PC Resolution-04-01-27-01.- PC RESOLUTION NO. 04-1 -27-1 MODIFICATION TO TRACT MAP 9382. BELFORD TERRACE A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING DESIGN MODIFICATIONS TO THE PROJECT ENTRY STATEMENT FOR THE BELFORD TERRACE NEIGHBORHOOD LOCATED AT THE INTERSECTION OF ORTEGA HIGHWAY AND BELFORD DRIVE (ASSESSORS PARCEL NUMBER(S) 650-192-01,24 (BELFORD TERRACE). Whereas, the Belford Terrace Homeowners Association, as part of the Landscape Maintenance District for the neighborhood, have requested approval of design modifications to the existing entry statement for the Belford Terrace neighborhood including modifications to landscaping, retaining walls, fencing, lighting, and signage; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA), issued a Class 2 categorical exemption (California Environmental Quality Act Guidelines, Section 7 5302, Replacement or Reconstruction), and caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA Guidelines; and, - Whereas, the Design Review Committee considered the proposed project at their Thursday, January 15, 2004 meeting and forwarded the project to the Planning Commission with a recommendation of conditional approval; and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA), has considered all project environmental documentation and technical studies ; and, Whereas, the Planning Commission conducted a duly-noticed public meeting on January27,2004 pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 51 0 to consider public testimony on the proposed project and has considered all relevant public comment. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Community Design Element because the - PC Resolution 04-1-27-1 2 January 27,2004 proposed entry improvements are compatible with the design policies for "scenic drives"; and, 2. The proposed project complies with all applicable provisions of the Title 9, Land Use Code with respect to intersection visibility; and, 3. The proposed project is consistent with the City's Architectural Design Guidelines because the proposed modifications to the Belford Terrace entry statement are consistent with the su bdivision-related design policies. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the project subject to the following conditions of approval: 1. Prior to issuance of a building permit or a notice to proceed to the contractor, the final construction plans shall be subject to review and approval by the Planning Director to determine substantial compliance with the Planning Commission-approved preliminary design plans. 2. The contract specifications and/or the final working drawings for the project shall include the following provisions: a. All materials and/or colors shall be substantially consistent with the catalogue information presented to the Commission for the ledger stone, wall cap, sign lettering, and tube-steel fencing subject to review and approval by the Planning Director. Provide two or three stack stone courses between the slate background for the sign and the bottom of the wall cap. For the cast concrete cap on the retaining wall, use a stylized edge treatment (rounded or similar). The wall pilasters, because they are not structural elements, shall be removed. For the type of ledger stack stone, the project shall use Coronado Stone Company, "Chablis" or 'Brookside" stack stone or equivalent. b. c. d. e. 3. Prior to issuance of a building permit, the project will submit a landscape plan which will be subject to Design Review Committee review and approval. Prior to final inspection of improvements, the project will complete installation of all landscaping consistent with the approved landscape plan. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (1 5) day appeal period without filing of an appeal application. The appeal period shall expire on Wednesday, February 11,2004 at 500 p.m. Pursuant to Section 9-2.345(h), this project approval shall be valid for a period PC Resolution 04-1-27-1 3 January 27,2004 of two years from the date of approval of this resolution, and shall expire on Friday, January 27, 2006 unless a time extension request or building permit or grading permit related to this discretionary approval have been submitted to the City prior to that date.
