A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN
CAPISTRANO CONFIRMING ISSUANCE OF A CATEGORICAL EXEMPTION AND
APPROVING ARCHITECTURAL CONTROL (AC) 04-01 FOR AN APPROXIMATELY
8,636 SQ. FT. TWO-STORY AUTO-DEALERSHIP OFFICE AND SHOWROOM AT 33555
CAMINO CAPISTRANO (WESELOH & SONS - HUMMER).
Whereas, John S. Morgan requests on behalf of the property owner, Weseloh
& Sons Chevrolet approval of an architectural control application (AC 04-01) to permit
development of an approximately 8,636 sq. ft. auto-dealership office and showroom on
property located at 33555 Camino Capistrano which is General Plan-designated “QI”
(Quasi-Industrial) and classified as “CM” (Commercial Manufacturing); and,
Whereas, the proposed project has been processed pursuant to Section 9-
2.301, Development Review of the Land Use Code; and,
Whereas, the Environmental Administrator has reviewed the project pursuant
to Section 15061 of the California Environmental Quality Act (CEQA), issued a Class 3
(1 5303. New Construction and Conversion of Small Structures) categorical exemption, and
caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA
Guidelines; and, -
Whereas, the Planning Commission has considered the Environmental
Administrator’s determination pursuant to Section 15074 of the California Environmental
Quality Act (CEQA), has considered all project environmental documentation and technical
studies ; and,
Whereas, the Planning Commission conducted a duly-noticed public hearing
on March 23, 2004 pursuant to the provisions of Administrative Policy 409, and Planning
Department Policy 510 to consider public testimony on the proposed project and has
considered all relevant public comment.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of
the City of San Juan Capistrano does hereby make the following findings:
1. The proposed project is consistent with the policies and objectives of the San Juan
Capistrano General Plan, specifically the Land Use Element, because the proposed
land use is consistent with the land use designation for the subject site; and,
2. The proposed project complies with all applicable provisions of the Land Use Code
subject to conditions of approval contained in this resolution; and,

The project plans, as conditioned to be modified, comply with all provisions of Title
9 of the San Juan Capistrano Municipal Code. The proposed structure will be in
compliance with building height and setback standards. No variances are being
sought as part of the subject development request;
The site plan is compatible with existing land uses on the project site. The
proposed site design is in-keeping and compatible with surrounding auto
dealerships, land uses and building setbacks. The proposed addition will be
setback approximately 160 ft. from the Camino Capistrano right-of-way;
The architectural and general design of the project, as conditioned, is generally
consistent with the goals, policies and objectives of the Community Design Element
and all other applicable provisions of the General Plan; The proposed structure will
be consistent with the architectural design, and materials of existing buildings in the
immediate vicinity;
The general site considerations, including the character, scale and quality of the
design are consistent with the adopted Architectural Design Guidelines of the City.
The proposed architectural character, scale and quality is consistent with the
adopted Architectural Design Guidelines. The proposed structure will incorporate
massing offsets and architectural details which would be complimentary to the
existing architectural style and enhance the overall building’s appearance;
The site plan is functional and safe in regards to existing or mitigated off-site
conditions as they relate to adequacy of vehicular, bicycle and pedestrian
circulation. The proposed design incorporates adequate pedestrian access from
public sidewalk and parking lot areas. The primary vehicular and pedestrian access
points to the site will not be modified. The landscaped areas adjacent to the main
entry will be designed in accordance with Title 9 sight distance requirement ; and
The general landscape design, including the location, type, size, color, texture and
coverage of plant materials has been considered to insure visual relief and to
complement buildings and structure. The proposed design solution will incorporate
landscaping areas adjacent to the building structure, thus enhancing the aesthetic
character of the building design.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning
Commission of the City of San Juan-Capistrano hereby approves the project subject to the
following conditions of approval:

