17-0801_EUROFINS EATON ANALYTICAL, INC._E13_Agenda ReportTO : FROM: City of San Juan Capistrano Agenda Report Honorable Mayor and Members of the City Council ~n Siegel, City Manager SUBMITTED BY: Steve May, Public Works and Utilities Director~~ PREPARED BY: Eric P. Bauman, Assistant Utilities Director DATE: August 1, 2017 8/1/2017 E13 SUBJECT: Consideration of an Amendment to the Personal Services Agreement for Water Sample Collection and Laboratory Testing Services (Eurofins Eaton Analytical Inc.) RECOMMENDATION : Approve and authorize the City Manager to execute Amendment No. 1 to the personal services agreement with Eurofins Eaton Analytical Inc., extending the agreement for one year for water sample collection and laboratory testing services, for an amount not to exceed $185,110. DISCUSSION/ANALYSIS: The City has a personal services agreement with Eurofins Eaton Analytical Inc. for testing of the City's drinking water that is required by the United States Environmental Protection Agency (EPA) and the California Department of Public Health (DPH), which regulate and monitor the treatment, delivery, and quality of the water that the City supplies to its consumers. That agreement expires on August 5, 2017, and is proposed to be extended for one year to allow for continued testing while the City conducts a competitive bidding process for these services. The estimated cost for these services is $185,110. It is recommended that the City Council approve Amendment No. 1 to the personal services agreement with Eurofins Eaton Analytical Inc. extending the agreement for one year. The proposed Amendment and the original agreement are provided as Attachment 1 . The original agreement with Eurofins Eaton Analytical Inc. in 2013 was based on a competitive bidding process where there were four proposals received. Two of the proposals did not meet the requirements specified in the request for proposals. Of the remaining two proposals, Eurofins was the low bidder. The original agreement was for a one year term with three, one year extensions. The fee for the services has not changed City Council Agenda Report August 1, 2017 Page2 of2 since the original proposal in 2013, and will remain unchanged for the proposed one year extension period. FISCAL IMPACT: The current budget for Fiscal Year 2017-2018 for water sample collection and laboratory testing services is $185,110. The cost of services under the proposed one year agreement extension will not exceed the budgeted amount. ENVIRONMENTAL IMPACT: This action is not subject to the California Environmental Quality Act (CEQA) pursuant to section 15060(c)(3) of CEQA Guidelines because the activity is not a project as defined in Section 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, and the project has no potential for resulting in physical change to the environment, directly or indirectly. PRIOR CITY COUNCIL REVIEW: • On August 6, 2013, the City Council approved a Personal Services Agreement for a one year term with three, one-year optional extensions for water sample collection and laboratory testing services with Eurofins Eaton Analytical Inc. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: • On August 6, 2013, the Utilities Commission recommended that the City Council approve a Personal Services Agreement for water sample collection and laboratory testing services with Eurofins Eaton Analytical Inc. Our program follows a logical work sequence and employs a number of criteria to reflect our commitment to generating accurate, legally and scientifically defensible compliance data . The QAP is on its 34 1h revision, is reviewed at least annually, and includes the following elements: • Fmmalized, validated analytical and operational standard operating procedures. • Annual demonstrations of capability and method detection limits for all compliance tests . • Ongoing checks to ensure the use of current and acceptance standards. " Usc of minimum reporting levels that arc at or above the lowest calibration standard and also above the method detection limit to help foster a high degree of data accuracy. • Strict adherence to chain of custody procedures and sample documentation. • Calibration levels that are established at or below federal triggers for increased monitoring. • Multiple data reviews at the peer, supervisor, independent QA validator and project management levels. e: Usc of sophisticated queries for data storage, retrieval, interpretation, control charting and early warning of preliminary results inconsistent with sample history or exceeding regulatory thresholds. • Data mining and query by location, date or constituent for clients from our LIMS. • Pre-qualified subcontract laboratories for subcontracted analyses + contingency for tests performed in-house. Additionally Eurofins maintains a UCMR3-specific Quality Assurance Program Plan (QAPP) that has been subjected to EPA review. This QAPP incorporates the aforementioned QAP plus additional specific unique UCMR3 QA/QC protocols, such as those referenced earlier. ATTACHMENT 1, Page 18 of 32 Eurofins also maintains an Ethics and Data Integrity Program that includes all elements outlined in the 1NI lab standards. Aside from our comprehensive internal QAP and UCMR3 QAPP, Eurofins is also subj ect to pre-scheduled and unann ounced audits by regul ato rs and other grd party entities as frequently as every year. The chart summary to the left reflects the diversity and frequency of audits our facility and staff are subjected to. In contrast, most laboratories are audited by the same regulatory agency every 2-3 years. \'EAR 2010 2011 2012 AC~CY Naw1111CJDEP Calfbrria .DPH (NE!.AC) U.S liPA (VCMIU) Calililmio Dl'H (ElM) CO<a Cola Corpo!llion US. ATTACHMENT 1, Page 24 of 32 ... ' i .'I ': . Your Project Manager, Ms. Debbie Frank, brings more than twenty years of water and wastewater experience to our project team. Because of her extensive regulatory and technical knowledge, including knowledge of Title ll, Reuse and NPDES regulatory/permits thresholds, Ms. Frank is able to provide advanced notice of results critical to treatment plant operations Our consciousness of your diverse and specific reporting limit requirements affords us the opportunity to advise you in advance concerning potential out of compliance situations. This advance warning provides time for recollection, analysis and verification of correct results prior to submission to regulatory agencies. A similar approach is taken concerning data that does not match historical trends. Eurofins' LIMS archives all historical data into a reference table and submits alert reports to the Project Manager to advise whenever a result is outside of the median range so that we can pass along these advanced alerts to you for feedback and proper follow up actions. Pre-labeled containers are included with ice packs, packaging material, customized custody form and kit inventory for every entry point, plant effluent and set of source and/or distribution system sample sites. Foam inserts and colol' coded caps are used for UCMR3 kits to provide a user-friendly mechanism to complete these complex sampling requirements. Our login staff also plays a special role in discerning the important distinction of your samples. All City samples are received the day of collection and immediate inspected to verify acceptability for compliance analysis. If problems are identified with samples upon our receipt, we notify you to inform concerning the need for recollection to meet compliance requirements. Verbal and electronic documentation of compliance concerns as well as electronic acknowledgment of acceptable sample receipt are submitted to you for your tracking and project management purposes. Our LIMS is customized to capture data specific to UCMR3 requirements. Information entered into the LIMS to document sample condition, analysis results, FB results (relative to the MRL), LRB-LFB-MRL checks acceptance, MS/MSD frequency and holding times is used to prompt us to contact you immediately whenever any of these UCMR3 criteria are not met. p,...rvalion dlod< ~one• on CDnt>lntnJ lor tho molhod lll!tdnod In this notlct, -plo ,..qulred within 30 doro.
