st day of May 2018, by
Resolution No. 18-05-01-_.
That upon said contract, the Indemnity Company of California was the surety for the bonds given by
said company as required by law.

RESOLUTION NO. 18-05-01-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DECLARING WORK COMPLETED FOR
THE RIDING PARK WATER AND SANITARY SEWER PIPELINES
PROJECT (CIP 17201 ).
WHEREAS, On October 17, 2017, the City of San Juan Capistrano
entered into a construction contract with Rich Construction Inc. for construction of the
Riding Park Water and Sanitary Sewer Pipelines Project; and,
WHEREAS, the Public Works and Utilities Director has evaluated the final
quantities and cost figures and recommends approval of the costs; and
WHEREAS, the Public Works and Utilities Director has evaluated the work
and deemed that it has been completed in accordance with the plans and specifications
and recommends approval and acceptance of the work.
NOW, THEREFORE, BE IT RESOLVED, by the City of San Juan
Capistrano as follows:
SECTION 1. The work required to be performed by said contractors has been
completed.
SECTION 2 . The total cost of said construction work is in the amount of $686,000 .
SECTION 3. The work is hereby accepted and approved .
SECTION 4. The City Clerk is directed to forthwith forward a "Notice of Completion" to
the County Recorder of the County of Orange for recording.
