ZA Resolution-03-05-14-01ZA RESOLUTION NO. 03-05-14-01 DEVELOPMENT STANDARD ADJUSTMENT 03-01 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO APPROVING A 36'-0" FOOT HIGH ROOF LINE FOR A TWO STORY SINGLE FAMILY RESIDENTIAL UNIT, WHERE THE MUNICIPAL CODE ALLOWS A MAXIMUM OF 35'10'' FOOT HIGH. THE PROPOSED PROJECT SITE WILL BE LOCATEDAT61601 PEPPERTREE BEND AND MORE PRECISELY REFERREDTO AS ASSESSORS PARCEL NUMBER 649-331 -09 (CANCELLIERI). Whereas, applicant Mr. & Mrs Lawrence Cancellieri have requested approval of a Development Standard Adjustment to allow the construction of a new two story single family residence at 31601 Peppertree Bend, which will have a maximum height of 36'-0" feet, which will exceed the maximum height of 35'-0'' feet as allowed by Code. The proposed project will be located at 31601 Peppertree Bend, which is General Plan- designated as Very Low Density (0 to 1 DU/Acre) and classified as RSE 40,000- Residential Single Family on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, General Review Procedures of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA), and issued a Class 3(a) Categorical Exemption, "New Construction or Conversion of small structures"and has caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA); and, u Whereas, the Zoning Administrator conducted a duly-noticed public hearing on May 14, 2003 pursuant to Section 9-2.335 of the Municipal Code, City Council Policy 5, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comments. NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan. 2. The proposed project complies with all applicable provisions of the Land Use Code. ZA Resolution 03-0514-01 2 May 14,2003 - NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning Administrator hereby confirms issuance of a categorical exemption and approves the project subject to the following conditions of approval: 1. The building permit plans shall be in substantial conformance with the preliminary plans submitted with the Development Standards Adjustment application subject to review and approval by the Zoning Administrator. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (1 5) day appeal period without filing of an appeal application pursuant to Section 9-2.31 1 of Title 9, Land Use Code. The fifteen (1 5) day appeal period shall expire at 500 p.m. on Thursday, May 29,2003. This project approval shall be valid for a period of two years from the date of approval of this resolution, and shall expire May 14,2005 unless a time extension request has been submitted to the City prior to the approval expiration date.
