BACKGROUND
•November 2010 - City Council approves reduced
project entitlements, Vesting Tentative Tract Map,
and Development Agreement with 6-year term and
automatic 4-year extension provision.
• June 2011 - Voters approve “Measure B” upholding
City Council’s 2010 reduced project approval.
•December, 2016 – After 5 years, Applicant receives
final approval from State Regional Water Quality
Board for landfill closure plan.

•April 20, 2017, City confirms there was a “Force
Majeure” delay caused by the referendum, making
the expiration date of the DA, June 7, 2017.

DEVELOPMENT AGREEMENT SUMMARY
•Establishes Validity of Project Entitlements and related
Project EIR .
• Requires Developer compliance with San Diego Regional
Water Quality Control Board-approved Remedial Action
Plan for Landfill Closure.
•Requires on-site trail dedication and trail-head staging
improvements for public use.
•Requires various off-site traffic improvements and/or fair
share payments for improvements around project site.

•Requires Developer to extend recycled water line to project
with over-sizing to accommodate future city needs.
•Requires dedication of a water run-off reservoir (size to be
determined).
•Requires dedication of 26 affordable housing units (4 more
units than required by code).
•Requires City Council approval of Project Phasing Plan
•Allows refinements via an “Operating Memoranda”

•Project would still move forward as entitlements
would remain in place because Vested Tentative Tract
Maps remain valid through June 2019.

PLANNING COMMISSION RECCOMENDATION
On April 25, 2017, the PC recommended that
the City Council:
•Grant a one-time 4-year extension, as
intended in the original DA’s RDA language
provision.
•Find that said DA amendment is consistent
with the previously certified Project EIR .
