Apple, Planning Director A. CALL TO ORDER — Chairperson Marquez called the meeting to order at 7:00 P.M. B. ORAL COMMUNICATIONS - None C. MINUTES OF JANUARY 24, 2007 The minutes of January 24, 2007 were approved by a vote of 3-0-1, Member Marquez abstained. D. NEW BUSINESS 1. Consideration of Acceptance of "Irrevocable Offer to Convey Easement" for Street and Highway Purposes for Calle Rolando - Ms. Lehmann provided a staff presentation to the Committee. She advised that in preparing the final street improvement plans for Calle Rolando, it was discovered that the legal description prepared in 1976 for the "Irrevocable Offer to Convey Easement" for Calle Rolando contained an error which shifted the Calle Rolando street right-of-way approximately 15 feet to the south of the intended location. Before construction on the street improvements may proceed, it is necessary to rescind the previously adopted Resolution No. 06-09-19-06 and accept the corrected right-of- way. San Juan Capistrano: Preserving the Past to Enhance the Future Printed on 100% recycled paper Housing Advisory Committee Minutes April 25, 2007 Page - 2 - Ms. Lehmann indicated that the City will be responsible for correcting the right-of-way easement and for any costs/damages to the property owners' properties associated with the street improvements to Calle Rolando, including any work required to restore utilities, irrigation lines, landscaping, curbs, signage, or to repair other damage to their property as a result of the street improvements. Ed and Lil Grabowski, the property owners for the property at the corner of Alipaz St. and Calle Rolando, have raised concerns with maintenance of the right-of-way easement areas and future costs that may arise related to the right-of-way easement. City staff does not anticipate future problems with the right-of-way. Therefore, if additional costs and legal fees are incurred at some future date, the circumstances will be evaluated at that time to determine responsibility for the costs. Staff noted that this agenda item was an advertised public hearing for the City Council meeting on April 3, 2007 and that the City Council continued the public hearing to May 1, 2007. Staff recommended that the Housing Advisory Committee forward the draft resolution to the San Juan Capistrano Community Redevelopment Agency with a recommendation to rescind Resolution No. 06-09-19-06 and to approve the Irrevocable Offer to Convey Easement for Calle Rolando for street and highway purposes. Chairperson Marquez opened the floor for public comment. There being no one wishing to speak, Committee discussion ensued. The Committee raised questions regarding the costs, and staff indicated that the costs for the engineering services to correct the mistake are approximately $24,200. The City proposes to pay for these costs with Community Development Block Grant program income funds. The Committee inquired whether the City could require the original engineer who made the mistake to the legal description to pay for the corrections. Staff advised that the original engineer was deceased. The $24,200 in program income would fund one housing rehabilitation loan; however, it was noted that the new $400,000 HOME grant is solely to fund housing rehabilitation loans. Therefore, staff stated that there is no financial impact to the housing rehabilitation loan program. Member Ratcliffe commented that the City has ample housing rehabilitation funds and the program income funds should be used to fund the right-of-way correction for the Habitat for Humanity project. Member Ratcliffe made a motion to forward the draft San Juan Capistrano Redevelopment Agency Resolution rescinding Resolution No. 06-09-19- 06 and accepting the Irrevocable Offer to Convey Easement for Calle Housing Advisory Committee Minutes April 25, 2007 Page - 3 - Rolando for street and highway purposes to the Agency with a recommendation of approval. Member Marquez seconded the motion, which was approved 4-0. 2. Consideration of Approval of the State of California Community Development Block Grant (CDBG) Program Income Reuse Plan — The staff presentation and Commission discussion for this item was discussed during the previous agenda item as part of the Irrevocable Offer to Convey Easement for Calle Rolando. There being no further comments, Member Ratcliffe made a motion to forward the draft resolution approving the modification to the State of California Community Development Block Grant (CDBG) Program Income Reuse Plan to the City Council with a recommendation of approval. Member Marquez seconded the motion, and the motion passed 4-0. 3. Status Report on Housing Programs — Ms. Lehmann provided a staff presentation summarizing the status of the Rental Subsidy Program, Little Hollywood Affordable Rental Program, the 2004 HOME First -Time Homebuyer and Owner -Occupied Housing Rehabilitation grant, the submittal of the 2006 Owner -Occupied Housing Rehabilitation Program Over -The -Counter Grant application, the 2004 Community Development Block Grant, the Capistrano Terrace Mobile Home Park owner's intent to close the park, and the status of the Whispering Hills Apartments, Little Hollywood expansion and Habitat for Humanity's affordable housing projects. The Housing Advisory Committee provided the following comments regarding the following projects: Whispering Hills Apartments: Member Ratcliffe questioned whether the applicant paid any affordable housing fees on their first phase tract. Staff advised that the applicant will be required to pay the 1 percent of the assessed valuation housing in -lieu fees for each building permit issued to the developer. Custom homes will not be required to pay this fee. Little Hollywood Expansion: Member Freese inquired whether the City had received elevations or plans for this project. Staff advised that three conceptual plans had been reviewed by the Design Review Committee, but that staff is still waiting for submittal of formal plans. Staff advised that the project will be scheduled for the Committee's review during the formal development review process. Housing Advisory Committee Minutes April 25, 2007 Page - 4 - E. COMMITTEE/STAFF COMMENTS Member Freese provided a summary of meetings she attended with the owners of the Mission Village shopping center at Camino Capistrano and Del Obispo Street. She indicated that the purpose of the meeting was to discuss the possibility of reconstructing the shopping center closer to Camino Capistrano, providing retail on the first floor, affordable housing on the second floor, and parking in the rear of the property adjacent to the railroad tracks. This change would impact four property owners, and she advised that further meetings are planned to discuss this in more depth. Member Freese also brought up the possibility of providing affordable housing on the lower Rosan property next to the mobile home park. She noted the City is investigating use of the property for the auto dealers to use for overflow parking. Member Ratcliffe noted that new affordable housing needs to be in close proximity to public transit, schools, and buffered from the railroad tracks. Staff advised that the next regularly -scheduled meeting would be June 27, 2007. F.
