SITUATION
This item was continued by the City Council on November 6, 1990, as requested by the
applicant to allow time for the contractor to remove stockpiled excavation from the rear
of the applicant's property. Since the stockpile has been removed to the satisfaction of
the applicant, the item is ready for reconsideration.
In accordance with a March, 1986 agreement, between the City and Barwick Datsun
Agency, a bond was posted to guarantee construction of improvements along their
property frontage in conjunction with the adjacent site (San Juan Dodge) development.
In March, 1987, a Reimbursement Agreement between the City and Chrysler Realty
Corporation was executed for the costs of constructing improvements north of the San
Juan Dodge (AC 83-8) site to Avenida Aeropuerto. Concurrently, the City CRA approved
Resolution No. CRA 87-3-17-1 authorizing reimbursement to the City for those costs.
To facilitate these abutting street improvements, Chrysler Realty Corporation agreed to
perform the work along the frontage of: Barwick Imports (formerly Barwick Datsun
Agency), San Juan Dodge and north to Avenida Aeropuerto.
Although a few issues remain with respect to the improvements north of Barwick Imports
to Avenida Aeropuerto, those improvements south of San Juan Dodge have been
completed to the satisfaction of the City Engineer. Therefore, it is recommended that
the City Council accept the improvements fronting Barwick Imports, exonerate the
Faithful Performance Bond, and authorize Staff to release the 10 percent retention
($10,930) for this portion of the improvements, 35 days after recordation of the Notice of
Completion.
