WHEREAS, Sonal Thakur, representative for the applicant, has requested a
twelve month time extension for Conditional Use Permit (CUP) 10-013 in order to develop
a faux mono -eucalyptus tree housing an unmanned telecommunications facility; and,
WHEREAS, the City of San Clemente is the owner of real property located
east of the intersection of Paseo Peregrino and Calle Andalucia in San Juan Capistrano,
CA (APN 675-321-03); and,
WHEREAS, a Notice of Exemption was posted in accordance with the
California Environmental Quality Act (CEQA) Guidelines; and,
WHEREAS, the project is consistent with the City's adopted Architectural
Design Guidelines; and
WHEREAS, the zoning entitlements for the project would otherwise expire on
April 26, 2013 if not extended by the Zoning Administrator who is authorized by the Title 9,
Land Use Code to extend such entitlements for twelve (12) months per request up to a
maximum of three (3) years from the original approval pursuant to Municipal Code Section
9-2.317(f); and,
WHEREAS, the Zoning Administrator of the City of San Juan Capistrano is
granted the authority to approve time extensions pursuant to Municipal Code section 9-

WHEREAS, this public hearing was duly noticed in a localnewspaper •

NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrat

1. The project applicant has notproposed . • to the project as approved by

2. Neither the policies of the City's General Plan Land Use Element nor the provisions
of Title 9, Land Use Code have changed so as to create inconsistencies or non -
conformities; and,
3. The project is consistent with the General Open Space land use designation on the
General Plan Land Use Map; and,
4. The project is consistent with the GOS (General Open Space) zone district and
more specifically, the permitted uses and development standards, set forth in
Municipal Code Section 9-3.305; and,
5. The project remains consistent with the City's adopted Architectural Design
Guidelines.
NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the
City of San Juan Capistrano grants a time extension of twelve (12) months subject to
conditions of approval set forth in the Planning Commission Resolution 11-04-26-01.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the zoning
entitlements for the project shall expire April 26, 2014 unless the applicant has obtained
building permits and commenced construction.
EFFECTIVE DATE & FINAL APPROVAL: The decision of the Zonir-1
Administrator shall become final on June 13, 2013 at 5:30 p.m. if an appeal has not be
filed prior to that date and time. I
