ZA Resolution-99-12-22-01ZA RESOLUTION NO. 99-12-22-1 LAND USE ADJUSTMENT 99-04 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO CONFIRMING ISSUANCE OF CATEGORICAL EXEMPTION AND APPROVlNG A ONE FOOT (1’) ENCROACHMENT INTO A TEN FOOT (10’) SIDE YARD FOR AN OVERHEAD PATIO STRUCTURE (PALAPA) ON A SINGLE FAMILY LOT LOCATED AT 28372 CAMINO LA RONDA. (BEEMAN) Whereas, Brian Beeman, 28372 Camino La Ronda has requested approval of Land Use Adjustment 99-04 to allow the approval of an as-built overhead patio structure to encroach one foot (I’) into a ten foot (IO’) side yard, on property located at 28372 Camino La Ronda which is General Plandesignated 1.3, medium low density, 3.5 dwelling units/acre and classified as PC, Planned Community District on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2 301. Development Review of the Land Use Code, and, - Whereas, the Environmental Admrntstrator has reviewed the project pursuant to Section 15081 of the Californra Environmental Quality Act (CEQA) and issued a Class 5 categorical exemption and caused a Notice of Exemptron to be posted pursuant to Section 15062 of the CEQA Guidelines and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA), and, Whereas, the Zoning Administrator has consrdered the Environmental Review Board’s determrnatron pursuant to Section 15074 of the Callfornla Envrronmental Quality Act (CEQA), and, Whereas, the Zoning Admlnlstrator duly noticed pubic meeting on December 22. 1999 pursuant to Section 9-2 313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano does hereby make the following findings. 1 The proposed project IS consistent with the policies and objectives of the San Juan Capistrano General Plan In that it does not violate any of the General Plan Polrcles; and, 2 The proposed project complies with all applicable provlsrons of the Land Use Code, specifically conforming to the requirement that Land Use Adjustments not exceed 10% of the required standard. PC Resolution 99-l 2-22-l 2 December 22, 1999 - - NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano does hereby confirm Issuance of a categorical exemption. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application The appeal period shall expire at 12:00 AM, Thursday, January 6, 2000. This project approval shall be valid for a period of 2 years from the date of approval of this resolution, and shall expire on December 22, 2002. A time extension request or subsequent permit applications related to this discretionary approval must be submitted to the City prior to that date.
