LAND USE ADJUSTMENT 99-01
A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN
CAPISTRANO CONFIRMING ISSUANCE OF A CATEGORICAL EXEMPTION AND
APPROVING A LAND USE ADJUSTMENT TO A FRONT YARD SETBACK STANDARD
FOR A LOT LOCATED AT 30702 HILL TOP WAY, LOT 9, TRACT 3090. (EIDELSTEIN).
Whereas, the applicant, Alex Eidelstein, 2963 1 Ivy Glenn, Laguna Niguel, CA, has
submitted an application for a Land Use Adjustment to allow a twenty-seven foot (27’) front yard
setback in the Small Farm (RA) zone district where the Code requires a minimum of thirty feet (30’)
on a lot located at 30702 Hill Top Way, Lot 9, Tract 30702; and,
Whereas. the proposed project has been processed pursuant to Section 9-2.405,
Zoning Administrator procedures of the Land Use Code; and,
Whereas. the Environmental Administrator has reviewed the proJect pursuant to
Section 15061 of the California Environmental Quality Act (CEQA) and issued a categorical
exemption and caused a Notice of Exemption to be posted pursuant to the City’s Environmental
Review Guidelines, and has otherwise complied with all applicable provisions of the California
Environmental Quality Act (CEQA) ; and,
Whereas, the Zoning Administrator conducted a duly noticed public hearing on
February 24, 1999 pursuant to Section 9-2.3 13 of the lMunicipa1 Code to consider public testimony
on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the
City of San Juan Capistrano does hereby make the following findings:
1. The proposed adjustment would not be injurious to, or adversely affect any
adjoining property in that the front of the house will be more than 30-feet from the
edge of the street and will provide for adequate separation. The goals of the Small
Farm zoning district for providing an open appearance from the street will be
satisfied by this proposal.
2. The proposed adjustment is the most practical solution to he project m that it
accomplishes the intent and purpose of the Land Use Code by keeping the adjustment
to within 10% of the dimensional standard and is consistent with other variances
granted in the vicinity. The project complies with all other standards of the Zoning
Code, including the hillside grading regulations.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning
Administrator of the City of San Juan Capistrano does hereby approve the issuance of Land Use
Adjustment 99-01, SubJect to the following condmon:
1. The plans submitted for permit issuance shall be in conformance with the project plans
entitled “Architectural Site Plan, Lot 9, Tract 9030, Erdelstein Residence” dated l-26-99 and
submitted with this application.
EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become
final fifteen (15) days following Zoning Administrator action, and becomes effective beginning
March 12, 1999.