a.
The final landscape plan shall be submitted to the Design Review Committee (DRC)
for review and approval prior to issuance of building permits and shall contain the
following features:
a. A minimum 10 ft. landscaped area between the vehicle display area
and the front property line; decorative boulders shall be shown on the
plan and placed behind the landscaped setback area.
Clay pottery planters in the area adjacent to the building frontage. b.
No fence, wall, hedge or other barrier shall be erected, placed, planted or allowed
to grow so as to materially impede vision above a height of 3 ft. as described and
required in Municipal Code section 9-3.559 - Visibility at intersections/ driveways.
All architectural building and site lighting shall be in compliance with Municipal Code
lighting requirements and subject to review and approval by DRC.
Darker color limestone shall be utilized for exterior building wall wainscoting, in
accordance with DRC’s recommendations. The selected limestone color shall be
subject to final review and approval by DRC.
Adequate space shall be accommodated for on-site source separation of
recoverable solid waste during construction activity. Additionally all building site
plans shall depict the area for recycling space allocation per SJCMCSec. 9-3.629.
Prior to issuance of building permits, the applicant shall submit a written waste
management plan and show on the site plans the location of receptacle(s) to
accumulate on-site generated solid waste for recycling purposes. Prior to issuance
of a Certificate of Occupancy the applicant shall submit solid waste generation
tonnages, disposal, and recycling records from remodeling activity.
The project shall be subject to and shall comply with all applicable Municipal Code
requirements, development standards, guidelines and fees.
Fire Hydrants
Service Codes:
Prior to issuance of building permits, the applicant shall submit a fire hydrant
location plan to the Fire Chief for review and approval.

Prior to issuance of building permits, the applicant shall submit evidence of the on-
site fire hydrant system to the Fire Chief and indicate whether it shall be publicly or
privately maintained. Privately maintained hydrant systems shall be reviewed and
approved by the Fire Chief prior to building permit issuance and the applicant shall
make provisions for the repair and maintenance of the system in a manner meeting

the approval of the Fire Chief. Please contact the OCFA at (714) 744-0499 or visit
the OCFA website for a copy of the “Guidelines for Private Fire Hydrant &/ or
Sprinkler Underground Piping.”
Prior to issuance of any certificate of occupancy, all fire hydrants shall have a blue
reflective pavement maker indicating the hydrant location on the street as approved
by the Fire Chief, and must be maintained in good condition by the property owner.

Water A vailability
Service Code: 2.12 (Emergency Access 8 Fire Hydrant Location)
Prior to issuance of building permits, the applicant shall provide evidence of
adequate fire flow. The “Orange County Fire Authority Water Availability for Fire
Protection” form shall be signed by the applicable water district and submitted to the
Fire Chief for approval. If sufficient water to meet fire flow requirements is not
available an automatic fire extinguishing system may be required in each structure
affected.
Automatic Fire Sprinkler System
Service Code: 2.18-2.26 (Commercial Fire Sprinklers)
Prior to issuance of building permits, the applicant shall submit plans for any
required fire sprinkler system in any structure to the Fire Chief for review and
approval. Please contact the OCFA at (714) 744-0499 to request a copy of the
“Orange County Fire Authority Notes for New NFPA 13 Commercial Sprinkler
Systems.”
Prior to issuance of any certificate of occupancy, this system shall be operational
in a manner meeting the approval of the Fire Chief.
Fire Access Roads
Service Code; 2.12 (Emergency Access 8 Fire Hydrant Locations)
Prior to issuance of building permits, the applicant shall obtain approval from the
Fire Chief for all fire protection access roads to within 150 feet of all portions of the
exterior of the showroom building and to within 150 feet of all portions of the exterior

to obtain a copy of the ”Guidelines for Emergency Access.”
Prior to issuance of a precise grading permit, the applicant shall submit and obtain
approval; of the Fire Chief and City Staff of plans for all public or private access
roads, street and courts. The plans shall include plan and sectional views and
indicate the grade and width of the access road measured flow-line to flow-line.
A legal instrument shall establish a fire department access easement prohibiting
obstructions such as speed bumps/humps, control gates or other modifications
within the approved fire department access easements or road. Please call OCFA

