Adopt a resolution declaring the work for construction of the Well Facility Equipment Replacement Project complete, accepted, and approved; and, 2. Direct the City Clerk to process recording of a Notice of Completion for the Project. DISCUSSION/ANALYSIS: On May 16, 2017, the City Council approved Construction Agreements with Layne Christensen Company and Industrial Power and Automation for construction of the Well Facility and Equipment Replacement Project (CIP 17807). Staff performed construction inspection, including start-up and testing of the replacement equipment, and concluded that the project was constructed in accordance with the contract documents. The project is operational to the satisfaction of the Public Works and Utilities Director and is ready for acceptance . Accordingly, staff recommends that City Council direct the City Clerk to process and record a Notice of Completion (Attachment 1) and adopt a resolution (Attachment 2) declaring the work for construction of the Well Facility Equipment Replacement Project complete, accepted, and approved. City Council Agenda Report December 5, 2017 Page 2 of 2 FISCAL IMPACT: The Project budget was $140,000, which included $100,000 from the Water Capital Replacement Fund and $40,000 from the Non-Potable Water Capital Improvement Fund. The Project was completed at a total cost of approximately $124,000, which leaves approximately $16,000 that will be returned to the Water Capital Replacement Fund and the Non-Potable Water Capital Improvement Fund in proportion to the original appropriations from those funds. ENVIRONMENTAL IMPACT The present action of declaring the work to be completed for the Project is not subject to CEQA pursuant to Section 15060(c)(3) of CEQA Guidelines because the action is not a project as defined in Section 15378 of the CEQA Guidelines, and the action has no potential for resulting in physical change to the environment, directly or indirectly. Prior to construction, the Project was determined to be Categorically Exempt, and on May 3, 2017, a Notice of Exemption for the Project was filed with the County Clerk. PRIOR CITY COUNCIL REVIEW On May 16, 2017, the City Council approved construction contracts with Layne Christensen Company and Industrial Power & Automation for the Well Rehabilitation and Equipment Replacement Project. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: On May 16, 2017, the Utilities Commission recommended that the City Council approve construction contracts with Layne Christensen Company and Industrial Power & Automation for the Well Rehabilitation and Equipment Replacement Project. That upon said contract, the Travelers Casualty and Surety Company of America was the surety for the bonds given by said company as required by law. WHEREAS, On May 16 , 2017, the City of San Juan Capistrano entered into construction contracts with Layne Christensen Company and Industrial Power and Automation for construction of the Well Facility Equipment Replacement Project; and, WHEREAS, the Public Works and Utilities Director has evaluated the final quantities and cost figures and recommends approval of the costs; and WHEREAS, the Public Works and Utilities Director has evaluated the work and deemed that it has been completed in accordance with the plans and specifications and recommends approval and acceptance of the work. NOW, THEREFORE, BE IT RESOLVED, by the City of San Juan Capistrano as follows: SECTION 1. The work required to be performed by said contractors has been completed . SECTION 2. The total cost of said construction work is in the amount of $124,000 . SECTION 3. The work is hereby accepted and approved . SECTION 4. The City Clerk is directed to forthwith forward a "Notice of Completion" to the County Recorder of the County of Orange for recording.
