ZA Resolution-01-11-07-01ZA RESOLUTION NO. 01 -1 1-07-01 CONDITIONAL USE PERMIT 01 -1 0 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO APPROVING CONDITIONAL USE PERMIT (CUP 01 -10) TO ALLOW OUTDOOR LIGHTING FOR AN EXISTING TENNIS COURT FOR AN EXISTING SINGLE-FAMILY RESIDENCE LOCATED AT 27731 ROLLING WOOD LANE AND MORE PRECISELY REFERRED AS ASSESSORS PARCEL NUMBER 650-371-02. (PARR) Whereas, Mr. James W. Parr at 27731 Rolling Wood Lane, San Juan Capistrano, 92675, has requested approval of outdoor lighting for an existing tennis court, to an existing Single- Family residence which is General Plan designated as (VLD) Very Low Density Residential and classified as (EL) Large Estate on the Official Zoning Map; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA), issued a Class 1 categorical exemption. Class 1 exemption includes minor modifications of existing structures or facilities, and caused a Notice to be posted pursuant to Section 15062 of the CEQA Guidelines; and, Whereas, the Zoning Administrator has conducted a duly-noticed public meeting on July 25,2001 pursuant to the provisions of Administrative Policy 409, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comment; and, NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano does hereby make the following findings: 1. The Municipal Code requires that setbacks be measured from property lines, or the edge of any private or public easement. The applicant has an existing tennis court that is consistent with all required rear, side and front yard requirements as well as the location to the nearest dwelling on an adjacent lot. 2. The applicant has proposed eight, eighteen foot tall fixtures, fitted with 1,000 watt metal halide lamps. The proposed lighting (fixture and pole) will comply with all the required standards. Additionally, the lights will have shield optical chambers that will be strategically oriented in order to reduce any possible light spillage behind the fixtures and anywhere else other than the tennis court area. The photometric study supplied by the applicant indicate a maximum reading outside of the tennis court fencing of 0.4 footcandles ten feet from the side edge of the tennis court, at thirty feet this value drops to 0.1 footcandles, the study also indicate a reading of 0.0 footcandles at a distance of ten feet from the ends of the tennis Court. 3. The tennis court as conditioned, will have minimum impacts to the surrounding neighborhoods because the tennis court is well contained within the 1.9 acre lot and situated at the lower part of the lot and enclosed by a six foot high retaining wall. Additionally, there is an existing six (6'-0") foot high retaining wall that surrounds the tennis court and a ten (10'-0") foot high green vinyl coated chain link fence which create a buffer between the properties and the adjacent lots that surround it. ZA Resolution 01-1 1-07-01 2 November 7.2001 4. The applicant has not indicated any limitations regarding the hours of operation of the tennis court as well as the use of the lights. The use and lighting of sports courts have impacts that relate to noise, resulting from extended hours of play time. Therefore, in order to minimize impacts on adjacent properties, staff recommends a condition requiring that tennis/sDorts courts not be used after 9:00 D.m. on weekdays and 1O:OO D.m. on weekends, nor before 8:OO a.m. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano hereby approves the project subject to the following conditions of approval: Conditions of APProval 1. The applicant has not indicated any limitations regarding the hours of operation of the tennislsport court as well as the use of the lights. The use and lighting of sports courts have impacts that relate to noise, resulting from extended hours of play time. Therefore, in order to minimize potential impacts on adjacent properties, staff recommends a that the tennis/sports court should not be used after 9:00 p.m. on weekdays and 1O:OO p.m. on weekends, nor before 8:OO a.m. 2. The proposed lighting fixtures shall have shielded optical chambers strategically oriented in order to reduce any possible light spillage behind the fixtures and anywhere else other than the tennis/sports court and the walkway area. 3. Tennis/sports court lighting shall not be used until all landscaping has been installed. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire at 500 p.m., November 22,2001. Pursuant to Section 9-2.303 (q), the conditional use permit must be established on or before November 22, 2002, otherwise, this approval shall become null and void.
