SUBJECT: Housing Advisory Committee Actions of June 18, 1998
This report summarizes actions taken by the Housing Advisory Committee on June 18, 1998 No
action is required unless Council wishes to hold special review of an item
on Attendance

A. m1,1, TO ORDER - Vice-chairperson de Guevara called the meeting to order at 7 06 p m
B -COMMUNICATIONS - None.
C. MINUTES OF FEBRUARY 26. 1998 - The action minutes of February 26, 1998 were
unanimously approved, subject to a correction changing “Chairman Dean” to “Member
Palermo” on Page 1, Item D 1, paragraph 3, second sentence
D. NEW BUSINESS
1 Status Repon - The Committee received and filed the housing
program status report Discussion ensued regarding the following issues
a cement ProPram - Staff provided status on the bid process
for rehabilitation of the condominiums noting that only one bid was
submitted and that new bids had been invited for a construction manager
Member Palermo supported use of San Juan Capistrano contractors provided
this did not delay the project Staff advised that contractors in the City and
locally had not responded to the City’s request for bids Member Colhns
made a motion recommending that staff take steps to see that local firms,
preferably within San Juan Capistrano, are selected whenever possible
Member Buckner seconded the motion, and the motion passed 5-O

b. -Timer Proerm - Staff advised that the funding for the first
time home buyer program had expired on June 30, 1998. Staff also indicated
that one recipient breached the agreement and that the City had begun
proceedings to accelerate the City’s second mortgage
Member Collins moved to recommend that staff require loan recipients who
breach the terms of the agreement to pay all costs for accelerating payment
of a City’s second mortgage The motion was seconded by Member Palermo
and carried unanimously
C. jarHome Prom - Member Winkler
requested that the inspections be scheduled for Capistrano Terrace Mobile
Home Park first. Staff advised that the City intended to inspect the smallest
mobile home park, Villa San Juan, first to work out any problems before
inspecting the larger parks Member Winkler requested that Thomas
Tomlinson contact her to discuss the inspection schedule
2. Subsidy Prom Educa - The Committee reviewed the quarterly
progress report from Mary Erickson Community Housing Corporation Discussion
ensued regarding the criteria and format for the quarterly reports. A majority of the
Committee concurred with the importance of obtaining information regarding any
tenant/landlord violations and/or non-payment of homeowners’ association dues.
However, Member Palermo expressed concerns with the legality of allowing Mary
Erickson Community Housing Corporation to obtain information about tenants and
landlords from the homeowners’ associations Staff advised that they would obtain
legal counsel with regard to this issue
The Committee asked stafF to ensure the number of monthly volunteer hours required
by program participants in the regulations is consistent with the criteria to be used
in the quarterly reports By unanimous vote, the Committee concurred with the staff
recommendation, pending a decisron from legal counsel regarding obtaining
information from homeowners’ associations regarding tenant/landlord violations, as
follows
a Received and filed the Rental Subsidy Program Quarterly Report, subject to
submittal of a quarterly report to the City’s Planning Department by
August 14, 1998, for the period from May 5 through August 4.
b Approved the requirement that Mary Erickson Community Housing submit
quarterly reports to the City’s Planning Department within 10 days following
the end of the following reporting periods: February 5 through May 4, May 5
through August 4, August 5 through November 4, and November 5 through
February 4.

C Approved the proposed criteria for determining continued eligibility in the
program each quarter and prior to renewal of agreements and leases. The
Committee requested that staff verify the regulations regarding the number
of volunteer hours required. In addition, the Committee requested inclusion
of criteria requiring owners to be current on payment of homeowners’
association dues, pending a decision from legal counsel.
d Approved the proposed chart to be completed by Mary Erickson Community
Housing for inclusion in each quarterly report The Committee
recommended that the report include two additional items for review of
tenant/landlord compliance with association rules and timely payment of
association dues.
e Recommendation that new leases include owner authorization for Mary
Erickson Community Housing Corporation and the City of San Juan
Capistrano to obtain information from the association regarding any tenant
and/or landlord violations or non-payment of dues.
E. COMMITTEE/STAFF COWNTS
on of the m Advisorv Cow - The Committee voted
unanimously to elect Joann de Guevara as the Chairperson and Richard Collins as Vice-
Chairperson of the committee for the new year
Member Collins requested a copy of the February 26, 1998 Housing Advisory Committee
meeting packet. Member Winkler stated she would pick up a copy of the Land Use Code for
the Mobile Home Park Districts at the Planning Department on June 19th
