PC Resolution-15-06-09-01PC RESOLUTION NO. 15-6-09-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA APPROVING AN UPDATE TO THE PLANNING COMMISSION'S BYLAWS. Whereas, the Planning Commission has conducted a thorough review of its Bylaws and identified appropriate revisions to clarify the provisions and assure consistency with Commission practice and City Council policy; and, Whereas, the Environmental Administrator has determined that the project is exempt from review under the "general rule" that "CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA" (Section 15061 (b)(3) of the CEQA Guidelines), and will cause the Notice of Exemption to be posted pursuant to Section 15061 (d) of the CEQA Guidelines which provides that "the notice shall not be filed with OPR or the county clerk until the project has been approved;" and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 1507 4 of the California Environmental Quality Act (CEQA), has considered all project environmental documentation and technical studies; and, Whereas, the Planning Commission conducted duly-noticed public meetings on May 12, 2015, May 26, 2015 and June 9, 2015 pursuant to Title 9, Land Use Code, Section 9-2.302, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 510. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the Updated Planning Commission Bylaws.
