ZA Resolution-13-07-26-01RESOLUTION NO. 13-07-26-01 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO APPROVING A 1 -YEAR TIME EXTENSION OF ZONING ENTITLEMENTS FOR CONDITIONAL USE PERMIT (CUP) 11-004 FOR FOR A PREVIOUSLY APPROVED WIRELESS FACILITY LOCATED IN THE SAN JUAN SPORTS PARK ON APPROXIMATELY 17 ACRES OF CITY -OWNED PARK LAND, GENERALLY LOCATED 600 FEET NORTH OF CAMINO DEL AVION AT 25925 CAMINO DEL AVION, ASSESSOR PARCEL NUMBER (APN)121-190-57. (CORE DEVELOPMENT-VERIZON WIRELESS) WHEREAS, Sonal Thakur, representative for the applicant, has requested a one-year time extension for Conditional Use Permit (CUP) 11-004 in order to develop a sports light standard housing wireless telecommunications equipment; and, WHEREAS, the City of San Juan Capistrano is the owner of real property located generally located 600 feet north of Camino Del Avion at 25925 Camino Del Avion, Assessor Parcel Number (APN) 121-190-57; and, WHEREAS, a Notice of Exemption was posted in accordance with the California Environmental Quality Act (CEQA) Guidelines; and, WHEREAS, the project is consistent with the City's adopted Architectural Design Guidelines; and WHEREAS, the zoning entitlements for the project would otherwise expire on July 26, 2013 if not extended by the Zoning Administrator who is authorized by the Title 9, Land Use Code to extend such entitlements for 1 -year per request up to a maximum of three (3) years from the original approval pursuant to Municipal Code Section 9-2.317 ft and, WHEREAS, the Zoning Administrator of the City of San Juan Capistrano is granted the authority to approve time extensions pursuant to Municipal Code section 9- 1.11(d)(2); and WHEREAS, this public hearing was duly noticed in a local newspaper and was mailed to property owners within 1,000 feet of the subject property; and, WHEREAS, the Zoning Administrator has considered all oral and written testimony offered at the public hearing; and, NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator hereby makes the following findings: 1. The project applicant has not proposed any changes to the project as approved by the Planning Commission on July 26, 2011; and, ZA Resolution 13-07-31-01 2 July 31, 2013 2. Neither the policies of the City's General Plan Land Use Element nor the provisions of Title 9, Land Use Code have changed so as to create inconsistencies or non - conformities; and, 3. The project is consistent with the General Open Space land use designation on the General Plan Land Use Map; and, 4. The project is consistent with the CP (Community Park) zone district and more specifically, the permitted uses and development standards set forth in Municipal Code Section 9-3.305; and, 5. The project remains consistent with the City's adopted Architectural Design Guidelines. NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano grants a time extension of 1 -year subject to conditions of approval set forth in the Planning Commission Resolution 11-07-26-01. NOW, THEREFORE, BE IT FURTHER RESOLVED that the zoning entitlements for the project shall expire July 26, 2014 unless the applicant has obtained building permits and commenced construction. EFFECTIVE DATE & FINAL APPROVAL: The decision of the Zoning Administrator shall become final on July 31, 2013 at 5:30 p.m. if an appeal has not been filed prior to that date and time.