Fire Lane Markings
Service Code: 2.12 (Fire Lane Markings)
Prior to issuance of building permits, the applicant shall submit plans and obtain
approval from the Fire Chief for fire lanes on required fire access less than 36 feet
in width. The plans shall indicate the locations of red curbs and signage and include
a detail of the proposed signage including the height, stroke and colors of the
lettering and its contrasting background. Please contact the OCFA at (714) 744-

Access Roadways and Fire Lane Requirements.”
Prior to issuance of any certificate of occupancy, all fire lanes shall be installed in
accordance with the approved fire lane plan documented in the recorded legal
instrument and the recorded legal instrument shall be provided for our records. The
recorded legal instrument shall contain a fire lane map exhibit, provisions that
prohibit parking in the fire lanes and a method of enforcement. The applicant shall
submit three copies of draft legal documents for review and approval by the Fire
Chief prior to recordation.
Access Gates
Service Code: 2.13 (Vehicular Emergency Access Gate Review)
Prior to issuance of building permits, the applicant shall obtain the approval from the
Fire Chief for the construction of any gate across required fire department access

obtain a copy of the “Guidelines for Design and Installation of Emergency Access
Gates and Barriers.”
Combustible Construction Letter
No OCFA Service Code (Usually received with 2.12)
Prior to the issuance of building permits for combustible construction, the builder
shall submit a letter on company letterhead stating that water for fire-fighting
purposes and all weather fire protection access roads shall be in place and
operational before any combustible material is placed on-site. Building permit will
not be issued without OCFA approval obtained as a result of an on-site inspection.

Hazardous Materials
Service Code: 2.39 (Hazardous Materials Review)
Prior to the issuance of building permits, the applicant shall submit to the Fire Chief
a list of all hazardous, flammable and combustible liquids, solids or gases to be
stored, used or handled on site. These materials shall be classified according to the
Uniform Fire Code and a document submitted to the Fire Chief with a summary
sheet listing the totals for storage and use for each hazard class. Please contact

Prior to the issuance of a building permit, the applicant shall complete and submit
to the Fire Chief a copy of the “Hazardous Materials Disclosure Chemical Inventory
and Business Emergency Plan” packet. Please contact the OCFA Hazardous
Materials Services Section at (714) 744-0463 to obtain a copy of the packet.
Fire Alarm System
Service Codes: 2.36-2.38 (Fire Alarm & Fire Sprinkler Monitoring Reviews)
Prior to issuance of a building permit, plans for the fire alarm system shall be
submitted to the Fire Chief for review and approval. Please contact the OCFA at
(714) 744-0499 or visit the OCFA website to obtain a copy of the ”Guideline for New
and Existing Fire Alarm Systems.”
This system shall be operational prior to the issuance of a certificate of use and
occupancy.
Storage Tanks
Service Codes: 2.41 8 2.42 Underground & Aboveground Storage Tank Installation)
Prior to the issuance of a building permit or installation of an aboveground or an
underground tank, plans shall be submitted to the Fire Chief for review and
approval. Please contact the OCFA at (714) 744-0499 or visit the OCFA website
to obtain a copy of the “Guidelines for Private Use Dispensing of Motor Vehicle Fuel
from Protected or Multi-Hazard Aboveground Storage Tanks,” or “Guidelines for the
Installation and Modification of Underground Storage Tanks at Fuel Dispensing
Stations.”
EFFECTIVE DATE & FINAL APPROVAL: This project approval shall
become effective following expiration of the fifteen (1 5) day appeal period without filing of
an appeal application. The appeal period shall expire at 5:OO p.m., Wednesday, April, 7
2004. This project approval shall be valid for a period of two (2) years from the date of
approval of this resolution, and shall expire on April 7, 2006, unless a time extension
request or buildinglgrading permit application related to this discretionary approval is
submitted to the City prior to that date.
