A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN
CAPISTRANO APPROVING AN ARCHITECTURAL CONTROL MODIFICATION FOR AN
EXISTING SITE LOCATED AT 31522 CAMINO CAPISTRANO AND MORE PRECISELY
REFERRED TO AS ASSESSORS PARCEL NUMBER 124-180-06 (MONSIGNOR PAUL
MARTIN FAITH AND EDUCATION CENTER, MISSION SAN JUAN CAPISTRANO)
Whereas, Mission San Juan Capistrano (Diocese of Orange, MIssIon San Juan
Capistrano, % Gerald Miller, Mission Admlnlstrator, 31522 Camlno Capistrano, San Juan Capistrano, California
92675) has requested approval of architectural control modification to construct a 1,600 square
foot building addition to the previously approved Monsignor Paul Martin Faith & Education
Center and the proposed building addition would increase the total approved building floor area
from 18,900 gross square feet (GSF) to 20,500 GSF and would provide a multi-purpose meeting
room with accessory Storage and Office (Glenn Gellatly, Project Architect; Bissell Architects, 446 Old
Newport Boulevard, Newport Beach, CA 92663); and,
Whereas, the proposed project has been processed pursuant to Section g-2.301,
Development Review of the Land Use Code; and,
Whereas, the Environmental Administrator reviewed the project on August 14,
2001 pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and issued
a Mitigated Negative Declaration and posted the same pursuant to Section 15062 of the CEQA
Guidelines, and has otherwise complied with all applicable provisions of the California
Environmental Quality Act (CEQA); and,
Whereas, the Design Review Committee (DRC) considered the project at a
worksession conducted on August 22,200l and commented favorably on the proposed project
design with respect to compliance with the City’s Architectural Design Guidelines (ADG); and,
Whereas, the Zoning Administrator has considered the Environmental
Administrator’s determination pursuant to Section 15074 of the California Environmental Quality
Act (CEQA), and conducted a duly noticed public meeting on September 12, 2001 to consider
public testimony on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City
of San Juan Capistrano does hereby make the following findings:
1. The proposed project is consistent with the policies and objectives of the San Juan
Capistrano General Plan, specifically, the Community Design Element because the
project incorporates features consistent with the design objectives of the Mission District;
and,

2. The proposed project is consistent with the General Plan Cultural Resources Element
because the project will result in development compatible with protection and
preservation of a historically-significant structure listed on the National Register of
Historic Places as well as the City’s Inventory of Historic & Cultural Landmarks (IHCL);
and,
2. The proposed project complies with all applicable provisions of the Land Use Code
subject to the mitigation measures and conditions of approval contained in this
resolution.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning
Administrator of the City of San Juan Capistrano hereby approves a Modification to Architectural
Control (AC) 98-06 subject to the following mitigation measures and conditions of approval:
Mitrqation measures
1. Prior to issuance of a grading permit, the applicant shall retain the services of a SOPA
(Society of Professional Archeologists)-certified archeologist who will monitor all grading
and excavation for potential impacts on cultural resources including archeological,
paleontological, and historic resources. The applicant shall provide an executed contract
for services with a SOPA-certified archeologist including a scope-of-work which provides
for comprehensive monitoring; a contingency for assessment, recovery, and/or
evaluation; and the preparation of a technical memoranda or report. In the event cultural
resources are encountered during grading, the monitor may cease grading operations,
consistent with City Council policy, to allow for the identification, assessment, and
preservation or recovery of any significant cultural resources.
Planninq Department Conditions of Approval
2. Proposed building permit site and architectural plans shall substantially comply in all
material aspects with the Planning Commission-approved site and architectural plans
(approve December 10, 1998 and prepared by Bissell Architects) subject to review by
the Planning Director or his designee. Alternate “A” shall be the approved west elevation
for the Parish Center building and the buildings permit plans shall be consistent with the
alternate design.

3. Compliance. The project shall be developed in full compliance with the City of San Juan
Capistrano Municipal Code, except as authorized by the City Council and/or Planning
Commission. The attention of the Developer and his Engineer is directed to Section 9-
2.3 of the Municipal Code (Engr.).
4. Pav Fees. The applicant shall fulfill all applrcable fee requirements in accordance with
the City Municipal Code, Section 9-2.316 and post securities to insure satisfaction
performance (Engr.).

5 Soils/Geolosv Report. The applicant shall submit to the City Engineer and Building
Official for their review and obtain approval for a Soils ReporUGeotechnical Feasibility
Study prepared by a Registered Geologist and/or Soil Engineer to determine the seismic
safety and soils stability of all proposed grading and development improvements within
the project and preliminary pavement sections and substructure bedding/backfill
recommendations (Engr.).
6. Site/ Gradino Plans. The applicant shall submit to the City Engineer and Building and
Safety Manager for their review and obtain approval for Site/Grading Plans prepared by
a Registered Civil Engineer. These plans shall show the limits of grading, drainage,
sewer, water and all related improvements. The extent of the topography shall be
extended enough to determine the drainage impacts to adjacent properties. The
elevations shall correspond with the Orange County benchmark datum. All drainage
must be conveyed to the street or a City approved drainage facility (Engr.).
7. Erosion and construction debris. The applicant shall submit to the City Engineer and
Building and Safety Manager for their review and obtain approval for Erosion/Silt Control
Plans prepared by a Registered Civil Engineer. These plans shall identify structural and
non-structural Best Management Practices (BMP’s) that will be used on-site to control
predictable pollutant runoff, shall show all temporary and/or permanent erosion/silt
control devices and proper precautions to prevent public trespass onto certain areas
where impounded water and construction debris may create a hazardous condition
(Engr.).
8. Improvements. Complete all Improvements to the City’s Satisfaction. Prior to issuance
of Certificate of Occupancy, the applicant shall complete, to the satisfaction of the City
Engineer, all construction improvements necessary to serve the development and
properly discharge the project’s runoff in accordance with the approved plan and
approved exceptions (Engr.).
EFFECTIVE DATE & FINAL ACTION: This project approval shall become
effective and final following expiration of the fifteen (15) day appeal period without filing of an
appeal application. The appeal period shall expire at 5:00 p.m., Thursday, September 27,200l.
PASSED, APPROVED AND ADOPTED this 12th day of September, 2001.
